AN ORDINANCE AMENDING CHAPTER 15,ARTICLES 4 AND 8,OF THE HAWAI`I COUNTY CODE 1983 (2016 EDITION,AS AMENDED),RELATING TO PARKS. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI`I: SECTION 1. The purpose of this ordinance is to remove "Punalu`u Black Sand Beach Park"from the list of parks and recreational facility schedule, due to the expiration of the County's lease for the property. SECTION 2. Chapter 15, article 4,section 15-39, of the Hawai`i County Code 1983 (2016 Edition, as amended), is amended by amending subsection(a)to read as follows: "(a) Camping is only permitted as follows: (1) At Laupahoehoe Beach Park,Kolekole Beach Park,Isaac Kepo`okalani Hale Beach Park, [Punalu`u Black Sand Beach Park,] Whittington Beach Park, Miloli`i Beach Park, Ho`okena Beach Park,Mahukona Beach Park,Kapa'a Beach Park, and Spencer Park at`Ohai`ula Beach. The camper shall give due regard to the rights and convenience of other users of the park, shall not obstruct any roadway or pathway,and shall not monopolize any facility intended for the use of all users of the park. (2) At Spencer Park at`Ohai`ula Beach, camping is permitted in two camping areas known as areas"A"and"B."Area"A" is mauka of the large pavilion between the Hapuna boundary of the park and the outdoor courts.Area"B"is between the north side restroom and the central restroom." SECTION 3. Chapter 15, article 8, section 15-68.1, of the Hawai`i County Code 1983 (2016 Edition, as amended), is amended by deleting the following listing from the"Ka`U"table of the parks and recreational facility schedule: "[Punalu`u Black Sand Beach Park] [9 6 001:006, 011, 012]" SECTION 4. Material to be repealed is bracketed and stricken. In printing this ordinance,the brackets and the bracketed and stricken material need not be included. SECTION 5. Severability. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid,the invalidity does not affect other provisions or applications of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are severable. SECTION 6. This ordinance shall take effect upon its approval.
