HomeMy WebLinkAboutORD 2000-151 2000-2002COUNTY OF HAWAII STATE OF HAWAII BILL NO. 349 Draft 2 ORDINANCE NO. 00 151 AN ORDINANCE TO AMEND CHAPTER 2 OF THE HAWAII COUNTY CODE, 1983 (1995 EDITION) AS AMENDED, TO ALLOW THE NEGOTIATED DISPOSITION OF REAL PROPERTY FOR AFFORDABLE HOUSING PROJECTS. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: Section 1. Findings Section 2-120 (a) (2), of the Hawaii County Code allows the finance director to negotiate the leasing of real property to nonprofit organizations, Section 2-120 (a) (3), of the Hawaii County Code allows the finance director to negotiate the exchange of real property to nonprofit organizations; Section 2-120 (a) (4), of the Hawaii County Code allows the finance director to negotiate the granting of licenses, permits and easements to nonprofit organizations. the Hawaii County Housing Agency is seeking to amend Section 2-120 (a) (2), of the Hawaii County Code to allow the finance director to negotiate the selling in fee simple of real property to develop affordable housing. Section 2. Chapter 2, Section 120 (a) (1), of the Hawaii County Code 1983 (1995 Edition) is amended to read as follows - Section 2-120. Disposition to government, governmental agencies, nonprofit organizations, and affordable housing developers. (a) Notwithstanding any limitations to the contrary, the council may, by resolution approved by a majority of its members, direct the finance director to negotiate the disposition of real property by: (1) Selling it in fee simple at such price and on such terms and conditions deemed proper to governmentsi and �.governmentai agencies authorized to hold lands in fee simple, to nonprofit organizations to develop affordable housing, or to affordable housing developers; (2) Leasing it to governments, governmental agencies, nonprofit organizations, or affordable housing developers at such rentals and on such terms, and conditions as deemed proper; (3) Exchanging it for real property owned by governments, governmental agencies, nonprofit organizations, or affordable housing developers. (4) Granting licenses, permits, and easements to governments, governmental agencies; nonprofit organizations; or affordable housing developers 'on such terms and conditions as deemed proper. Section 5. Severability. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are severable.
