Yamashiro, dated January 25, 1999, submitting the following name for confirmation to the Hawaii County Liquor Control Adjudication Board: Mr. Jude E. Mattos of Honomu to replace Francis Pacheco of Hilo, whose term expired on December 31, 1998. Mr. Mattos is a life-time resident of Hawaii and is presently unemployed/retired due to disability. Comm. 112: HAWAII STATE ASSOCIATION OF COUNTIES (HSAC) EXECUTIVE COMMITTEE MEETING -JANUARY 20, 1999 From Al Smith, Vice President, HSAC, dated January 21, 1999, transmitting highlights of the HSAC Executive Committee meeting of January 20, 1999. ACTION IS REQUESTED on the following: Consideration of an additional proposal for inclusion into the HSAC 1999 Legislative Package measure which requests the legislature to make permanent the counties' limitation on liability from lawsuits relating to ocean recreation. Comm. 123: RESOLUTION CHANGING THE TIME ELEMENT OF GOLF (Res. 32-99) COURSE STARTER 2/ST TO GOLF COURSE STARTER 1/2T From Finance Director Harry A. Takahashi, dated January 14, 1999, transmitting the above resolution. The additional four hours per week are to accommodate the duties and responsibilities of assuming the golf cart rental functions. Comm. 127: RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS (Res. 33-99) OF A LATER FISCAL YEAR AND OF MORE THAN ONE FISCAL YEAR FOR AMULTI-YEAR LEASE FOR NINE (9) COPY MACHINES FOR THE POLICE DEPARTMENT From Finance Director Harry A. Takahashi, dated January 25, 1999, transmitting the above resolution authorizing the Mayor to enter into afive-year lease agreement with purchase options for the copy machines, one for each district (North Hilo, Hamakua, Waimea, Kohala, Ka'u, Keaau and Pahoa); and the Criminal Investigation Division and the Kona Driver License. The present machines are constantly breaking down which causes hardship and inconvenience to the different divisions and sections of the department. FC-4 Page 3 February 16, 1999 Comm. 134: RESOLUTION TRANSFERRING/APPROPRIATING $3,000 (Res. 36-99) FROM THE COUNCIL SERVICES COMPUTER ACCOUNT AND CREDITING THE SAME TO THE COUNCIL SERVICES BUILDING MATERIALS ACCOUNT From County Clerk Al Konishi, dated February 3, 1999, transmitting the above resolution. The transfer is requested for the purchase of building materials to build office furniture to accommodate the components of the new computer system in the Council Services Section. Comm. 135: RESOLUTION AUTHORIZING THE COUNTY OF HAWAII (Res. 37-99) TO ENTER INTO AN AGREEMENT WITH THE UNITED STATES OF AMERICA, PURSUANT TO HRS 46-7, FOR A LOCAL LAW ENFORCEMENT BLOCK GRANT From Finance Director Harry A. Takahashi, dated January 28, 1999, transmitting the above resolution. The purpose of the agreement is to purchase computers, printers, software and related materials to improve and enhance operation and communication within and between the Deparhnent of Justice, Office of Justice Programs, and the Office of the Prosecuting Attorney and other agencies. UNFINISHED BUSINESS Comm. 1084: ORDINANCE BILL AMENDING THE CAPITAL BUDGET (Bill 340) BY APPROPRIATING $2.5 MILLION FOR TEA PROJECTS (1998) (FEDERAL AID) AND $2.5 MILLION FOR LOCAL ROAD IMPROVEMENTS From Finance Director Harry A. Takahashi, dated November 17, 1998, transmitting the above bill. Funds for these projects shall be provided from the fuel tax increase pursuant to Res. No. 192-97. Specific projects are enumerated in the attached Exhibit A. Comm. 113: From Council Member Dominic Yagong, dated January 2l, 1999, (Bill 340) transmitting Bill 340, Draft 2, which proposes to change the (Draft 2) distribution formula by reducing the TEA-21 Projects (Federal Aid) funds from 50 percent to 40 percent and to add a category called "Roads-In-Limbo" with an allocation of ] 0 percent. Comm. 113.01: From Council Member Bobby Jean Leithead-Todd, dated (Bill 340) January 28, 1999, transmitting Bill 340, Draft 3. (Draft 3) The amendment is intended to recognize the funding requirements of circle island roads referenced in Res. No. 192-97 and shifts $500,000 from the category of local roads improvements to a category titled "Circle Isle Improvements" to establish a fund account for those roads encircling the island that cross district boundaries. (Continued on next page) FC-4 Page 4 February 16, 1999 Comm. 113.02: From Deputy Chief Engineer Jiro A. Sumada, dated January 28, 1999, recommending the removal of all references to Roads-In- Limbo contained in Bi1134Q Draft 2. Of particular concern is the statement, "WHEREAS, some of the'Roads-in-Limbo' within Hawaii County need to be maintained." States this is a policy statement that has financial impacts far beyond this ordinance. Feels its importance and impacts on Hawaii County are so significant that it warrants a separate resolution for proper and meaningful discussion and debate. Comm. 113.03: Copy of memorandum to Corporation Counsel Richard D. Wurdeman, from Legislative Assistant Liana Cox-Ishizu, dated January 29, 1999, requesting an opinion as to the legality of funding roads that fall within the auspices of Section 264-2, Hawaii Revised Statutes, identified as "Roads-In-Limbo" in Exhibit A, contained in Bi11340, Draft 2, with funds derived from fuel tax revenues.
