Subject:NO CLEAR PATH with Draft 3
Please vote NO on Draft 3 and Amend again this November 6th.
It is UNJUST to homeowners who have had Mid-Term (30-180 days) vacation rental homes WITHOUT
NEEDING to get a permit to operate a vacation rental due to the <30 day STVR definition of Bill 108. Many homes,
like ours, were NOT ABLE TO EVEN APPLY for a Special permit, or a non-confirming use permit, since it was in a
restricted STVR area for <30 day rentals at the time of Bill 108 implementation, even though our rental term was
over 30 days. It didn't make sense to have been turned away. Bill 108 did not exclude a Mid-term (30-180) rental in
the noted restricted areas, only <30 day rentals.
We have owned our home in North Kohala for 10 years and have generated over $150,000 in ET and TAT proceeds
for the county, not to mention the property taxes we have paid in excess of $180,000. It is our future retirement
home because we plan to live here in our 60's - whenever we pass away, thereby also contributing to the economy
as residents in the future. Hawaii is Ohana to me because my earliest memories where in Hawaii as a little girl, a
child of an architect who built the Honolulu Airport in the early 70's. Since then our family visited Hawaii - all the
islands - yearly for long vacations. Now we are sharing the Aloha spirit with our only daughter, returning to our home
every year since she was born. We love sharing Aloha with friends and family and visitors, and promote and
support Hawaiian culture.
Please change subsection 25-4-C (b) to the following:
In any district or area not identified in subsection (a), an un-hosted TVR may operate:
1. With a nonconforming use certificate issued pursuant to Ordinance No. 18-114; or
2. With a pre-existing use permit, provided that
(A) At any time between April 1, 2019, and the effective date of this ordinance, the building site was in use
as an STVR available exclusively for rental periods more than thirty days and less than one hundred eighty
days; OR (not and) (B) ....; OR
3. With a NEW PERMIT or Non-Conforming Use Permit application, provided that
(A) the building site was in a (prior) STVR restricted zone, but did not qualify as an STVR permit of
any kind since it was only rented exclusively for periods more than thirty days and less than one
hundred eighty days, at any time between April 1, 2019 and the effective date of this ordinance; OR
(B) the building site was purchased prior to April 1, 2019, and has been operating as an Mid-Term
(30-180 day) TVR as of April 1, 2019, in a restricted TVR zone.
Of course the planning department will have to allow for new permits for the 30-180 prior existing rentals in
restricted zones, which they denied us before.
Bill 108 already reduced the number of Multi-Million dollar homes that are offered as vacation rentals, by forcing
owners to change to a Mid-term (30-180) day rental in ag A zone areas. If you release Draft 3 the way it is written
you will completely eliminate ALL vacation rentals in A zone or other restricted areas. Not providing any
grandfathering lenience to homeowners like us who purchased property 10 years ago and have been conducting a
peaceful 30-180 rental experience for visitors, is certainly UNJUST and would decrease your transient pool of
visitors and tax contributions to the county.

Please vote NO on draft 3.
You already increased the restrictions twice on vacation rental properties in North Kohala and parts of South Kohala
- once forcing them to Mid-term rentals, and now the $500 registration fee ON TOP of all the taxes being paid to the
county.
Thank you,
North and South Kohala 30-180 day vacation rental owners in A-1, A-5
5.
