Annual Progress Report
TMK: 7-7-07: 5: Pahoehoe 4th. North Kona. Hawaii
This will acknowledge receipt of your letter dated August 2, 2000, containing an annual progress
report in compliance with Condition L of the above-described ordinance that changed the zoning
of the subject property from a Unplanned (U) to a Single Family Residential (RS-10) zoned
district.
Our records indicate that the revised preliminary subdivision plat maps for the proposed 9-lot
subdivision was not approved by this office since its configuration did not conform to the
Department of Water Supply's Rules and Regulations regarding service limits. By memorandum
dated May 13, 2000, the Department asked that the proposed subdivision be reconfigured to
conform to their requirements. We continue to await your response to the Department of Water
Supply's request.
While we will accept this current annual progress report, we do ask that greater effort be made
on the part of the applicant to keep the County Council, the Planning Commission, and this
office apprised of the status of the proposed project. This is the second year in a row where we
have had to supplement your report with information from within our files.
By a copy of this letter, your report will be transmitted to the Hawaii County Council and
Planning Commission for their information.

Dear Ms. Goldstein
A. This document is being submitted as the annual progress report on TMK: 3-7-7-7:05
per County of Hawaii Bill no 62 Ordinance No. 90 99, page 8, paragraph L.
B. The property owner, Pacific Rim Land, Inc., intends to comply with all stated
conditions of approval.
C. As of February 6, 1991, the required water commitment payment was made in the
amount of $59,400 for 33 units. As of March 1991, the Kealekekua Source
Agreement and Assignment was executed by the Department of Water Supply.
D. On January 9, 1992, a revised preliminary plat map was submitted to the Planning
Department. On May 21, 1993, the engineer for the owner, The Keith Companies,
attempted to obtain tentative preliminary subdivision approval. On Apri l It, 1994 the
Planning Department granted tentative approval of the preliminary plat. On October
27, 1997, a revised preliminary map was submitted to your office and the applicant
continues to work on comments received from that submittal.
E. Regarding construction of roadways, applicant has had numerous discussions with
neighboring land owner that is also required to comply. Applicant is reviewing the
implications of the recent down zoning of the adjacent parcel and will be seeking
input from the Planning Department as to how to proceed.
F. Regarding drainage system, applicant intends to comply.
G. Regarding restrictive convenants prohibiting Ohana Dwelling units, applicant intends
to comply.
H. Applicant intends to comply with the Office of Housing and Community
Development and Planning Department Guidelines.

1. As of March 1991, an Archaeological inventory survey was conducted and
acknowledged received by the Planning Department.
J. Regarding unanticipated archaeological sites being uncovered during preparation
activity, applicant intends to comply.
K. Applicant intends to comply with all applicable laws, rules, regulations, and
requirements.
L. With regards to possible adoption of Unified Impact Fees Ordinance, applicant
intends to comply.
M. Upon submittal of this document, applicant is complying with the requirement to
submit an annual progress report prior to the anniversary of adoption, August 14,
1990.
