HomeMy WebLinkAboutRES 043 Draft 01 2000-2002 COUNTY OF HAWAII ~ STATE OF HAWAII RESOLUTION NO. 43 01 RESOLUTION AUTHORIZING THE FINANCE DIRECTOR TO NEGOTIATE WITH THE ROMAN CATHOLIC CHURCH IN THE STATE OF HAWAII OFFICE FOR SOCIAL MINISTRI FOR THE SALE OF LOT 22, PLEASANT ACRES SUBDIVISION WHEREAS, the County of Hawaii purchased lot 22, Pleasant Acres subdivision being further described as TMK: 3/6-9-019: 059, (Lot 22) pursuant to the U. S. Department of Housing and Urban Development's $1 Home Sales to Local Governments program for ONE DOLLAR ($1.00) and THREE HUNDRED THIRTY THREE AND 20/100 DOLLARS ($333.20) closing costs; and WHEREAS, Chapter 2, Article 19, Section 2-120 (a)(1), Hawaii County Code, as amended, provides that real property may be sold through negotiation; and WHEREAS, Chapter 2, Article 19, Section 2-120 (b), Hawaii County Code, as amended, provides that a disposition of real property to non-profit organizations may be made without the required notice or appraisal; and WHEREAS, *_he County of Hawaii agrees to dispose of Lot 22 to the Roman Catholic Church in the State of Hawaii Office for Social Ministry (RCCHOSM), a duly formed not-for-profit corporation under IRS Section SOlc(3), for the purpose of prod ding homeless or other special needs housing; and WHEREAS, the County proposes to enter into an Agreement with the RCCHOSM after receiving proper authorization from the Hawaii County Council; and WHEREAS, the Agreement will state that the RCCHOSM will provide homeless or other special needs housing for at least two (2) years; and IOOOhmAo WHEREAS, the County hereby acknowledges that the Waimea area is a good and proper choice for homeless or other special needs housing; and WHEREAS, the County desires to use its resources to provide decent, safe and sanitary housing to qualified families; and WHEREAS, the County and the RCCHOSM mutually desire to provide homeless or other special needs housing to families with income levels of 120 percent (120) and below of the median family income for the County of Hawaii; and WHEREAS, it is the intent of the County of Hawaii to sell Lot 22 to the RCCHOSM pursuant tc the U. S. Department of Housing and Urban Development's $1 Home Sales to Local Governments program for THREE HUNDRED THIRTY FOUR AND 20/100 DOLLARS ($334.20) consideration; and WHEREAS, ~t is the intent of the RCCHOSM to purchase Lot 22 from the County of Hawaii pursuant to the U. S. Department of Housing and Urban Development's S1 Home Sales to Local Governments program fcr THREE HUNDRED THIRTY FOUR AND 20/lOC DOLLARS ($334.20) consideration; and NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that pursuant to Chapter 2, Article 19, Section 2- 111 (a)(1) Hawai'i County Code, as amended, the Finance Director ~s hereby directed to negotiate the sale of Lot 22, Pleasant Acres subdivision with the Roman Catholic Church of the State of Hawaii Office for Social Ministry to provide homeless or other special needs housing. BE IT FURTHER RESOLVED, pursuant to Chapter 2, Article 19, Section 2-120 (b) Hawaii County Code, as amended, the Finance Director is authorized to dispose of lot 22, Pleasant Acres subdivision, further described as TMK: 3/6-4-019: 059, without the required notice or appraisal. BE IT FURTHER RESOLVED that a copy of this resolution be transmitted to the Department of Finance and the Office of Housing and Community Development.
