Subject - I.egtslative Auditor's report on Hawaii Island Humane Society
I have asked for a Performance Review of Hawaii Island Humane Sceiety for several
years and this audit does not fulfill the Charter regwremerit The fact that one has never
been done and in fight of the many senous situarions and complaints island wide it
certainly justifies the need and the expense for an agency such as the National Animal
Control to evaluate the program
In the Executive Summary it states that because of lack of program definition by the
County quote "we have performed a disservice to the Hawaii Island Humane Society
and to the public " The disservice was to the public for not listening to then complaints,
which have been many and many rimes extremely senous
While the 1998 contract was flawed, the previous one was gwte explicit Hawau Island
Humane Society has been in business for gwte awhile, not all then employees are new
and they should know then responsibility to the community by now Many people Gave
called about dog problems m their neighborhood and they are told to get a trap. Many
people corrtacted venous people m the last admimstrarion and nothing happened
Our animal control laws do need reviewing, however, the straying law is dust fine The
problem is that rt has not been enforced Fines of 825 00, 850 00, 875 00 etc is a decided
deterrent, only if usedi ~ Enforcing that one law would eliminate the maJonty of
complaints Running dogs, loose in the neighborhoods are the # 1 offense Because the
humane society does not enforce the laws people take the law into then own hands I
personally know of 2 men who shot another neighbors dog because of continual problems
and the Hawaii Island Humane Society refused help, so they took care of rt themselves
Isswng citations is part of the education process We're dealing with adults, not c}uldren
and to always issue a wanung than a notice to comply etc is not doing the fob H I H S
reports show an extremely low number of citations given Education is always
uppermost m all humane society agendas, but enforcemeirt is also a crucial part of the
program, especially when you sign a contract to do the fob If a dog is aggressive and
places people m imminent danger he needs to be declared vicious the same way a drink
dnver is cited You don't give the dnver a couple more chances to inure or kill someone
H I H S really needs to spend rime studying this statute, they will not g?ve vicious dog
norices to dogs, even pit bulls, that attack and cause injury However, recently they b 1

declared a Gordon Setter vicious, over a month after the dog flushed a neighbors
chickens an officer gave the owner a vicious dog notice This is a highly trained bird dog
and was blinded by a rock thrown by the chicken owner The dog's owner was right
there putting puppies back m kennel, they had also escaped through the gate
H I H S stresses that they are educating the public Precisely what is that program, how
is it betng Judged Speaking of records whatever happened to the records I left in 1990 of
the 70 dogs declared vicious that we were periodically monitonng~
In reviewing our laws, tf an opinion is needed as to the legality of a law, in reference to
the state statutes we need to go to the Attorney General's office, Criminal Justice
Diwston, and ask Lance Goto I discussed this with him One does NOT go to another
islands Corporation Cowtsel and ask for their determination The County has the right to
write their own laws, they must be at least as strict as the state but can be stricter Check

Separating functions, animal control and animal sheltering is not practical These
functions are tied too closely together and should be done by one agency If more staff is
needed than tt should be properly trained animal coimol officers with the hwnane society
Animal control and "people" control are two different tlvngs and training to effectively
do the Job differs The police department is wtderstaffed and under funded as rt is and rt
would be impractical to expect them to set up a departrnent to do animal control The
responsibilrty for the program should go back to the police department However, not to
do the amoral control but to oversee and tram If a complaint comes in regarding any
animal rt should tmmedtately be fumed over to the humane society Animal control is law
enforcement and supemsion should come from an agency that is interested to law
enforcement I was the one that asked to set up the regwrement that all animal control
officers should have appropriate training by the police and prosecutor's office thus I am
totally aware of what is required Havtng worked as an officer and all phases of humane
society work I am also knowledgably of the sheltering regwrements The large national
hwnane societies are always upset when a humane society gives up an animal control
contract It is felt that a hwnane society can better fill that job with their education and
dedication to animal welfare
The problem arises when you have administrators and or staff with no animal welfare or
animal control background and maybe rt's Just a Job to them and they could care less
Sensitivity towards the staff and an understanding of the dtfficult job they have to
perform is essential Recently Princess, the office mascot to Kona, was adopted out. A
scene erupted over tlvs decision and one employee was fired and another qwt This also
impacted a program the next day at Kesuhou shopping center where Hawaii Island had
advertised with a large ad in West Hawaii Today that there would be animals there to
adopt I went down to check rt out No sign telling why rt was canceled, Just a no showy ~
This pest Saturday I called the Kona Shelter during business howl and got an answering
maclvne "We are busy with other customers, leave a message and we'll get back to
you" No emergency nwnber was Lsted What if this was a serious problem? Speaking of
hours H?lo is open 7 days a week Kona and Waimea only 5 days, closed Sunday and
Monday How come
A ma~onty of the cats are being put down i?nmediately The cat cages are filled w?th
supplies or whatever Then: are two separate cages so you can separate males from
females, there are shelves on the walls No, there is no law covering cats, however, this ?s
supposed to be a humane society Grayson had said, told Advo Cats, they have a
mut?mum holding penod, there is plenty of room See pictures
I have attached some activity reports,~ust for yow reference On page 23 of the audit
you can see the past contract amounts Please note m 1990 the total budget for both
shehers was $312,094 00, however, the next year ?t shot up to $474,122 00 Cost went up
and sernce went downy ~
West Hawai? Humane Society considered the Kona shelter as ow own, treated rt as such
and added many improvements, at ow own expense, to provide a better facility for the
animals Many of these ?mprovement are now gone Sce pictures
We used to have raised benches for the dogs, automatic water bowls, sheet metal between
the kennels to separate the dogs, built extra kennels in the old puppy yard, plus nused
pens for the puppies Repairs are needed aRer a lime, instead they dust removed them
Theca vetennanan removed the sheet metal this pest summer, it was thrtyi We did add a
laundry area, intake cages, storage areas, 12 kemiels m back and other improvements m
Kona and Waimea, fenc?ng, storage etc that still remain
If we're loolung at other humane soc?etres that ?s near ow size and do?ng an exemplary
fob, Main ?s the agency to look at, they have an excellent program and are highly thought
of in the community Yes, they also g?ve a lot of citations, as needed ~ In the pest they
too had theca problems but they have rt all together now
IT IS TIIVIE FOR A CHANGE. Ow community ?s growing and West Hawai? needs ?ts
own agency to work and spend their funds in West Hawaii West Hawait Humane
Society had and has an excellent worlung relahonslup with the police and prosecutor's
office Retired Capt Fergerstrom is one of ow advisor; Three of ow board members
volunteer at the Kona pol?ce station I'm past president of Kona Cnme PnvenUOn where
we honor a pol?ce officer each month I'm liaison to the Police Dept

607 dogs were redeemed, from the shelters, by their owners .Fine for straying is $ 5.00.
However, only 58 citations were given1l Why weren't citations Issued for the other 549 dogs
The fine for not having a license is $25.00, yet only 21 citations were givens Buying a license for
the dog when you redeem It does not exempt you from being fined!
Chapter 4 of the County laws and the animal control contract requires enforcement of the lawsl

State & County laws regazding animals, of proper administration of the tax payers dollars allotted to
the animal control program and the humane society's education programs. As experienced humane
society personnel and animal control officers, Ginger Towle, President and Madelyn Barrea,
Executive Director will be able to effectively handle all problems and will cooperate with the police
department to insure that the needs of the community, animal and human, are met
