Arakaki, Chairman and Members of the County Council County of Hawaii 25 Aupuni Street Hilo, HI 96720 Dear Chairman Arakaki and Members: State Land Use Boundary Amendment Application (SLU 00 -003) Request: Agricultural to Urban Change of Zone Application (REZ 00 -003) Request: A -la to RA -.5a Applicant: Dennis Inouye Tax Map Key: 2 -4 -35:25 The Planning Commission, after a duly held public hearing on August 15, 2000, voted to recommend for your approval the proposed legislative bills for a State Land Use Boundary Amendment from Agricultural to Urban and a Change of Zone changing the district classification from Agricultural (A -la) to Residential and Agricultural (RA -.5a) for approximately 43,576 square feet of land. The property is located approximately 500 feet west of Kupulau Road, Waiakea Homesteads, 2' Series, South Hilo, Hawaii. The Commission concurs with the following Planning Director's reasons for recommending favorable consideration of the applications: State Land Use Boundary Amendment The approval of the reclassification from the State Land Use Agricultural to the Urban District will not be violative of Section 205 -2, Chapter 205, Hawaii Revised Statutes, nor will it be inconsistent with the Land Use Commission Rules, the Rule 13 of the Planning Commission Rules of Practice and Procedures, the County General Plan and the Hawaii State Plan. According to the Hawaii Land Use Commission 0 Honorable James Y. Arakaki, Chairman and Members of the County Council Page 2 Rules, one of the standards for considering an area for urban reclassification states that "In determining urban growth for the next ten years, or in amending the boundary, lands contiguous with existing urban areas shall be given more consideration than non- contiguous land, and particularly when indicated for future urban use on state or county general plans." The subject property is located on a private roadway off Kupulau Road. Surrounding lands are zoned A -la, A -3a, and RS -10 and located within the State Land Use Agricultural and Urban Districts. New Hope Church is situated directly across from the property to the north. There are dwellings on both sides of the property, and a vacant parcel to the rear. Kupulau Road generally serves as a division between the Urban designated lands makai of the road, and the Agricultural designated lands mauka of the road. In the area of the subject property, Urban uses have been established by the proximity of existing residential subdivisions makai of Kupulau Road. TMK: 2 -4 -65: 4 (Kupulau Heights) located approximately .55 miles north of the subject property, was granted a SLU Boundary Amendment from Agricultural to Urban (SLU 972) and a Change of Zone from A- I a to RS -15 under Ordinance No. 97 91, effective July 3, 1997. A subdivision application for 25 lots has been filed with the department. The proposed Urban boundary amendment request would be consistent with the Land Use Element of the General Plan. Land Use is one of the principal focal points of public concern and policy. The Land Use Element provides the primary basis for direct control and guidance of publicly and privately owned resources. The General Plan is intended to be a policy guide for the coordinated growth and development of all sectors of the County. It sets forth goals, policies, standards and courses of action to accommodate growth without congestion, to designate and preserve the lands needed for residential use, commercial and visitor services, industry, agriculture and open space, and to coordinate these uses with the County's service and circulation systems. The overall Land Use goals, policies and standards are set forth to physically plan the lands in the County in the best interest of the island's residents: * Designate and allocate land uses in appropriate proportions and mix and in keeping with the social, cultural, and physical environments of the County. * Zone urban- and rural- types of uses in areas with ease of access to community services and employment centers and with adequate public utilities and facilities. * Allocate appropriate requested zoning in accordance with the existing or projected needs of neighborhood, community, region and County. Arakaki, Chairman and Members of the County Council Page 3 * Rural -style residential - agricultural developments, such as new small -scale rural communities or extensions of existing rural communities, shall be encouraged in appropriate locations. * The County shall encourage the development and maintenance of communities meeting the needs of its residents in balance with the physical and social environment. The proposed Urban boundary amendment request would also complement the following goals, policies and standards of the Housing and Single Family Residential Elements of the General Plan. Housing * Attain safe, sanitary, and livable housing for the residents of the County of Hawaii. * Develop better places to live in Hawaii County by creating viable communities with decent housing and suitable living environments for our people. * To maximize choices of single - family residential lots and /or housing for residents of the County. * To provide single - family residential areas conveniently located to public and private services, shopping, other community activities and convenient access to employment centers. * Rural -style residential - agricultural developments, such as new small scale rural communities or extensions of existing rural communities, shall be encouraged in appropriate locations. * The County shall review and amend if necessary land use ordinances and codes to include considerations for rural -style residential subdivisions in appropriate locations. Standards and criteria for the establishment of these areas shall be developed. r Honorable James Y. Arakaki, Chairman and Members of the County Council Page 4 The proposed Urban boundary request also conforms to the Land Use Pattern Allocation Guide ( LUPAG) Map which designates the area as Low Density Urban. The Low Density Urban designation includes uses which are single family residential in character, ancillary community and public uses, and convenience type commercial uses. In the area of the subject property, urban uses have been established by the proximity of existing residential subdivisions makai of Kupulau Road. Effective August 19, 1999 under Ordinance 99 91, TMK: 2 -4 -37: 36 (Waiakea Development Ventures) across Kupulau Road to the east of the subject property, was granted a change of zone from A -3a to RS -10 for approximately 10.023 acres. In the immediate vicinity are parks, gyms, churches and school, as well as small neighborhood commercial establishments. Kupulau Heights located approximately .55 miles north of the site, as well as adjacent subdivisions, includes a mix of residential and limited agricultural activities. The request would allow a development for Residential - Agricultural uses. It is therefore determined that the request is consistent with the low- density form depicted on the LUPAG Map for this area of Hilo. The property is situated approximately 5 miles from the urban retail /employment center of Hilo, and thereby conforms with the Land Use Commission Rules which encourages urban development in close proximity to existing development, services and facilities. Based on the above findings, including the General Plan's goals and policies, the granting of the Urban boundary amendment would complement and implement the General Plan. All utilities and services are available to the property, which are essential to accommodate the development. Access to the property is from Kupulau Road to a private roadway with an approximately 18 -foot pavement within a 25 -foot right -of -way. A future road widening is proposed for the mauka portion of Kupulau Road, which would result in an 80 -foot right -of -way). According to the applicant, there are two 5/8 -inch water meters and septic systems serving the two existing dwellings on the property. The Hilo Police Station is located approximately 5 miles from the property, and the Fire Station is located on Kawailani Street approximately 3.5 miles from the site. All other utilities and services are available to the property. The property has no severe geological or topographical problems which cannot be properly rectified or which would render the land unusable. The topography of the site is level. The Federal Emergency Management Agency (FEMA) Flood Insurance Rate Map (FIRM) designates a portion of the property within Flood Zone AH (Special Flood Hazard Area inundated by the 100 -year flood). However, that portion of the property will remain undeveloped. While the subject property is within the State Land Use Agricultural and County's Agricultural -la zoned districts, it is not currently being used for active Honorable James Y. Arakaki, Chairman and Members of the County Council Page 5 agricultural purposes. There are two existing dwellings on the site. The property is unclassified by the Agricultural Lands of Importance to the State of Hawaii (ALISH) System. Soils within the subject property are classified as "C" (Fair) for agricultural productivity by the Land Study Bureau. The surrounding properties are zoned A -la, A -3a, and RS -10 by the County, and within the State Land Use Agricultural and Urban districts. This area has been previously used for very limited agricultural activities. Therefore, the reclassification of this approximately one -acre property from the Agricultural to the Urban designation will not be detrimental to the reduction of this area from the agricultural land inventory in the County of Hawaii. Furthermore, an Urban classification would complement the existing and future residential - agricultural land use patterns of the surrounding area. Finally, it should be noted that the reclassification action would also conform to the following goals, objectives and /or policies articulated in the Hawaii State Plan: (a) Achieve a strong, viable economy characterized by stability, diversity and growth that enables the fulfillment of the needs and expectations of Hawaii's present and future generations. (b) Encourage urban developments in close proximity to existing services and facilities. Based on the above, the approval of the State Land Use Boundary Amendment from the Agricultural to the Urban District complements the State Land Use Regulations and is supportive of the State of Hawaii Plan and the County of Hawaii General Plan. Change of Zone In order to consider an area for any type of zoning designation, the applicable goals, policies and standards of the General Plan must be adequately addressed. It is only through such a comprehensive policy analysis approach that evaluations and decisions can be made to better time and stage developments to achieve growth determined by the General Plan and related planning documents. The implications of these evaluations and decisions must also be considered as they may have an impact on similar areas in the County. The Change of Zone Application from Agricultural -1 acre (A -la) to a Residential and Agricultural -.5 acre (RA -.5a) zoned district will conform to the following goals, policies and standards of the General Plan Land Use, Housing, and Single Family Honorable James Y. Standards and criteria for the establishment of these areas shall be developed. The applicant is requesting the change of zone to create a two -lot subdivision consisting of .5 acres each. There are two existing dwellings on the parcel. The Land Use Pattern Allocation Guide ( LUPAG) Map component of the General Plan is a representation of the document's goals and policies to guide the coordinated growth and development of the County. It reflects a graphic depiction of the physical relationship among the various land uses. The LUPAG Map establishes the basic urban and non -urban form for areas within the County. The subject property is designated Low Density Urban. This designation includes uses single family residential in character, ancillary community and public uses, and convenience type commercial uses. Neighboring properties are a mix of residential and limited agricultural activities. The request would allow a development for Residential - Agricultural uses. It is therefore determined that the request is consistent with the low- density form depicted on the LUPAG Map. The applicant is concurrently applying for a State Land Use Boundary Amendment from Agricultural to Urban in conformance with the Low Density Urban designation under the General Plan LUPAG Map. The potential for agricultural uses may exist; the subject property is comprised of soils classified by the U.S. Department of Agriculture Soil and Conservation Services as i Honorable James Y. Arakaki, Chairman and Members of the County Council Page 8 Olaa extremely silty clay loam, 6 to 20 percent slopes (OID). The surface layer is very dark brown extremely silty clay loam, about 16 inches thick. Permeability is rapid, runoff is slow, and the erosion hazard is slight. These soils are used for sugarcane. Soils within the subject property have been classified as "C" or Fair for agricultural productivity by the Land Study Bureau's Detailed Land Classification System. Finally, soils within the subject property are unclassified by the ALISH system. Surrounding lands are zoned A -la, A -3a, RS -10, and located within the State's Agricultural and Urban Districts. New Hope Church is located across the private road directly in front of the subject property, and there are dwellings to both sides of the property and a vacant parcel to the rear. Kupulau Road generally serves as a division between the Urban designated lands makai of the road, and the Agricultural designated lands mauka of the road. The requested RA designation provides for activities or uses characterized by low density residential lots in rural areas where "city- like" concentrations of people, structures, streets, and urban level of services are absent, and where small farms are intermixed with low density residential lots. The RA district is intended to be only within areas designated as State Land Use Rural or Urban. In the area of the subject property, urban uses have been established by the proximity of existing residential subdivisions makai of Kupulau Road. Effective August 19, 1999 under Ordinance 99 91, TMK: 2 -4 -37: 36 (Waiakea Development Ventures) across Kupulau Road to the east of the subject property, was granted a change of zone from A -3a to RS- 10 for approximately 10.023 acres. A State Land Use Boundary Amendment from Agricultural to Urban (SLU 972) and Change of Zone from A -la to RS -10 under Ordinance No. 97 91 was approved for TMK: 2 -4 -65: 4 (Kupulau Heights) on July 3, 1997. Kupulau Heights is located approximately .55 miles north of the subject property on Kupulau Road. Therefore, a favorable recommendation of this change of zone request will be consistent with the emerging land use pattern being established within this portion of Hilo. All utilities and services are available to the site. The primary access to the property is from Kupulau Road onto a private subdivision roadway, which has an approximately 18 -foot wide pavement within a 25 -foot right -of -way. A future road widening is proposed for the mauka portion of Kupulau Road, which would result in an 80 -foot right -of -way. Finally, because the subject property and surrounding areas have been extensively altered with residential /agricultural development, it is not anticipated that endangered or threatened candidate species of flora or fauna are located within the subject property, nor has the area been identified as a significant botanical or biological habitat. In addition, it is also not anticipated that the proposed request will have any adverse impact on cultural or historical resources. Based on the above findings, approval of the Change of Zone request from Agricultural -1 acre (A -Ia) to a Residential and Agricultural -.5 acres (RA -.5a) zoned district would result in an appropriate land use pattern that will further the public convenience, necessity and general welfare. Request: The applicant is proposing to change the existing State Land Use Agricultural land use designation to Urban and district classification from Agricultural (A -la) to Residential and Agricultural (RA -.5a) for approximately one acre of land. According to the Zoning Code, the proposed RA district provides for activities or uses characterized by low density residential lots in rural areas where "city- like" concentrations of people, structures, streets, and urban level of services are absent, and where small farms are intermixed with low density residential lots. The RA district is intended to be only within areas designated as State Land Use Rural or Urban. 3. Objectives: The applicant is proposing to create a two -lot subdivision consisting of .5 acres each. The property will be subdivided as soon as the necessary approvals are secured. 4. Property: The subject property is approximately one acre in size, with two single family dwellings built in 1994. The property is rectangular shaped, and is located within the 5- lot Mauna Kea View Estates Subdivision (SUB 6252), which received Final Subdivision Approval on March 3, 1993. The property is partially landscaped with a lawn and there are palm trees adjacent to the driveway. 12. Surrounding Zoning/Land Uses: Surrounding lands are zoned A -la, A -3a, and RS -10 and located within the State Land Use Agricultural and Urban Districts. U.S.D.A. Soil Type: Olaa extremely silty clay loam, 6 to 20 percent slopes (OID). In a representative profile, the surface layer is very dark brown extremely stony silty clay loam about 16 inches thick. It is underlain by A'a lava. This soil dehydrates irreversibly into gravel size aggregates. Permeability is rapid, runoff is slow, and the erosion hazard is slight. This soil is used f or sugarcane. 15. Land Study Bureau Soil Rating: "C" or Fair. 16. ALISH: Unclassified. 17. FIRM: A portion of the property is located in Flood Zone AH according to the Flood Insurance Rate Map (FIRM) by the Federal Emergency Management Agency (FEMA). Flood Zone AH is the Special Flood Hazard Area inundated by the 100 -year flood with average depths of one to three feet. The portion of the property in Flood Zone AH will remain undeveloped. 18. Flora/Fauna and Archaeological Resources: Since the site has been previously developed, the likelihood of any rare or endangered flora or fauna or historical sites is remote. 19. Topography: The subject property is relatively level. CM of 20. Water: According to the applicant, there are two existing 5/8 -inch meters serving the two existing dwellings on the property. There is a fire hydrant at the end of a 6 -inch waterline along Kupulau Road near the property. 22. Wastewater: The on -site drainage is diverted to an existing drywell on Kupulau Road. -3- ow 23. Other Essential Utilities and Services: Electrical and telephone services are available to the site. The Hilo Police Station is located approximately 5 miles from the property, and the nearest fire station is located 3.5 miles from the site on Kawailani Street. AGENCIES' COMMENTS 24. The present State Land Use designation of the subject parcel is Agriculture. Kupulau Road g enerally serves as the division between the urban designated lands makki of Kupulau Road and the agricultural with a few urban designated lands mauka of Kupulau Road. 2. The General Plan Land Use Pattern Allocation Guide (LUPAG) map designates the property as Low Density Urban. As such, the request would not be contrary to the LUPAG map. 3. The property is located within the County Agricultural 1 acre (A -1 a) zone. 4. The property is bounded by A -la zoned parcels to the south, A -3a to the west, A- la to the north, and RS -10 parcels to the east. 5. The property is not within the Special Management Area of the County of Hawaii. DESCRIPTION OF THE PROPERTY AND SURROUNDING AREA Physical Characteristics/Environmental Setting 1. The property is a 1.0 acre parcel located along a private road with access to Kupulua Road. 2. The property is presently improved with two existing dwellings, consisting of 1,056 and 2,800 square feet each. -t t Since the site is improved, archaeological features. and any habitats for endangered plants or animals species are not expected on the property. 4. There is no evidence of historical. natural or cultural resources on the property. 5. The topography is level. 6. The average annual rainfall is approximately 100 inches. 7. The U.S. Department of agriculture Soil Survey identities the underlying soil on the property as O1aa Soil Series. This series is characterized by extremely stone silty clay loam that formed in volcanic ash. 8. The State Department's agricultural Lands of Importance to the State of Hawaii (ALISH) classification of Prime agricultural Land borders the property. 9. The U.S Army Corps of Engineers Flood Insurance Rate NIap (FIR'-1) has designated most of the property to be outside of the flood plain, with the exception of a small portion of the "AH" zone in the southwesterly corner of the parcel. This area will remain undeveloped. PUBLIC FACILITIES AND UTILITIES 1. The property is located along a private road with access to Kupulau Road. 2. The two dwellings on the property each have their own approved septic system. 3. The existing dwellings both have electrical and telephone service. 4. The main Hilo police station is 5 miles from the property and the nearest fire station is located 3.5 miles away on Kawailam Street. There is a fire hydrant aat the end of a 6 -inch waterline along Kupulau Road fronting the property. 5. The on -site drainage is diverted to an existing drywell on Kupulau Road. 6. Waiakea Intermediate and High School, located approximately 4 miles from the property, are the closest public upper level schools. Subsection 15 -15 -18 of the Land Use Commission's rules identities standards for determining the characteristic boundaries of an Urban District. Many of these standards also coincide with the County's criteria for change of zone request, which will be discussed below. B. The requested designation to the Urban District is also allowed under Planning Commission Rule No. 13, State Land Use District Boundary Amendments. In 13 -1 it permits amendments for parcels less than 15 acres in size to be considered by the County Planning Commission with final decision by the County Council. C. The Urban designation allows new development patterns that may be desirable but where these development patterns have not yet been established. In this area, the use patterns have been generally established as urban by the proximity of existing residential subdivisions makai of Kupulau Road. Kupulau Road generally separates the State Landuse urban and agriculture designated lands in this area. The lands makai of Kupulau Road are all zoned residential; and with the exception of Parcel 2- 4- 065:004 ( Kupulau Meadows Subdivision), to the northwest and mauka of Kupulau Road that is designated urban and zoned RS -15, all the lands mauka of Kupulau Road, including the subject parcel, are designated agriculture and zoned A -la or larger. These lands mauka of Kupulau Road are mostly developed agriculture related pastoral lots intermixed with residences. Given this SLU designation/County zoning pattern surrounding the subject parcel and Division 5, Section 25 -5 -50 that allows the county RA zoning in the SLU urban district designation, it would be appropriate to maintain the original Urban designation request; however, amend the requested zone change from RS -20 to RA- .5a. F. The proposed development conforms to the Residential Policies of the General Plan, which states: Rural -style residential - agricultural developments, such as new small -scale rural communities or extensions of existing rural communities, shall be encouraged in appropriate locations. The County shall designate and allocate single- family residential zoned lands at varying densities for future use in accordance with the needs of the communities and the stated goals, policies, and standards. The requested landuse boundary amendment and amended change of zone requested would be consistent with the Housing goals of the General Plan that include the following: • Attaining safe. sanitan . and livable housing for the residents of the County of Hawaii. Attaining a diversity of socio- economic housing mix throughout the different parts of the County. Maintaining a housing supply which allows a variety of choice. Inasmuch no additional dwellings are proposed. there will be no impact to the traffic at the intersection of the private road and Kupulau Road and also along Kupulau Road. H. In the immediate vicinity of the property are parks, gyms, church, and school, as well as small neighborhood commercial facilities. The applicant believes the project will be conveniently located close to recreational facilities, schools, and other neighborhood facilities that would be conducive to his proposed agricultural residential project. I. Infrastructure to service this property are all existing. J. There are no significant development constraints on the property such as flooding, excessive slopes, or unstable ground conditions, which cannot be adequately mitigated. K. The subject property is fully developed with two existing dwellings on fairly level topography, thereby precluding any archaeological or habitat constraints, or limitations to develop the property. L. All public infrastructure are in place. Given the above and the fact that the property is fully developed with two existing dwellings along with all the required public infrastructure, the applicant feels that his request is reasonable and should be approved.
