COUNTY OF HAWAII STATE OF HAWAII <br /> RESOLUTION NO. 52 1!1 <br /> RESOLUTION ACCEPTING THE DEDICATION OF THAT CERTAIN ROADWAY <br /> PARCEL BEING A PORTION OF HIEN'ALOLI-KAHULUI ROAD, SITUATE INN KONA, <br /> ISLAND AND COUNTY OF HAV6'AI`I, STATE OF HAWAII, FROM MARYL GROUP, <br /> NC , BEING A PORTION OF TAX MAP KEY (3)7-5-011 002, TO THE COUNTY OF <br /> HAWAII <br /> ~•'I-IEREAS, Maryl Group, Inc , a Hawaii corporation, is the owner of that certain <br /> <br /> roadway parcel being a portion of H~enaloh-Kahulw Road, located m N Kona, Hawaii, <br /> specifically identified as a pomon of Tax Map Key (3)7-5-011 002, being more particulazly <br /> descnbed m the attached dedication deed (Exh~brt "A") attd delineated on Exhibit "B" attached <br /> <br /> hereto, and <br /> V4'IIEREAS, Maryl Group, Inc has constructed all subdiv•~s~on improvements and <br /> received final subdivision approval, and <br /> WHEREAS, ~4aryl Group, Inc is desirous ofded~caung the sub)ect parcel, including all <br /> subdiv~s~on improvements thereon, to the County of Hawa~'~ for road and drainage purposes, and <br /> the improvements have been inspected and approa•ed by the County of Haw•a~'~ Department of <br /> Public Works, Department of Water Supply and the Planning Department, and <br /> WHEREAS, the subject road and drainage improvements have been completed according <br /> <br /> to County of Hawa~`i standards, aze m acceptable condition for ded~catwn, and m full compliance <br /> <br /> with the provisions of Chapter 23 of the Hawa~`i County Code, and <br /> WHEREAS, Section 23-10 of [he Hawai`~ County Code proh~brts the council from <br /> <br /> recei~ mg by ded~cat~on any streets m any subdwisron platted after December 2, 1966 except <br /> upon full compliance with the prov~s~ons of Chapter 23, and <br /> WI-IEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides that the <br /> <br /> Council may accept gifts which include the dedication of land on behalfof the County of <br /> <br /> Hawai'~, <br /> <br />
