Arakaki, Ex-Officio Member DATE: May 26, 1999 (Wednesday) PLACE: Councilroom TIME: 9:00 a.m. CALL TO ORDER STATEMENTS FROM THE PUBLIC ON ITEMS ON THE AGENDA REFERRALS Comm. 221: AN ORDINANCE TO AMEND THE HAWAII COUNTY CODE (Bill 60) 1983 (1995 EDITION) RELATING TO THE BUILDING CODE From Deputy Chief Engineer Jiro A. Sumada, dated Mazch 19, 1999, after careful review of the 1994 and 1997 editions of the published Uniform Building Code by the International Conference of Building Officials, transmits amendments to the Building Code which they feel need immediate action. (PROPOSES seven changes to the Building Code relating to: liens resulting from unpaid fines; props for performances or filming; access to bedrooms & bathrooms; window guardrails; standards for ducts; the seismic zone map for the island; and maximum spacing of certain floor planks.) (See next page for Comm. 221.001) PW&PC-12 Page 2 May 26, 1999 Comm. 221.001: From Edward V. Richardson, Major General, HIANG, Director of Civil Defense, State Department of Defense, dated April 30, 1999, stating that the State Civil Defense (SCD) and the Hawaii State Earthquake Advisory Board (HSEAB) endorse the upgrade of the seismic hazard designation for the County of Hawaii Building Code from Zone 3 to Zone 4. Comments on their reasons for supporting the proposal. Comm. 251: TRAFFIC CODE AMENDMENT - PROPOSED NO PARKING (Bi1169) ZONE -ALII DRIVE, N. KONA, BETWEEN WALUA ROAD AND KAHAKAI ROAD From Deputy Chief Engineer Jiro A. Sumada, dated March 31, 1999, per request, transmits a bill to prohibit parking on the mauka side of Alii Drive between Walua Road and Kahakai Road because parked vehicles are interfering with pedestrian activities in the immediate area. States other no parking zones listed under the Kona section of schedule 28 were amended for clarity, as indicated on the proposed amendment. Comm. 274: TRAFFIC CODE AMENDMENT (Bill 73) WAINAKU STREET: PROPOSED FREIGHT LOADING ZONE From Deputy Chief Engineer Jiro A. Sumada, dated April 22, 1999, per request, transmits a bill to authorize a freight loading zone along Wainaku Street at Amauulu Street and Waihau Lane to serve the recently opened Wailuku River Store. Comm. 274. 001: From Police Chief Wayne Carvalho, dated May 12, 1999, stating they have no objections to the proposed freight loading zone along Wainaku Street at Amauulu Street and Waihau Lane (Bill 73). Comm. 285: CONCERNS OF THE PUNALU`U PRESERVATION COMMITTEE ON THE EROSION AND ABUSE OF THE PUNALU`U BEACH ROAD From Pele Hanoa, President, Punalu`u Preservation Committee, dated April 12, 1999, stating their concerns regarding the Punalu'u Beach Road. They would like to discuss this matter with the Council to offer some ideas to rectify the problems they are experiencing in this area. PW&PC-12 Page 3 May 26, 1999 Comm. 286: DISABILITY RIGHTS HAWAII'S SUPPORT OF HELE ON BUS ROUTES TO SERVE THE HILO AND KONA AIRPORTS AND THE HILO WHARF From Daniel Grant-Johnson, President, Disability Rights Hawaii, dated May 3, 1999, informing they strongly support the Hele On Bus routes serving the Hilo and Kona airports and the Hilo Wharf and oppose the special interest lobby that is trying to keep these routes closed, and states their reasons. Comm. 287: APPRECIATION FOR THE GREEN WASTE AND RECYCLING AREA AT THE KONA TRANSFER STATION From Walter and Phyllis Kriewald, dated May 3, 1999, stating their appreciation of the green waste and recycling area at the Kona Transfer Station for reasons as stated. Comm. 288: "PUNA ACCESS ROAD PROJECT" AND THE COUNTY'S "CONNECTOR LOT" From Stephanie Bath, submitting her concerns on the recently paved "Puna Access Road" and the hazards created in the subdivision by the paving of 9th road and the damage done to property pins during the construction of this road. Comm. 289: TRAFFIC CODE AMENDMENT (Bill 82) HINA-LANI STREET SPEED LIMITS From Deputy Chief Engineer Jiro A. Sumada, dated April 29, 1999, per request of the Kona Heavens Homeowners Association, transmits a bill to increase the existing speed limit along the mauka portion ofHina-Lani Street from 25 m.p.h. to 35 m.p.h. Informs they have investigated this request and agree that 35 m.p.h. is a reasonable speed for the section of Hina-Lani Street between Anini Street and the Mamalahoa Highway (Route 190). The Kona Traffic Safety Committee and the Kona police concur with this amendment. Also informs this amendment also identifies "Kamanu Street" as the con-ect street name for the unnamed road to Costco. PW&PC-12 Page 4 May 26, 1999 Comm. 293: RESOLUTION ACCEPTING THE DEDICATION OF (Res. 84-99) ROADWAY LOTS WITHIN SUNSET RIDGE AT WAIKOLOA, PHASE III, UNIT I, INCREMENT 2, FROM SUNSET RIDGE JOINT VENTURE, TMK (3)6-8-046, (PORTION), TO THE COUNTY OF HAWAII From Corporation Counsel Richard D. Wurdeman, dated May 10, 1999, transmitting the above resolution and the subject dedication deed. Informs that the Department of Public Works, Department of Water Supply and the Planning Department have all recommended acceptance of the dedication deed and that all the subdivision improvements have been completed. Comm. 299: A RESOLUTION EXTENDING THE PARKING METER (Res. 87-99) MORATORIUM WITHIN THE AREA OF DOWNTOWN HILO AND REQUESTING THE REMOVAL OF PARKING METER HEADS From Councilmember Bobby Jean Leithead-Todd, dated May 14, 1999, transmitting the above resolution. UNFINISHED BUSINESS Comm. 18: AN ORDINANCE AMENDING CHAPTER 10 OF THE (Bill 6) HAWAII COUNTY CODE 1983 (1995 EDITION), RELATING TO EROSION AND SEDIMENTATION CONTROL From Deputy Chief Engineer Jiro A. Sumada, dated December 2, 1998, transmitting an ordinance repealing the present Chapter 10 and adding a new chapter to the Hawaii County Code and an ordinance in Ramseyer format for the Council's perusal. Comm. 18.01: From Thomas Langenstein, a founding member of the Kona Community Action Group to Address Flooding, an associate director of the Soil and Water Conservation District Board, Local Working Group, and a property owner who is currently struggling with the impacts of drainage flooding on two separate properties in Kona, dated February 22, 1999, submitting his personal comments and recommendations on specific proposed portions of Bill 6. (See next page for Comms. 18.02, 18.003 & 18.004) PW&PC-12 Page 5 May 26, 1999 Comm. 18.02: From Tomoe Nimori, dated February 22, 1999, informing she wholeheartedly supports the reasons and recommendations submitted by Thomas Langenstein on Bill No. 6. (Comm. 18.01) Comm. 18.003: From Deputy Chief Engineer Jiro A. Sumada, dated April 15, 1999, commenting on Comm. 18.01. Comm. 18.004: From William E. Cowell, Chairperson, Kona Soil and Water Conservation District (SWCD), dated April 28, 1999, transmitting their concems and possible language suggestions regarding Bill 6. Their comments address Kona community concerns that have been recently stated to them. Comm. 172: A RESOLUTION REQUESTING THE REMOVAL OF (Res. 53-99) PARKING METER HEADS WITHIN THE AREA AFFECTED BY THE MORATORIUM IN DOWNTOWN HILO From B. J. Leithead-Todd, Council Member, dated February 23, 1999, transmitting the above resolution requesting the removal of parking meter heads within the azea affected by Resolution No. 288-98, parking meter moratorium in downtown Hilo. Comm. 172.01: From Randy Rohner, Chairman, DIA Parking Committee, Hilo Downtown Improvement Association, dated January 29, 1999, supporting the removal of the parking meter heads in the Downtown area with the exception of the Post Office block. Offers suggestions for possible implementation for proper enforcement of the pazking stalls. Requests permission to install " 2 Hour Customer Parking" signage on the remaining meter posts, in the form of a bumper sticker printed in vertical format, which they would pay for and install. Comm. 172.002: From Hank Roberts, dated March 1 1999, commenting on the pazking meters in the Downtown area. PW&PC-12 Page 6 May 26, 1999 Comm. 199: CORRECTION DEED AND RESOLUTION ACCEPTING THE (Res. 63-99) ACCEPTANCE OF A QUITCLAIM OF REAL PROPERTY IDENTIFIED AS TAX MAP KEY (3)7-5-18:008 FROM BANK OF HAWAII, TRUSTEE, TO THE COUNTY OF HAWAII From Corporation Counsel Richard D. Wurdeman, dated March 8, 1999, transmitting the above resolution and a copy of the correction deed, along with (1) Trustee's Quitclaim Deed dated August 27,1997, recorded as Document No. 97-1345581; (2) Title Insurance Policy dated October 21, 1997, issued by Title Guaranty of Hawaii. Comm. 199.001: From Corporation Counsel Richard D. Wurdeman, dated April 7, 1999, informing Bishop Trust and American Trust merged with Hawaiian Trust as of July 1, 1994 and subsequently, Hawaiian Trust merged with Bankoh effective September 30, 1997, therefore the description in the title of Res. 63-99 is correct. Also informs the typographical errors to the description have been noted to Title Guaranty, who will make the changes and reissue the title policy. Comm. 218: TRAFFIC CODE AMENDMENT (Bill 59) K[LAUEA AVENUE, FRONTING KAWAMOTO VEGETABLE STORE PROPOSED TIME LIMIT PARKING AREA (36 MINUTE TIME LIMIT) From Deputy Chief Engineer Jiro Sumada dated March 16, 1999, per request of the Hawaii Police Deparhment, transmits a bill to convert the mauka side of Kilauea Avenue fronting Kawamoto Vegetable Store to a time limit parking zone. States the proposed regulation is needed to provide additional vehicle turnovers for business in the immediate area. Comm. 218.001: From Chief of Police Wayne G. Carvalho, dated April 29,1999, transmitting their comments, as requested, on Comm. 218 (Bill 59). A survey found no reason to conduct an experimental 15-minute parking zone in the area fronting Kawamoto Vegetable Store. States 15 minutes is sufficient time for customers to conduct their business and leave. Encourages the Committee to consider an ordinance to limit parking in this area to 15 minutes. GOVERNMENT ACCESS TELEVISION: Channel 9 (Hilo) and Channel 12 (Kona) The Public Works & Parks Committee and Finance Committee meetings can be seen on Wednesday, May 26 at 6 p.m. and on Tuesday, June 1 at 8:30 p.m. The Planning Committee meeting can be seen on Thursday, May 27 at 8:30 p.m. and June 3 at 8:30 p.m.. All the above meetings will be aired on May 30 at 9 a.m..
