Subject: Application for Variance, 14 Holomua Street, Hilo TMK# 2-2-050-093
Dear Mr. Yagong:
Pursuant to the Notice of Order #H00-2, dated August 30, 2000, Paradise Auction, Ltd seeks
approval in the form of a variance, from the Hawai'i County Code, Hawaii County Sign
Ordinance, Section 3-5, regarding advertising and signs.
Based on our interpretation of Section 3-5 of the Sign Ordinance, we believe the "Auction Blimp"
should not be considered a sign, the same as a flagpole, or a hanging banner. A permanent
commercial sign or marquee is stationary. Therefore, the "Auction Blimp" which is suspended
from a rope attached to the ground and flown like a banner for not more than (8) eight hours a
day, should be exempt from the requirements for permanent signs as defined by the sign
ordinance.
Further, our "Auction Blimp" is aesthetically appealing, safe, and vital to the economic survival
our small locally rum business. In fact, most of our business is generated as a direct result of
flying our banner (Auction Blimp). In the long run, the incorrect interpretation of our "Auction
Blimp" as a sign causes undue and inequitable hardship on our business and may be construed as
discriminatory when economic damages are considered.
Please know that we do not fly the blimp everyday. Flying the blimp is subject to weather
conditions. It cannot go up on rainy or windy days. It is stored in our warehouse nightly and on
those inclement days. Also be apprised that we have complied with FAA regulations.
We urge you to seriously and comprehensively consider our application for this variance.
