South Hilo. Hawaii, TMK 2-2-34 95, reports as follows Bill No 24 amends Section 25-8-33 (City of Hdo Zone Map), Article 8, Chapter 25 (Zoning Code) of the Hawai' i Counn• Code, by changing the district classification for approximately 12,473 5 square feet of land from a Single Family Residential (RS-10) to a Neighborhood Commercial (CN-10) zoned district The rectangular-shaped subJect property, owned in fee by the applicants, is located on the west-side of Hinano Street, approximately 100 feet from the intersection with Kekuanaoa Street, directly across the Big Island Candies site The propem• is surrounded by a rock wall approximately 3 feet high The two-story duplex was constructed in 1937 and the records indicate that the first Floor dwelling has six bedrooms and the second floor has two bedrooms The applicants are seeking the change of zone to utilize the existing two-story dwelling as a boarding facility and possibly office rentals in the future The first Floor was approved as an ohana and on May 7, 1991 The applicants are presently caring for an elderly parent and are looking to relocate to a new residence due to the increasing difficulty in accessing the upstairs unit Plans indicate anon-conforming structure, as setbacks do not meet the required setback for the RS-15 zoned district, which are 25 feet for the front and rear, and 15 feet on the sides Upon approval, the downstairs would be converted to a boarding facility and the upstairs would be converted when the applicants secure a new dwelling The State Land Use designation is "Urban" The General Plan Land Use Pattern Allocation Guide (LUPAG) Map designates the area as Low Density Urban Development, which are used for single family residences, ancillary communih• and public uses, and convenience type commercial uses Pursuant to General Plan Amendment No 16, effective October 29. 1992 (Ordinance No 92-I 15), the area (roughly 122 ~ acres) bordered by Hualani Street, Kalanikoa Street (including parcels located on the eastern side of the street). Lanikaula Street, and Mililani Street, was re-designated from Medium Density Urban and Industrial to Low Densih Urban The Hilo Community Development Plan (CDP), adopted by Resolution in 1975 by the Planning Commission recommended that the area be maintained as RM-4 Boarding facilities are not allowed in the Residential (RS) districts, but are allowed in the Multiple-Family Residential (RM) and Commercial d istncts The subJect property is not located within the Special Management Area and is located approximately one mile from the nearest coastline The Agricultural Lands of Importance to the State of Hawaii (ALISH) classification is Urban Development The Land Study Bureau Soil Rating is Urban The USDA soil classification is Keaukaha, which consists ofwell-drained, thin organic soils overlying pahoehoe lava bedrock with medium runoff and slight erosion hazard PC-8 PC-8 Page 2 February 6,2001 The subject property is located within Zone"X", an area determined to be outside the 500-year flood plain. Because the property had been improved,the likelihood of any archaeological features is remote and the impacts to flora and fauna are expected to be minimal. Surrounding lands adjacent to the subject property are zoned RS-10. Big Island Candies, located across the street, is zoned CG-20. Approximately 100 feet north of the subject property, is the approved Hara zoning, which allows the construction of an office building. Further north on Hinano Street are parcels zoned CN-7.5, which include Don's Grill and the JCC Credit Union. Oda-McCarty Architects is located approximately 600 feet northwest of the subject properties. Access isP roposed from Hinano Street, a County roadway, and since the zoning is for a commercial use, the Department of Public Works is recommending that Hinano Street be widened to a 50-foot right-of-way from its current 40-foot right-of-way, and that future road widening sections and roadway improvements be subdivided and dedicated to the County. Water is available to the property from existing waterlines and future commercial uses may require more than the allotted 600 gallons per day, so the Department of Water Supply is requiring the installation of a backflow preventer. Wastewater will be disposed of through a County sewer line fronting the subject property. All other utilities and services are available to the subject property. Bill No. 24, Draft 2, which merely replaces the existing map with the corrected version explaining that the subject parcel is being zoned to CN-10 instead of CN-7.5,was circulated and approved by Your Committee. Your Committee had some concerns about the availability of parking in the area, and Mr. Soares explained that there would be eight regular stalls and one handicapped stall. This will be more than the required amount stated in the Subdivision Code. Mr. Soares also mentioned that he spoke to the neighbors and they were agreeable to his request. Your Committee concurs with the Planning Commission and the Planning Director for recommending a favorable consideration for the Change of Zone request. Your Committee on Planning is in accord with the intent and purpose of Bill No. 24, Draft 2, and recommends it pass first reading.
