Hal Kamigaki of HELCO advised as follows.
• If it was totally up to HELCO, they would prefer to keep it (easement) for its intended
purpose (maintenance access) only; however, if all issues can be resolved, they will
work with us to use their easement for other purposes HELCO's issues are:
i They cannot accept liability for other uses of the easement.
u They are worried about safety occasional DWS and HELCO maintenance
vehicles are okay, but bikes and people could be a problem. The downhill
grade is rather steep overall and could be an added danger to a bike rider
Their standards are for slow-moving vehicles on unpaved roads, and even
with partial paving by DWS, it may be dangerous for bikes.
iu They feel that the homes along the easement could pose a problem. When
we met on the easement issue with the homeowners, security and
vandalism were of concern to them. Moving the easement (as we did a
couple of years ago to satisfy this concern) and advising them of the
frequency of HELCO and DWS usage alleviated their concerns They could
resurface and give HELCO a problem with construction, etc.

HELCOlDWS EASEMENT-QLT LANDS
This u in response to your letter of November 16, 2000 informing us of the Council's request for a
pedestrian/bikeway easement to be shared with the proposed HELCO/DWS roadway and utility
easement. The Department does have some concerns to the request.
Normally, in a aon-exclusive easement, the Department would provide ~~++1n1a1 maintenance of the
roadway merely for access for purposes of maintauring and operating the water system facilities within
the easement and within sites that wLll be along the easement. Will the Council provide for
maintenance of the access roadway and easement to insure the safety of the users? Will the Council
assume liability for the users of the easement
Further, opening the easement to the public increases the potential for vandalism to the utility systems
in a remote area. Vandalism may include graffiti and any damages or tampering that may compromise
water quality or water service.
