Comm. 700: AN ORDINANCE AMENDING CHAPTER 22, OF THE HAWAII
(Bill 225) COUNTY CODE 1983 (1995), RELATING TO STREETS AND
SIDEWALKS
From Deputy Chief Engineer Jiro A. Sumada, dated February 18, 2000,
transmitting the attached bill.
The purpose of this bill is to make significant changes to
Chapter 22, which relates to streets and sidewalks. In order to
make the changes to Chapter 22, this bill repeals it in total and
replaces it in a restructured and reordered format. Some of
the major areas addressed by the bill include: a general
prohibition of use of county streets for profit/private use;

modified permit requirements; modernized technical
requirements; and ADA compliance. The bill includes
sicnificant chances which would: prohibit commercial signs
and advertising material within a county street; make it
mandatory that homes and businesses be numbered; establish
new driveway requirements for commercial and industrial
uses; assign certain permitting responsibilities to the Chief
Engineer (non-comroercial uses and banners across street) and
the Planning Director (street naming); make property owners
responsible for maintenance of driveway approaches and
remove responsibility for sidewalk damage caused by age or
poor construction; establish new driveway requirements for
commercial and industrial uses; establish a new section for
variances; and create new penalty and enforcement
provisions. The bill contains sicnificant deletions of certain
provisions relating to: permitting installation of livestock gates
across county road and allowing cafe table service and other
commercial activities on sidewalks; prohibited acts on bridges
and elevated structures; peddling, repair of private roads and
utilities; and mandatory installation of curb, gutter and
sidewalk through Council resolution.
Comm. 709: SIGN VARIANCE REQUEST- KONAWAENA HIGH
SCHOOL,
Prom Council Member Nancy Pisicchio, dated March 14, 2000,
requesting on behalf of Konawaena High School, a sign variance
to place a 60-sq. ft. school sign along the makai side of Mamalahoa
Highway on .Tack B. Greenwell's property, TMK: 8-1-04:01.
Daniel Yoshida, Principal of the school, states this sign will
enhance the South Kona community area as a viable
communication bridge, which will announce the school's activities,
and public announcements by the County and/or State.
Informs the school received permission from Mr. Greenwell to
place this sign on his property. Also, submits a copy of letter from
Stanley Takemura, Building Division Chief, dated March 10, 2000,
stating that the sign be placed so as not to obstruct the sight
distance of any vehicle entering the highway from the makai side
of the roadway. An illustrated copy of the sign is also submitted.
