FC-38 Page 2 June 1, 2000 Comm. 773: AN ORDINANCE AMENDING CHAPTER 21, ARTICLE 4, Bi112~> HAWAII COUNTY CODE 1983 (1995 EDITION), AS AMENDED, BY ADDING A NEW SECTION AUTHORIZING THE REMISSION OF SEWER SERVICE CHARGES FOR NON-RESIDENTIAL CUSTOMERS From Chief Engineer Robert Yanabu, dated Apri16, 2000, transmitting the above-mentioned amendment which clarifies the terms and conditions under which adjustments to water consumption may be applied to non-residential sewer user accounts. Comm. 77~: AN ORDINANCE AMENDING CHAPTER 21 OF THE (Eiil.l ?~fil HAWAII COUNTY CODE 1983 (1995 EDITION), RELATING TO SEWERS (Making the owner of a property responsible for the sewer user charges and including an interest penalty for overdue penalties) From Chief Engineer Robert Yanabu, dated Apri16, 2000, transmitting the above-mentioned amendment. Currently, the Wastewater Division bills the same customer as the Department of Water Supply (DWS). This has led to situations where the tenant is not responsible for the sewer fees under their lease but is responsible under the Sewer Code. Further states that another difficult situation arises when the heirs to a deceased customer do not change the account name. The interest penalty is being added to account for the time value of the delinquent user fees and to conform more closely with DWS's penalty provisions. HAWAI'I COUNTY CODE 1983 (1995 EDITION) BY ADDING A NEW SECTION TO AUTHORIZE THE SHUTOFF OF WATER SERVICE BY THE DEPARTMENT OF WATER SUPPLY TO ENFORCE COLLECTION OF SEWER USER FEES, AND AMENDING CHAPTER 21, ARTICLE 4, SECTION 21-32, HAWAII COUNTY CODE 1983 (1995 EDITION) BY ADDING A NEW SUBSECTION TO AUTHORIZE THE CHIEF ENGINEER TO ORDER THE SHUTOFF OF WATER SERVICE TO ENFORCE COLLECTION OF SEWER USER FEES AND PROVIDING FOR ADMINISTRATIVE REVIEW OF SAID ORDER From Chief Engineer Robert Yanabu, dated April 6, 2000, transmitting the above-mentioned amendment. States, currently, the Department of Public Works, Wastewater Division, has no means by which to force payment of delinquent fees. Because they do not have the ability to withhold sewer service, their delinquent fees have been a major revenue loss for the County.
