State of Hawaii Dear Chairman Arakaki and Councilmembers: By way of background, the County of Hawaii has been negotiating with the State of Hawaii, Department of Hawaiian Home Lands (DHHL), to confirm the basic responsibilities and agreements between the parties relating to county services on Hawaiian Home Lands and the settlement of delinquent real property taxes owed by homestead lessees. The Hawaii County Council has, by prior action at its November 30, 1994 meeting, authorized the acceptance of a compromise offer by the DHHL to accept the payment of delinquent taxes with the County waiving penalties and interest thereon. By Finance Committee Report No. 126, dated June 27, 1995, the committee recommended that the compromise offer to waive the penalties and interest for the delinquent taxes to apply to the individual lessees. rtes. 342 a- 00 Comm. Date AR 10 2000 James Arakaki, Chairman and Councilmembers September 8, 2000 Page 2 The subject matter before your body now is in the form of a Memorandum of Agreement (MOA) which spells out the responsibilities and agreements of both the State and the County as it relates to the provision of County services and the settlement of delinquent real property taxes owed by homestead lessees. This item has been long in coming to resolvement, however, this MOA will cure the delinquent taxes owed by lessees, with the DHHL paying it to the County and also spelling out our County services provided to DHHL lands and lessees.
