RESOLUTION AUTHORIZING AI~"D EMP01~1'ERING THE FINANCE DIRECTOR TO
ACQUIRE TAX MAP KEYS (3)2-4-025 044 AND 2-4-025 046 FOR FUTURE EXPANSION
OF THE PUBLIC SAFETY COMPLEX FOR LAW ENFORCEMENT PURPOSES
WHEREAS, the County of Hawaii is the owner of Tax Map Key (3)2-4-025 028, where
the Public Safety Building ~s located (see Exh~b~t "A" attached), and
W7IEREAS, the i1a•o abutting properties, being Tax :vlap Keys (3)2-4-025 044 and
2-4-025 046 are currently vacant, available for a limited time, and would provide the police
department with room to accommodate their ever growing needs,
WHEREAS, these hvo abutnng properties are currently subJect to oversight by the United
States Bankruptcy Court, D~stnct of Hawai'~, and
«'HEREAS, the owner of the two abutting properties desires to sell the properties and the
Hawaii County Police Department is interested m acginnng the two abutting properties, and
V6'HEREAS, by certified letter dated August 28, 2000 (see Exh~b~t "B" attached), the
County of Hawa~'i, for and on behalfof the Hawa~`~ County Police Department, submitted an
offer to purchase the two abutting propemes, subJect to certain conditions, and
~4•'HEREAS, by Order Granting Debtor's Motion to Sell Property Other Than in The
Normal Course of Business, dated January 19, 2001 (see Exhibit "C" attached), the United States
Bankruptcy Court granted permission to allowing the sale ofthe two abutting properties by direct
negonat~ons with the County of Hawa~`i, and
~l'IIEREAS, money for the acgms~tion of the two abutnng properties is available through
the Asset Forfeiture Fund, and
WHEREAS, the U S Department ofJusnce, m [heir letter ofluly 17, 2000 (see
l;xhibit "D" attached), has approved the use of the Asset Forfeiture Fund for the acgmsrtion of
the two abutnng propertres, provided the properties are used for law enforcement purposes, and
WHEREAS, the County can acquire these hvo unique parcels for 5175,000 with proceeds
from the asset forfeiture account w•h~ch is below them current assessed value of $200,000
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCII, OF THE COUNTY OF
HAWAII that it authorizes the acquisition of Tax Map Keys (3)2-4-025:044 and 2-4-025:046 for
future expansion of the Public Safety Complex for law enforcement purposes.
BE IT FURTHER RESOLVED that the Director of Finance of the County of Hawaii be
and is hereby authorized and empowered to finalize the acquisition of Tax Map
Keys(3)2-4-025:044 and 2-4-025:046.
BE IT FINALLY RESOLVED that the Clerk of the County of Hawaii is directed to
transmit copies of this resolution to the Honorable Harry Kim, Mayor of the County of Hawaii;
Police Chief James S. Correa; Director of Finance William Takaba; and Randolph R. Slaton,
attorney for the debtors in Case No. 00-01431, United States BatrlQUptcy Court, District of
Hawaii.

Subject: Taz Map Reys: 3rd/2-4-25:44 and 46
Reference is made to your letter of May 4, 2000 and my response
of May 8, 2000 and pour recent telephone conversation with
Ezecutive Assistant Glenn Y. Taguchi about the subject property.
After reviewing our available finances, the County of Hawaii,
for and on behalf of the Hawaii Police Department, submits an
offer to purchase Taz Map Reys: 3rd/2-4-25:44 and 46 for a
total purchase price of One Hundred Seventy Five Thousand
dollars ($175,000.00). The offer to purchase is subject to the
following:
1. The availability of Asset Forfeiture Funds;
2. Authorization to acquire the subject properties and
approval of its funding source by the Council of the
County of Hawaii;
3. Approval of the sale of the subject properties to the
County of Hawaii for the Hawaii Police Department by the
United States Bankruptcy Court;
4. That the subject properties shall be free and clear of all
encroachments, liens, encumbrances, mortgages and the like;
5. That the subject properties shall be free and clear from
any and all easements, rights-of way, reservations and the
like that may unduly interfere with the use of the subject
properties for the future ezpansion of our Hawaii County
Public Safety Complez; and
6. That this offer to purchase may be withdrawn upon a thirty
(30) day written notice of the County of Hawaii's
intention to withdraw said offer to purchase.
