The Secretary's Minutes of the Executi~ e Committee Meetirt#; of .tatt~tacy !-5, 1997 were approved and placed on file (attached for information). The Treasurer's Report for the month of January 1997 was approved and placed on file (attached for information). An HSAC Executive Committee Report on the approval of the 1997 HSAC LegislaCi~'tP~gkage was received and placed on file (Approved on January I5, 1997). CALL TO ORDER The HSAC Executive Committee was called to order by President Rene Mansho at 8:45 a. m. The following members present made up a quorum: City and County of President Rene Mansho Honolulu Staff Elaine Lee Staff Cookie Harris County of Maui First Vice President Dennis Nakamura Staff David Raatz County of Kauai Second Vice President Ron Kouchi Staff Cyndi Ayonon County of Hawaii Secretary-Treasurer A] Smith Staff Gerald Monden Also in attendance: Takashi Domingo, Hawaii Council Staff Curt Cottrell, Dept of Land and Natural Resources II. EXECUTIVE COMMITTEE MEETING MINUTES The minutes of the December I I, 1996 meeting of the HSAC Executive Committee were approved as circulated. III. TREASURER'S REPORT The Treasurer's Report for the month of December 1996 was approved as circulated. IV. REPORTS A. Executive Committee Reports President Mansho presented a brief oral report of a meeting with Governor Cayetano and the members of the HSAC Executive Committee on December 27, 1996. The purpose of the meeting with the Governor was to discuss the mutual concerns of the counties and their priorities. Attending this meeting were President Mansho, Vice President Nakamura, Secretary-Treasurer Smith, Kauai Alternate Tehada and Council Chair Thronas. President Mansho indicated that the Governor was very receptive and used the meeting to share with the attendees information about the state's short fall, his thoughts on raising the General Excise Tax and possibly the Transit Accommodations Tax, the promotion of CIP projects on all of the islands, discussions on agriculture and diversified agriculture support, the OHA ceded lands claims, and ideas on how to encourage business. President Mansho also reported that the Governor was very open to having quarterly meetings with HSAC Representatives. B. County Reports A County report from James Y. Arakaki, Council Chair, Hawaii County, to President Mansho, dated January 3, 1997, regarding HSAC Executive Committee Matters was recieved and placed on file. C. NACo Reports There were no NACo Reports. D. WIR Reports There were no WIR Reports. V. UNFINISHED BUSINESS A. 1997 HSAC Legislative Package The following items were approved for inclusion in the 1997 HSAC Legislative Package: 2 1. Bill relating to public land liability immunity The purpose of this bill is to immunize the counties from liability For injuries caused by a natural condition of unimproved public property, even in the absence of warning signs and other public safety services. Maui -Approved December 4, 1996. Kauai -Approved. Hawaii -Approved Dec 18, 1996. Honolulu -Approved by Honolulu Council Resolution 96-297. 2. Bill relating to revenue sharing The purpose of this bill is to restore the potential loss of any transient accommodations tax revenues currently received by the counties with the State's general excise tax revenues. Maui -Approved. Kauai -Approved. Hawaii -Approved December 18, 1996. Honolulu -Approved by Honolulu Council Resolution 96- 303,FD1. 3. Bill relating to preference to bidders on county contracts The purpose of this bill is to authorize the counties by ordinance to give preference for county public works projects to bidders who have successfully paid their applicable State taxes, and to provide the counties the flexibility to adopt such preference provisions similar to those of the State. Maui -Approved. Kauai -Approved. Hawaii -Approved December 18, 1996. Honolulu -Approved Honolulu Council Resolution 96- 301,FD1. 4. Bill relating to general excise tax The purpose of this bill is to reimburse the counties for general excise tax revenues passed on to the counties by licensees. Maui -Approved. Kauai -Approved. 3 Hawaii -Approved December 18, 1996. Honolulu -Approved. VI. NEW BUSINESS A. Support of State Legislation to Fund State Trails Program The Executive Committee considered a "Resolution Supporting Legislation Proposed by the Division of Forestry and Wildlife of the State Department of Land and Natural Resources for Insuring Funding of the Hawaii Statewide Trails and Access Program or Na Ala Hele" along with documentation and proposed legislation which will provide long-term supplemental funding to the Na Ala Hele Trail and Access Program. Mr. Curt Cottrell, Trails and Access Program Manager, explained that the Statewide Trails and Access Program is at risk for lack of a stable funding source. In addition to basic recreational purposes, trails serve a number of functions which include access for the management and protection of our forests and watersheds, access for hunters, and a resource for ecotourism. To insure the continued maintenance of trails and the development and maintenance of new trails and accesses, the Department of Land and Natural Resources is proposing legislation which will provide 0.3% of the gasoline tax revenues to fund this program and allow for the assessment of fees for the commercial and other uses of trails and accesses. A HSAC Resolution supporting DLNR's proposed legislation along with supporting information is being referred to the separate counties for consideration and adoption. B. Support of State Legislation for DARE's Five-Year Plan The Executive Committee considered a "Resolution Supporting Legislation to Appropriate Grants-in-Aid to County Police Departments for the Expansion of the Drug Abuse Resistance Education (Dare) Program." President Mansho indicated that the four Police Chiefs are proposing that the DARE Program be expanded statewide to intermediate and high schools over a five year period using a state grant-in-aid. Both the Speaker of the House and the President of the Senate have agreed to introduce the grant-in-aid proposal. A HSAC Resolution supporting proposed legislation for the expansion of the DARE Program by state grant-in-aid along with the proposed legislation and supporting information on each county is being referred to the separate counties for consideration and adoption. 4 C. Proposed HSAC Executive Committee Meeting Dates for 1997 The following proposed HSAC Executive Committee Meeting Dates for 1997 were scheduled: February 14, 1997 (Friday) March 14, 1997 (Friday) April 11, 1997 (Friday) May 21, 1997 (WIR Conference, Kauai) June 1997 (Year-End Conference, Hawaii) August 22, 1997 (Friday) September 26, 1997 (Friday) November 14, 1997 (Friday) December 10, 1997 (Mid-Year Conference) D. HSAC Budget and Annual Dues Estimate The Executive Committee reviewed a proposed HSAC Budget and Annual Dues Estimate for FY 1997-1998 by Secretary-Treasurer AI Smith. For purposed of annual budgeting, it is recommended that counties anticipate an annual HSAC dues assessment of $8,000 for fiscal year 1997-1998. This assessment represents an increase of $1,000 over the assessment for fiscal year 1996-1997. Kauai, host of the WIR '97 Conference, reported that private fund raising and sponsorships for the WIR are very promising. If this be the case, the HSAC subsidy of WIR'97 will be minimized and a favorable fund balance will be carried over into FY 1997-1998. With this scenario, the annual HSAC dues assessment would be less than $8,000. VII. COMMUNICATIONS The following communication were placed on file: 1. From President Mansho and Secretary-Treasurer Smith to Coopers & Lybrand, L.L.P., dated December 17, 1996, regarding the annual audit of HSAC's financial statements. 3. From President Mansho to the Honorable Joseph M. Souki, State Speaker of the House, dated December 23, 1996, regarding consideration and introduction of the 1997 HSAC Legislative Package. 5 4.
