SUBJECT: PERMTT PROCEDURE FOR THE INSTALLATION OF PRIVATE
WATERLINES WITHIN COUNTY STREETS
The County of Hawaii does not have a workable permit procedure for the mstallatlon of private
consumer waterlines within County right-of--ways. This has resulted m unregulated, unauthonud and
illegal use of County property violating Chapter 2 of the Hawaii County Code The Department has been
issuing 180 day conditional permits However, the short duration rs unworkable as nearly 100% of the
conditional permits issued have now expired and no one has renewed their permit
To resolve this situation, we are proposing the enclosed draft permit. The County Council under Chapter
2, Section 2-119, will, by resolution, direct the Cluef Engineer to issue the penmt. Under this section
consultation with the Chief of police is required. In September 2000, the Council authonzed a simrlaz
permit for the installation of private convex minors within County right-of-ways
