The Secretary's Minutes of the Executive Committee Meeting of August 11, 2000 were approved (Attached for information). The Treasurer's Reports for the months of July and August 2000 were approved (Attached for information). Under New Business, the HSAC Executive Committee began its discussions on the 2001 HSAC Legislative Program. Representatives from each of the County Administrations were present at this meeting. The issues key to the County of Kauai was beach liability and immunity. The City and County will be submitting legislation allowing for more home rule in Collective Bargaining Agreements especially as it affects our police officers. The City and County will also be submitting legislation which directs that the unadjudicated traffic fines and forfeitures be returned to the counties for use in funding police salaries. The City and County will also be amending Mr. Tyler's proposals on hazardous recreation and public notification and submitting appropriate legislation. Mr. Wurdeman, supported Mr. Tyler's proposal on the Public Service Tax and will be providing draft legislation. Mr. Wurdeman will also be providing legislation to regulate cellular towers on agricultural lands and on discretionary immunity for the counties. Mr. Wurdeman also suggested legislation relating to the supplemental funding of veteran cemeteries and amendments to the use requirement for recycled glass, neither of which drew any interest from the other counties. �,,.. This amendment updates the outdated HSAC Policy on Mid -year Conferences and propose changes which will minimize potential staffing conflicts at future HSAC Conferences (i.e. Hawai`i County hosting a Mid -year Conference in an election year). Under the proposed Policy amendment, Hawaii County, along with Kauai County, will be responsible for hosting HSAC Conferences during odd -numbered years. (Copy of proposed HSAC Policy amendment attached, ACTION REQUESTED). The next meeting of the HSAC Executive Committee was tentatively scheduled for October 27, 2000 on the island of Oahu. This meeting is planned for 10:00 a.m. in the Council Committee Room. III. REPORTS OF THE TREASURER The Treasurers' Report for the months of May 2000, and June 2000, were approved. IV. REPORTS OF COMMITTEES A. Executive Committee Reports The following reports were received and placed on file: HSAC Executive Committee Minutes of the August 11, 2000, meeting Page 2 1. From Dennis Y. Nakamura, HSAC Secretary, to President Mansho, dated June 29, 2000, regarding the endorsement of Karen Miller as a candidate for the NACo Second Vice President position. 2. From Dennis Y. Nakamura, HSAC Secretary, to President Mansho, dated June 29, 2000, regarding the approval of the County of Hawaii's request for an advanced payment in the amount of $5,000 to allow it to open its 2001 Western Interstate Region (WIR) conference account. 3. From Dennis Y. Nakamura, HSAC Secretary, to President Mansho, dated June 29, 2000, regarding the approval of nominees for possible appointment to the NACo Board of Directors. B. County Reports There were no County reports. C. NACo Reports There were NACo reports. Your Committee did note that the NACo Annual Conference in July 2000, was successful. Hawaii delegates promoted the WIR Conference that will be hosted by Hawaii County in May 2001. Conferees at the NACo Annual Conference expressed strong interest in attending the WIR Conference on the Big Island. V. UNFINISHED BUSINESS There was no unfinished business. VI. NEW BUSINESS A. Discussion of Proposals for the 2001 HSAC Legislative Package President Mansho distributed a final report on the 2000 Regular Session of the State Legislature, listing the status of bills that were in the 2000 HSAC Legislative Package and other county -related bills, with the intention of generating legislative proposals for possible inclusion in the 2001 HSAC Legislative Package. HSAC Executive Committee Minutes of the August 11, 2000, meeting Page 3 Your Committee noted that a bill to provide compensation to the counties from the State's collection of the "public service tax" under Chapter 239, Hawaii Revised Statutes, failed during the session. Vice President Smith distributed information relating to Hawaii County's efforts to clarify the counties' rights with respect to the taxation of public utilities and noted that the County's lawsuit to collect Chapter 239 revenues from the State was dismissed on May 5, 2000. The County's position was that Chapter 239 revenues were collected "in lieu of property taxes", and therefore, a portion of the revenues should be remitted to the counties. The court's ruling noted that the County had not attempted to collect property taxes from the utilities, which rendered the County's lawsuit premature. Your Committee noted that Hawaii County was pursuing the taxation of the utilities through ordinance (Bill No. 276) and that the City and County of Honolulu was attempting to do so by administrative rule. Your Committee expressed interest in the City and County of Honolulu's position that the public utilities could be made subject to property taxes by administrative action. Your Committee requested that it be kept apprised of the City and County of Honolulu's efforts on this matter and that President Mansho transmit any future legal opinion on the subject issued by the City's Corporation Counsel to your Committee for its review. Your Committee also noted that, with respect to "beach liability" issues, it would be advisable to give consideration to the concerns raised by Governor Cayetano in the message accompanying his veto of Senate Bill No. 2001 (2000), Senate Draft No. 2. Your Committee noted that the bill would have provided "indemnity" to the respective counties for injuries occurring at County beach parks. Your Committee further noted that Governor Cayetano indicated that he would be favorably disposed to a grant of immunity, instead of indemnity. B. 2001 HSAC Legislative Program Policy Statement Your Committee referred the following proposed 2001 HSAC Legislative Program Policy Statement to the respective counties for their consideration and action: The Hawaii State Association of Counties (HSAC) shall be guided by the following policies during the 2001 legislative session: 1. The Executive Committee shall determine the strategy for HSAC's efforts before the legislature. HSAC Executive Committee Minutes of the August 11, 2000, meeting Page 4 2. An HSAC officer or designee shall testify before the Legislature on proposals in the 2001 HSAC Legislative Package. C. HSAC Mid -Year Conference on Oahu Your Committee noted that the HSAC Mid -Year Conference is scheduled for December 12-13, 2000, at the Ala Moana Hotel on Oahu. VII. COMMUNICATIONS The following communications were received and placed on file: A. From Al Smith, HSAC Vice President, to the HSAC Executive Committee members, dated June 22, 2000, relating to real property valuation of public utility companies. B. From Dennis Y. Nakamura, HSAC Secretary, to President Mansho, dated July 10, 2000, transmitting a copy of the revised Bylaws, which were amended by the General Membership on June 7, 2000. C. From Ronald Kouchi, HSAC Treasurer, to HSAC Executive Committee members, dated July 26, 2000, relating to HSAC's travel reimbursement policy. VIII. ANNOUNCEMENTS President Mansho announced that the next meeting, including a "legislative workshop," would be held on September 29, 2000, on Oahu, commencing at 9:00 a.m., and that the four county mayors would be invited to discuss the 2001 HSAC Legislative Package. Your Committee noted that the agreed-upon rotation among the four counties for the hosting of the HSAC Mid -Year Conference and HSAC Year -End Conference should be placed in the Bylaws. President Mansho noted she would transmit the proposed revisions to the Bylaws for your Committee's consideration at a future meeting. CITY AND COUNTY OF HONOLULU 00-173 HONOLULU, HAWAII NO. RESOLUTION RELATING TO HSAC POLICY AMENDMENTS CONCERNING CONFERENCES. WHEREAS, the Hawaii State Association of Counties (HSAC) is an organization consisting of the members of Hawaii's four county councils; and WHEREAS, HSAC is headed by its Executive Committee, which is composed of four officers: President, Vice President, Secretary, and Treasurer; and WHEREAS, HSAC generally holds two conferences each year for its general membership and other interested parties; and WHEREAS, the locations of these conferences are rotated among the four counties of the State of Hawaii; and WHEREAS, the Executive Committee finds that there is a need to amend HSAC policies to update the conference rotation schedule; and WHEREAS, amendments to HSAC policies require the unanimous approval of the county councils; now, therefore, BE IT RESOLVED by the Council of the City and County of Honolulu that the HSAC Policies on the "Mid -Year Conference" are amended to read as follows: "HSAC POLICIES 1. The Mid -Year Conferenceshallnot be held in the same County that hosts the Year -End Conference (annual meeting) immediately preceding a Mid -Year Conference. 2. The Mid -Year Conference shall be rotated and no County shall host the Mid -Year Conference for two (2) successive years. 3. The rotation schedule shall be as follows: [A.
