HomeMy WebLinkAboutRES 052 Draft 01 2000-2002 COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO. 52 1!1 RESOLUTION ACCEPTING THE DEDICATION OF THAT CERTAIN ROADWAY PARCEL BEING A PORTION OF HIEN'ALOLI-KAHULUI ROAD, SITUATE INN KONA, ISLAND AND COUNTY OF HAV6'AI`I, STATE OF HAWAII, FROM MARYL GROUP, NC , BEING A PORTION OF TAX MAP KEY (3)7-5-011 002, TO THE COUNTY OF HAWAII ~•'I-IEREAS, Maryl Group, Inc , a Hawaii corporation, is the owner of that certain roadway parcel being a portion of H~enaloh-Kahulw Road, located m N Kona, Hawaii, specifically identified as a pomon of Tax Map Key (3)7-5-011 002, being more particulazly descnbed m the attached dedication deed (Exh~brt "A") attd delineated on Exhibit "B" attached hereto, and V4'IIEREAS, Maryl Group, Inc has constructed all subdiv•~s~on improvements and received final subdivision approval, and WHEREAS, ~4aryl Group, Inc is desirous ofded~caung the sub)ect parcel, including all subdiv~s~on improvements thereon, to the County of Hawa~'~ for road and drainage purposes, and the improvements have been inspected and approa•ed by the County of Haw•a~'~ Department of Public Works, Department of Water Supply and the Planning Department, and WHEREAS, the subject road and drainage improvements have been completed according to County of Hawa~`i standards, aze m acceptable condition for ded~catwn, and m full compliance with the provisions of Chapter 23 of the Hawa~`i County Code, and WHEREAS, Section 23-10 of [he Hawai`~ County Code proh~brts the council from recei~ mg by ded~cat~on any streets m any subdwisron platted after December 2, 1966 except upon full compliance with the prov~s~ons of Chapter 23, and WI-IEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides that the Council may accept gifts which include the dedication of land on behalfof the County of Hawai'~, NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAR'AI`I that ri finds the subject subdivision and improvements thereon are in full compliance w•rth the provisions of Chapter 23 of the Hawaii County Code as certified and approved by all applicable agencies VOW, THEREFORE, BE IT FL"RTHER RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, m accordance +vtth Amcle XIII, Section 13-12 of the Hawat`i County Charter, and Section 23-1U of the Hawaii County Code, that the County of Hawaii accepts [he real property m the attached dedication deed (Exhibit "A") and more specifically Identified as a portion of Tax Map Key (3)7-5-011 002, including all improvements thereon, for public road and drainage purposes DATED Hilo, Hawaii, INTRODUCED BY t / -
