Your Committee on Governmental Operations and External Affairs,to which was referred Bill
No. 193,reports as follows:
Bill No. 193,transmitted by Council Members Holeka Goro Inaba and Heather L. Kimball,via
Communication No. 1074, dated August 31,2026, amends Chapter 2,Article 25, Section 2-137, of
the Hawai`i County Code 1983 (2016 Edition, as amended),relating to appropriation of funds to
nonprofit organizations.
Bill No. 193 specifies that nonprofit organizations whose governing board members receive
compensation for their governance duties are ineligible to receive County grant funds.
Member Inaba stated that there has been some confusion in the past regarding nonprofit board
members receiving some form of compensation for some services that they provide to their
organizations, outside of their governance duties.As the language currently stands there is a hard
line allowing for no compensation. He explained that by inserting this language it allows board
members to still receive compensation for additional duties,not related to serving on the board.
Member Kimball added that she believes this is a simple solution that satisfies what the County
intends to accomplish with this added language.
Your Committee on Governmental Operations and External Affairs is in accord with the purpose
and intent of Bill No. 193, and recommends its passage on first reading.
