RESOLUTION AUTHORIZING A GRANT OF EASEMENT FOR RETAINING ~4'ALL
PURPOSES AT KALOKQ DISTRICT OF NORTH KONA, ISLAND, COUNTY AND STATE
OF HAWAII, TAX MAP KEY NO (3)7-3-051 PORTION OF KANAL.4NI STREET, TO
PACIFIC JETSTREAM, LLC
WHEREAS, the County of Hawaii ~s the owner of that cenam roadway parcel located m
the Kaloko Light Industnal Subdrvis~on L"nrt 1, at Kaloko, North Kona, Island, County and State
of Hawaii, known as Kanalam Street, and
WHEREAS, Pacific Jetstream, LLC, is the owner of Lot 34 of the Kaloko Light
Industnal Subdivision l;mt 1, at Kaloko, North Kona, Island, County and State of Hawaii,
specifically identified as Tax Map Key No (3)7-3-051 035, and
WHEREAS, the retammg wall owned by Pacific Jetstream, LLC along the east boundary
of Kanalam Street encroaches mto the pubhc nght-of--way, and
WHEREAS. Pacific Jetstream, LLC needs the grant of easement to mamtam its retammg
wall along the east boundary of Kanalam Street w•nhm the pubhc nght-ot=way, and
11'HEREAS, the required easement ~s approx~mateh• 46 square feet and ~s appraised at
$437 00, and
«TIEREAS, Section 2-111 of the Hawaii County Code authonzes the Council, by
resolution approved by a maJonty, to direct the finance director to grant easements from the
County of Hawaii, subJect, however, to reversion to the Counq- of Hawaii upon tennmation or
abandonment of [he easements for the specific purposes for which rt was granted
NOW, THEREFORE, BE IT RESOLVED BY THE COLT]CIL OF THE COUNTY OF
HAW,AI`I, m accordance with Section 2-1 l 1 of the Hawal`I County Code, that rt hereby
authonzes the director of finance to grant an easement for the encroachment of said retaining
wall to Pacific Jetstream, LLC, Its successors and assigns, as descnbed and delineated on
Ethlbrt "A° attached hereto, until termination or abandonment of that specific purpose, or upon
reconstruction of the retaining wall
