SUBJECT: Proposed Amendment to Bill No. 147;AN ORDINANCE AMENDING
CHAPTER 2 AND CHAPTER 25 OF THE HAWAI`I COUNTY CODE 1983
(2016 EDITION,AS AMENDED),RELATING TO TRANSIENT
ACCOMMODATIONS.
Transmitted herewith is a proposed amendment to Bill No. 147. The amendment is shown below
in Ramseyer format with respect to the contents of Bill No. 147;material to be deleted is bracketed
and stricken, and material to be added is underscored.
1. SECTION 7 of Bill No. 147,which amends chapter 25,article 4, of the Hawai`i County
Code 1983 (2016 Edition, as amended) by adding a division, is amended by amending the
second section thereof, entitled"Short-term vacation rentals;where permitted;
nonconforming use certificate", subsection(a),to read as follows:
"(a) An STVR is permitted in the following zoning districts:
(1) [RM,] V, CG, CN, CV, and CDH;
(2) Any residential district, other than RM,that is wholly situated within any of
the following:
(A) A Resort or Resort Node area, as designated in the General Plan; or
(B) An area designated as Open in the General Plan that is adjacent to an
area identified in subparagraph(A) and that is located along the
shoreline; [and]
(3) A project district,where consistent with the uses allowed in the underlying
zoning district[.]; and
(4) RM,provided that plan approval for the dwelling used as the STVR was
issued prior to the effective date of this ordinance."

2. SECTION 19 of Bill No. 147,which amends chapter 25, article 5, division 3, section
25-5-32,of the Hawai`i County Code 1983 (2016 Edition,as amended)by amending
subsection (a), is amended by amending paragraph (19)to read as follows:
"(19)Short-term vacation rentals[.],as permitted under section 25-4- ."

if it were adopted is not attached.
