(Note A similaz measure was adopted by the Legislature in 2000, but vetoe by the governor ) James Arakaki, Chairman December 20, 2000 Page 2 2 Hazardous Recreational Activities This proposal seeks to lima county ltabil~ty with respect to hazardous recreational achv~ties when participation in these activities holds a higher than nonnal nsk for injury or death, and when these acGvitres take place on county- owned or -controlled property. 3 Public Nohficatton This proposal seeks to provide each county with flexibility m the publication of public notices, consistent with their needs and respective charter requirements. 4 Public Service Companv Tax This proposal seeks to transfer a portion of the public service company tax revenue to the respective counties. It will allow the counties to collect their rightful shaze of the tax which, historically, has been collected in lieu of real property taxes. (Note The final version of this bill ~s still being drafted The City and County and the State currently disagree as to the language of the bill The State ~s also seeking guarantees against clams for real property taxes in arrears and guazantees against future suits Negotiations aze continuing In any event, HSAC should ensure that a Public Service Company Tax proposal be introduced for consideration by the Twenty-First State Legislature) The next meeting of the HSAC Executive Committee has been scheduled for January 17, 2001 on the island of Oahu, following the convening of the Legislature This meeting is planned to begin at 2 00 p m in the Council Committee Room at Honolulu Hale Your attendance and participation is encouraged Thank you for giving me the opportunity to represent the Hawaii County Council If you have any questions regarding this memo, please call me or my HSAC Legislative Assistant, Rory Flynn, at extension 8564. EXECUTIVE COMMITTEE MEETING MINUTES The minutes of the September 29, 2000, Executive Committee meeting were approved as amended. III. REPORTS OF THE TREASURER The Treasurers' Report for the month of September 2000 was approved. IV. REPORTS OF COMMITTEES A. Executive Committee Reports There were no Executive Committee reports. B. County Reports There were no County reports. C. NACo Reports Secretary Nakamura noted that the next meeting would be held in Sun Valley, Idaho on December 7-9, 2000. V. UNFINISHED BUSINESS A. HSAC Policy Amendment concerning conferences Your Committee noted that the following proposal was referred to the respective c~untiet: for consideration and appropriate action. The proposal is as follows: A. Mld-Year Conference, odd-numbered years, County of Hawaii or County of Kauai B. Mid-Year Conference, even-numbered years, County of Maui or City and County of Honolulu C. Year-End Conference, odd-numbered years, County of Hawail or County of Kauai D. Year-End Conference, odd-numbered years, County of Maui or City and County of Honolulu HSAC Executive Committee Minutes of the October 27, 2000, meeting Page 3 Your Committee noted that the City end County of Honolulu and the County of Maui has approved the proposed amendment. However, the County of Kauai and the County of Hawaii have not had the opportunity to take action on the matter to date. B. 2001 HSAC Legislative Program Policy Statement Your Committee noted that ail four member counties had approved the policy statement, which provides for the following: The Hawaii State Association of Counties (HSAC) shall be guided by the following policies during the 2001 legislative session: 1. The Executive Committee shall determine the strategy for HSAC's effort s before the Legislature. 2. An HSAC officer or designee shall testify before the Legislature on proposals In the 2001 HSAC Legislative Package. C. Consideration of proposals for the 2001 HSAC Legislative Package Your Committee noted that all four member counties were invited to submit proposals for possible inclusion in the 2001 HSAC Legislative Package. Your Committee noted that proposals were submitted on the following Issues: 1. Beach liability 2. Hazardous recreational activities 3. Public Service Company tax 4. Public notification 5. Permitting of cellular phone towers on agricultural lands 6. Discretionary immunity for counties 7. Home rule for collective bargaining agreements 8. Adjudicated and unadjudicated fines to fund police salaries Your Committee deieted proposal number 7 from those submitted and agreed to refer the remaining proposals to the respective counties for appropriate action. D. HSAC Mid-Year Conference Your Committee approved a request fora $1,000 advance to the City and County of Honolulu to allow it to open its conference HSAC Executive Committee Minutes of the October 27, 2000, meeting Page 4 account. President Mansho also distributed a draft of the conference schedub and confirmed the dates of the conference to be December 12-13, 2000. VI. NEW BUSINESS There was no new business. VII. COMMUNICATIONS There were no communications. VIII. ANNOUNCEMENTS President Mansho announced that the next meeting was tentatively scheduled for November 18, 2000, pending concurrence, or significant progress, by all four counties on the Public Service Company tax proposal.
