Code of Ethics
This is to transmit Bill 305, Draft 3, which includes changes discussed in concept at the Finance Committee
meeting on September 6, 2000. Major changes are summarized below.
1. Moved the definitions for "Agency" and "Business" from Section 2-91.1, HCC, to
Section 2-82, HCC.
2. Replaced the definition of "Officer" in Section 2-82, HCC, with the definition in Section
2-91.1, HCC.
3. Added new definitions taken from state law for "Controlling interest", "Financial
interest", "Official act" or "Official action", and "Official authority."
4. Page 4: Section 2-83(a)(3)-"Using county time, equipment or other facilities for private
business or campaign purposes."
5. Page 4: Section 2-83(a)(5) - Added "Using county property or personnel for other than
a public activity or purpose."
6. Page 4: Section 2-84(a)(3): Added clause prohibiting an officer or employee from taking
official action directly affecting a business in which the employee's family has a
substantial financial interest.
7. Page 5: "Section 2-85, Contracts. (a) A county agency shall not enter into any contract
involving services or property of a value in excess of $10.000 to procure or dispose of
goods or services, or for construction, with an officer, an employee, or a business in
which an officer or an employee has controlling interest involving services or property 11
of a value in excess of $10,000] unless
Other minor changes have been made to make the law consistent, clarifying or gender neutral.
