Peterson, Executive Director, PATH, Peoples Advocacy for Trails Hawaii, dated January 12, 1999, informing Mr. Chazlie Gandy, along-time bicycle and pedestrian advocate, will be on the Big Island from February I-7, and has offered his services to do a presentation on bike and pedestrian issues, gratis. Ms. Peterson further lists his accomplishments and qualifications and requests that the Committee on PW&PC allow him to make this presentation at its Februazy 2,1999 meeting. Comm. 82: CONCERNS OF TED BALDAU ON THE FUTURE OF ALII HIGHWAY (KONA) From Ted Baldau, dated January 7, 1999, stating his serious concerns as to the future of the Alii Highway. Comm. 84: RESOLUTION AUTHORIZING THE DEDICATION OF (Res. 26-99) KAUPAKUEA HOMESTEAD ROAD FROM MAUNA KEA AGRIBUSINESS CO., INC., TAX MAP KEYS (3)2-8-03-001 (PORTION), 2-8-04-001 (PORTION), AND 2-8-07-003 (PORTION), TO THE COUNTY OF HAWAII From Corporation Counsel Richazd D. Wurdeman, dated January 4,1999, transmitting the above resolution and the subject dedication deed which has been reviewed by the Departments of Public Works, Water Supply; and Planning, which all recommends its acceptance. PW&PC-4 -3- February 2, 1999 Comm. 107: REQUESTS FOR REMOVAL OF PARKING METER HEADS IN DOWNTON HILO From Deputy Chief Engineer Jiro Sumada, dated January 11, 1999, transmitting a copy of the Downtown Improvement Association's (HDIA) letter dated November 6, 1998 regarding Councilman Yagong's phone request to have the County remove parking meter heads downtown and HDIA providing funds for caps on the meter poles. States the request was received favorably by the HDIA Pazking Committee and the HDIA Executive Board. They are willing to fund up to $500 for the Project. The Department of Public Works is waiting for the Council's concurrence to proceed with their proposal to remove the parking meter heads from the areas affected by the parking meter moratorium and anticipates that all the affected meters heads can be removed within a month from the approval date and receipt of the funds to purchase caps for the meter posts. Comm. 114: TRAFFIC CODE AMENDMENT (Bi1128) CORRECTION TO TRAFFIC CODE DIVISION 5. PARKING (PROVIDING A MORE ACCURATE DESCRIPTION OF THE EXISTING "NO PARKING ON PAVEMENT" ZONES ALONG THE WEST SIDE OF ALII DRIVE) From Deputy Chief Engineer Jiro A.Sumada, dated January 15, 1999, transmitting the above bill. UNFINISHED BUSINESS: Comm. 1007: REQUEST TO PLACE STREET STANDS IN HILO AND (1998) KONA -HAWAIIAN BUY AND SELL MAGAZINE From Reno Amisone, Distribution Manager, Hawaiian Buy & Sell Magazine, dated September 24, 1998, informing that their magazine is a free publication to the people of Hawaii which advertises private and commercial products statewide with a readership of 250,000 weekly. They are planning to place street stands at certain locations in Hilo & Kona, which are manufactured to comply with state and city sidewalk regulations. Requests permission to provide this service. Encloses maps of specific locations. PW&PC-4 -4- February 2, 1999 Comm. 1007.01: From Deputy Chief Engineer Jiro A. Sumada, dated December 8, (1998) transmitting their comments as requested, on Comm. 1007. Comm. 22: From Corporation Counsel Richard D. Wurdeman, dated December 3, 1998, giving their interpertation, as requested, of the term "abutting properthy owners or ocupiers" as used in HCC Sec. 22-22(a)(4). States an abutting owner is defined as one whose property is contiguous or joins at a boundary, and where no other land, road, or street intervenes. Interprets the ordiance to mean that the "abutting" owner is the owner of the property immediately fronting the newsstand, and not all owners on any particular block. Comm. 22.01: From Reno Amisone, Distribution Manager, Hawaiian Buy & Sell Magazine, dated January 12, 1999, transmitting signatures of property owners giving his company permission to place a newspaper rack on the sidewalk in front of their business, and maps of specific location where stands are to be placed, if their requests (Comm. 1007) is approved. Bi11280: AMENDS CHAPTER 3, OF THE HAWAII COUNTY CODE, (C-454.13) BY REPEALING ARTICLE 1 -RELATING TO SIGNS, (1998) ADDING A NEW ARTICLE 1-RELATING TO SIGNS, AND AMENDING ARTICLE 2 -RELATING TO KAILUA VILLAGE SIGNS Intr. By: Mr. Reynolds (Council referred Bi11280 along with C-454.19 (Bill 280, D. 2) and C-454.20 back to PW&PC - 09/02/98) Comm. 454.19: From Councilman J. Curtis Tyler, III, dated September 1, 1998, (Bi11280, transmitting Bi11280, Draft 2, which contains a number of Draft 2) substantive changes to address certain major concerns which (1998) consistently surfaced during public hearings and testimony, and a number of less substantive revisions are proposed to further clarify definitions and other sections of the bill. Also attaches a summary of the proposed amendments. Comm. 454.10: From Sandra Scarr, Vice President for Public Affairs, Kona (1998) Outdoor Circle, dated August 3, 1998, transmitting their comments and recommendations on revisions to the Sign Code (Bi11280). PW&PC-4 -5- February 2, 1999 Comm. 454.11: From Councilman Joe Reynolds, dated August 4, 1998, (1998) transmitting a drab bill to amend Chapter 3, Hawaii County Code, relating to signs. The draft bill is based on the discussion draft bill prepared for the Committee by the Legislative Auditor's Office and it contains changes which were made in response to comments received regazding the discussion draft. A summary of these changes is attached. Comm. 454.12: From Sherry L. Bracken, dated August 3, 1998, stating she supports (1998) the comments submitted by the Kona Outdoor Circle and by Vonnie Lyons on Bi11280and also suggests additional comments of her own. Comm. 454.14: From Sherry L. Bracken, Sign Committee Chairman, Kona (1998) Outdoor Circle, dated August 17, 1998, submitting several suggestions which the KOC's Sign Committee prepared as a summary of the comments and replies received from several community members on the latest proposed bill repealing the sign ordinance. Comm. 454.15: From Sherry L. Bracken, dated August 17, 1998, submitting her (1998) personal views on the proposed sign ordinance revisions. Comm. 454.16: From Karin Hazelhoff, First Vice President, Waimea Outdoor (1998) Circle, speaking for Na Leo Pohai, the Public Policy Affiliate of The Outdoor Circle, dated August 18, 1998, submitting a list of issues and possible suggestions regarding Bill 280. Comm. 454.17: From Alexandra Bernstein, dated August 17, 1998, transmitting (1998) her comments and recommendations on Bill 280. Comm. 454.20: From Corporation Counsel Richard D. Wurdeman, dated (1998) August 31, 1998, responding to PWPC Chair Yagong's memo on whether the provision of Bi11280 which exempts real estate signs from the provisions of the Bill makes it constitutionally questionable. Submits Corporation Counsel's Opinion 96-03, relating to election signs in which he pointed out that when sign restrictions are based on content, rather than other more legitimate reasons, the Courts are very unlikely to uphold them. Therefore, recommends that the exemptions for real estate signs be eliminated and be treated as all other signs. PW&PC-4 -6- February 2, 1999 Comm. 454.21: Copy of letter from Councilman J. Curtis Tyler, III, dated (1998) September 2, 1998, to interested persons, in which he submits a copy of a proposed Bi11280, Draft 2, and a summary of the proposed changes for their information. Welcomes any suggestions or comments that they may have on the matter. Comm. 454.22: From Kathrin G. Kohler, President, and Bets Lawrence, Vice (1998) President, Waimea Outdoor Circle, dated September 21, 1998, on behalf of the board and members of the Waimea Outdoor Circle, stating their support for Councilman Tyler's draft bill and revisions for the proposed sign ordinance. Comm. 454.23: From Daniel L. Roudebush, dated September 19, 1998, submitting (1998) his comments and recommendations on Bill 280, Draft 2. stands at certain locations in Hilo & Kona, which are manufactured to comply with state and city sidewalk regulations. Requests permission to provide this service. Encloses maps of specific locations. Comm. 454.24: From Richard Waller, dated October 5, 1998, urging the Council to (1998) vote in favor of Councilman Curtis Tyler's amendment on the sign ordinance. States it is good protection for our beautiful scenery without hazming any businesses. Comm. 535: TRAFFIC CODE AMENDMENT (Bill 151) ALII DRIVE -ADJUSTMENTS TO PARKING RESTRICTIONS (1997) (N. KONA) PROHIBIT PARKING ALONG THE MAKAI SIDE OF KAHALUU BEACH PARK From Chief Engineer Donna Fay K. Kiyosaki, dated October 7, 1997, per request, transmits a bill to amend the Hawaii County Code, Chapter 24, Article 10 to prohibit parking along the makai side of Alii Drive by Kahaluu Beach Park. Informs the shoulder width in this azea is approximately 6-7 feet which is not wide enough to accommodate pazked vehicles, and the existing metal guardrail prevents vehicles from parking completely off the pavement. Comm. 535.01: From James S. Correa, Deputy Police Chief, dated October 30, (1997) 1997, commenting on their request to prohibit pazking along the makai side of Alii Drive by Kahaluu Beach Park. Comm. 535.02: From Debera Donner, dated October 23,1997, commenting on (1997) Bi11151. PW&PC-4 -7- February 2, 1999 Comm. 535.03: From Fr. Jack M. Ryan, St. Michael's Catholic Church, dated (1997) October 23, 1997, stating eliminating pazking neaz St. Peter's Church would be a disaster for them and for the lazger Kona community. Further comments on the subject. Comm. 535.04: From Susan Russell, dated October 30, 1997, transmitting several (1997) correspondences from Kona residents regarding Bill 151. Comm. 535.05: From D. L. Murphy October 27,1997, and S; Painter, dated (1997) November 1, 1997, informing of their concern that the limited praking adjacent to St.Peter's Church would place an inconvenience on those who attend the church. Comm 535.06: From Councilman Curtis J. Tyler, III, dated November 17, 1997, (1997) transmitting correspondence from Shyran Lee DeGuair, Diane Claire Tokumura and Arthur and Adele DeGuair, dated November 14, 1997, regazding the elimination of parking spaes on Ali'i Drive. Comm. 535.07: From Councilman Curtis J.Tyler, III, dated November 19, 1997, (1997) transmitting a correspondence from Linda Ann Yoshida dated November 14, 1997, regarding the elimination of pazking spaces on Ali'i Drive.
