Home My WebLink AboutCOM 0114.000 2000-2002 NANCY PISICCHIO Tel (808) 961-8266 Councdmember Fax (808) 961-8912 u COUNTY COUNCIL ~ County ojFlawat't f T' Nawau't County Bwld~ng 23 Aupunt Street ` HJo, Nawai'~ 96710 Febivary 8, 2001 MEMORANDUM TO Aaron Chung, Chair, Finance Committee and Council Members FROM Nancy Ptstccluo, Counctl Member ~ /~M ~ / O RE A Resolution to Authorize an Independent Eval ton of the Am~mal Control Program of the County of Hawatt At its meeting on January 23, 2001 the Fittance Corunittee voted to defer consideration of Resolutton No 20-0 I to order to allow revision of the resolutton to more broadly evaluate the County's animal control program Accordingly, I am submitting a new resolutton and Request for Proposals to response to the wishes of Counctl members As such, I recommend that we close file on Communication No 54 transmitting Resolutton No 20-01 to favor of consideration of this newly prepared resolutton and RFP For public health and safety, and for the well-bemg of ammals-both domesticated and feral-throughout our island, it is critical that the County of Hawatt provides for azumal control services Animal control is an essential function of local government In Hawaii, these services aze typically performed under contract by established hiimane orgamzattons Unfonunately, our ammal control progiam has received mconsistent support and direction for many years Meanwtnle, our shelteis are deluged with an exceptionally high intake of unwanted ariimals, overwhelming the ability of humane officers to provide patrol services and respond to nuisance complaints Many tons of euthamzed ammals are boned at oiir landfills every week Our spay/neuter subsidies lag far behind other counties A recent story by Hunter Bishop m the Nawati Tribune-Herald (attached) paints a grim picture of the duress of shelter workers trying to cope with all these problems Our Auditor's study recommends a professional and independent evaluation to guide our policy-makmg Our goal is to receive a complete, independent written performance evaluation by July of this year In soliciting an independent contractor, I propose that the Counctl appropriate 312,000 and obtain the services of a qualified evaluator in conforttiance with the provisions of our state procurement law I believe tt is prudent and responsible for the Counctl to seek independent assessment of our county's animal control operations, our needs, and to heaz recommendations for trriprovements, including u Comm. INTRODUCTION A. Generallnformatton The Council of the County of Hawaz't, pursuant to adoption of Resolution No ,finds [hat tt is m the public interest to contract the servtces of an established animal welfare organization to conduct an independent evaluation of the animal control program of the County of Hawaz't The evaluation with recommendations is intended to provide (1) An assessment of the structure and framework of the County of Hawaz't's animal control program and the adequacy of animal control enforcement provtstons performed by the present contractor, to include an evaluation of interagency coordination between the Hawat't Island Humane Soaety and the Hawaz`i County Police Department, Prosecutor's Office, and Corporation Counsel's Office, (2) An assessment of the present administration and oversight of the County•s animal control contract by the Department of Finance, to include recommendations for contractual performance, goals and objectives, and standards of compliance sublet[ to agreement by humane society providers and the County of Haw•az't, (3) An analysts of Chapter 4, Hawaz't County Code, to include recommendations for a revised animal control ordinance, (4) An assessment of the overall adequacy of funding for animal control servtces and the recommended county appropriation for animal control servtces, (5) An assessment of the swtabdtty of maintaining one contractor to serve the entve County of Hawaz'i (6) An expert, technical assessment of the animal sheltering and animal control operations presently funded by the County of Hawaz'i B. Contract Engagement: Term, Execution The Council antiapates and prefers that the agreement entered into, as authorized by Council resolution, will not exceed four (4) months C. Rights, Reservations and Constderattons The County reserves the tight to investigate the experience and records of each proposer, and to requee Further tnforntatton from any proposer The County shall be the sole fudge of the facts as to the reliability of the proposer Should the proposer fazl to meet the qualifications stated herein or fazl to subn»t additional information requested by the County, the County may refuse to accept or consider any proposal submitted by such proposer There is no expressed or implied obligation for the County of Hawaz`t to rnmbivse responding firms or organizations for any expenses incurred m preparing proposals m response to t}us request Such costs should not be included m the proposal Unless otherwise expressly provided in the contract, all provtstons of these specifications and instructions shall be considered to be part of the contract entered into by the County and the Contractor The "General Terms and Conditions for Goods and Services," including exlvbits of appropriate contract and bond documents, dated July 1, 1994, shall be a part oEanv contract entered into as a result of this proposal All proposers are responsible to be familiar with these general terms and conditions, a copy of which is on file at the Purchasing Division and will be made available to anv interested person upon request at no charge Where any conflict might appear, the specifications shall have precedence over the General Terms and Conditions The County shall have the right to suspend performance of the services under the agreement or terminate the agreement m whole or m part at any time by written notice to the Contractor with good cause It is understood and agreed that any sen~ces to be provided m accordance with the terms of this agreement may be terminated unmediately, m whole or in part, upon a finding by the Countv that these sernces must be provided by public employees, pursuant to Cml Sen~ce Laws or that such sernces will be chsconunued It is further understood that, should such a finding be made, the County will not be liable under this agree- ment For any resulting damages, and such a termination will not be considered a breach of the agreement D. H. SCOPE OF SERVICE A. Definitions "COVI'RACTOR" shall mean the person, company, or nonprofit organiuUOn awarded the work "COUKTY" shall mean the Countv Council of the Countv of Hawaii B. Form, Content and Distribution of Final Report The Contractor's final written report shall be addressed to the "Chair and Members of the County Council, County of Hawaii, Hilo, Hawai'i," and shall contain the Following parts 1 Title of report The title of the report shall be as follows "Independent Evaluation of the Animal Control Program of the County Of Hawai`i:' 2 A foreword, to include a summary desmption of nationally established and accredited protocols and standards of animal control shelters and the organization of municipal animal control programs 3 A table of contents 4 An introduction consisting of a statement of the purpose of the report, a brief description of the scope of the evaluation conducted by the Contractor, and an outline of the organiuUOn of the material m the report 5 The report shall present detailed findings and recommendations relating to each of the areas specified in the `Specihcauons" below 2 6 Pnor to submittal of the Mal written report to the County, the Contractor shall submn its report to the following parties for review and written response (a) Executive Director, Hawaz'i Island Humane Socety, (b) Hawaii County Finance Department, (c) Hawaii County Police Department, (d) Prosecutor's OEHce, (e) Office of the Corporation Counsel The written responses of all the aforementioned parues shall be included in the Contractor's final report submitted to the County The Contractor shall deliver an unbound original and two (2) copies of the complete evaluation report to the Legislative Auditor no later than Friday, July 27, 2001 C. Specifications The Contractor, as an independent contractor, shall perform and carry out in a satisfactory and proper manner, as reasonably determined by the Counh', all work requred to conduct a thorough evaluation of the animal control program of the County of Hawaii, to include a site assessment of the three animal shelters operated by the Hawaz`i Island Humane Society and its management and administration The work shall commence upon award of the agreement and shall be completed in written report form not later than June 22, 2001 Services to be provided shall include, but not be limited [o, the following 1 The Contractor shall produce a detailed, written report addressing the following areas for evaluation and recommendations to the County as enumerated below (a) Structure and framework of the County of Hawai'i•s animal control program, to include comments and recommendations for clear designation of animal control responsibilities among relevant Countv departments and coordination of services with a convacted humane soaety (b) Assessment of the administration and oversight of the County's animal control contract by the Department of Finance, to include recommendations for contract standards for service delivery and measurements and reporting protocols to assure contract compliance, (c) Assessment of Chap[er 4, Hawaii County Code, to include recommendations for amendments of the County's animal control ordinance deemed appropriate based upon assessment of the scope of animal control sernces required by the County of Hawaii and ns auzens and knowledge of successful animal control programs m other counties and municipalities (d) Assessment of the adequacy of County funding for animal convol services, to include recommended funding levels to address the costs of shelter operations, spay/neuter services, animal convol enforcement functions, and recommended licensing fees for pet owners and breeders (e) Assessment of the smtabihty of maintaining one contractor to sen•e the enure Island of Hawaii versus two or more contractors serving distinct island districts, (f) Assessment of the current sernce delivery of the Hawaii Island Humane Society m the areas enumerated below i. CONSQLTATION ON REPORT FINDINGS AND RECOMMENDATIONS Subsequent to completion of the work regwred, the Contractor shall, as part of the convact, be available for a telephone conference call with the Council's Committee on Finance to discuss the findings and recommendations contained m the evaluation and to answer questions pertaining thereto i IV. BUDGET LIMITATIONS AND TIME REQUIREMENTS A. Budget Ltmrtattons The total sum to be allocated for conducting the independent evaluation of the Haw•ai'~ Island Humane Soaety shall be I~mrted to the extent of Funds approprtated for tlus purpose and the continued avatlabtlrtv of such funds dunnq the course of the protect The anuapated cost of the performance evaluation ~s between 55000-58,000, plus vavel expenses 2 The method of payment for services provided by the Contractor, whether m lump sum or m increments, shall be agreed to mutually by the Contractor and the County Should progress or incremental payments be agreed upon as the method of payment, the follovvtnq condmons shall apply a The amount of each progress payment shall be subtect to agreement b In no event <hall a final payment be made except upon the delivery of a final report acceptable to the County Counal c The County reserves the nght to determine and prescnbe such other conditions as are appropriate under which progress payments shall he allowed B. ADDITIONAL TERMS AND CONDITIONS A As national animal welfare organizations mazntain headquarters outside the State of Hawaz't, the County of Hawat`t anticipates that the Contractor's place of business is on the U S maznland Accordingly, the Contractor shall conduct rts srte vtsrtation and inspection of the three shelter facilities maintained by the Hawat't Island Humane Soaety For a period of at lea<t six (6) worlung days, to include a Saturday for purposes of observing public use of a shelter faaltty and its staff operations B The Contractor shall submit its bid for costs for travel to and from the U S maznland not [o exceed the following budget 1 R/T avfare at coach class rate for no more than two (2) evaluation team members 2 Hotel accommodations for not more than seven days to Hawaz`t not to exceed 5120/day per evaluation team member, including hotel room tax 3 Renal car and gas/oil expenses not to exceed S50/day for seven days on the Island of Hawaz't 4 Per diem for meals and miscellaneous expenses not to exceed E~0/day for each evaluation team member 5 Expenses for taxi to/from home or place of business to azrport not to exceed Ei0 per evaluation team member C QUALIFICATIONS The Contractor 1 Must provide written documentation to show that the proposer has experience to furntslung written technical and on-site evaluations of animal control/welfare agencies Such documentation should include four (4) copies of actual reports prepared for at least two muntapal or county lurtsdtcuons during the last two years, and 2 Must provide references from no less than three mumctpal or county lunsdtctions of satisfactory performance of a contracted performance evaluation of an animal control program during the last two years D Factors for rating of proposals received by the County of Hawaz't, to order of importance, are as follows 1 Qualifications and experience to the operation and accepted protocols of animal shelter/welfare and experience m providing evaluative reporting to counties and/or municipalities ftmdtnq animal control programs = 45 points 2 Specific plan or methodology to be used to perform the serv-tce = 20 points 3 Documented references from mumctpal or county governments of satisfactory performance of preparing professional evaluations and recommendations relating to the operation of animal control programs = 20 points 4 Price = 15 panu 7
