Dear Ms. Goldstein:
On behalf of WB Kuldo Resorts, LLC (WBK), the following is a report on the status
of development and compliance with the conditions of approval for the subject
Change of Zone Ordinance and Special Management Area Use Permits related to
the resort development.
Status of Development
Following the purchase of the Kuldo property in June 1999 planning and
development of the msort property has progressed smoothly. In Decemlxr 1999
WBK received grading permit approval for area malcai of Queen Ka`ahumanu
Highway. In March of this year, WBK received Board of Land and Natural
Resources (BLNR) approval of a Conservation District Use Permit allowing for the
construction of water utility related improvements over State lands and a portion
of the State Conservation District located mauka of the Kuldo property. The water
utility improvements will connect the resort's maulca potable wells with the resort
proPC1'tY•
Final Subdivision approval for the Phase I subdivision in the area makai of Queen
Ka'ahumanu Highway was received in August of this year. Grading Permit
approvals have also been received for infrastructure related improvements in the
area mauka of the highway and for the resort golf course. Mass grading of the
area malcai of the highway is near completion and construction of the resort
infrastructure, which will start shortly, is expected to be completed by the end of
2001.

Final plan approvals for the resort hotel (Beach Club), Golf Course and Golf
Clubhouse, and the Sales Office have also been received this year. Construction
of the sales office is currently underway and is expected to be completed by
December 2000. Construction of the resort hotel (Beach Club) is scheduled to
start in the first quarter of 2001 and be completed and ready for occupancy by the
end of 2002.
With regards to the proposed Kikaua Point Park (Disputed Parcel), a request by
WBK to amend the prior BLNR approval of a settlement regarding the disposition
of the disputed parcel and to grant a right of entry to initiate the proposed
landscape improvements was approved by the BLNR at its October 27, 2000
meeting. The BLNR also approved a Management Plan for Kikaua Point Park. A
copy of the BLNR approval is attached for reference. WBK recently submitted
plans to both the DLNR and your office to initiate the landscape improvements in
the park area. Plans for the structural and related infrastructure improvements
within the park area will be submitted for Final Plan Approval at a later date. The
structural improvements related to public access, restrooms/showers and related
utilities are scheduled to be completed and available to the public concurrent with
the occupancy of the resort hotel near the end of 2002.
Regarding the compliance with conditions of approval from the subject ordinance
and permits, the following tables provide a summary of the status of compliance.
Those conditions that have been fully satisfied are so indicated along with
reference to the corresponding compliance letters}.

Associates L.P., we are transmitting ten (10) copies of the
above subject subdivision for your preliminary approval.
The SMA for this development was approved on October 27,
1988.
Although the configurations of the various parcels that
were previously approved has changed, the basic development
concept of a Resort Hotel zone, Golf Course and both RS
single-family residential and RM multiple-family residential
zoning remains the same.
All roadways within the parcels will remain private.
Water will be supplied from wells at the Huehue Ranch parcel
currently under construction. Two wells with brackish water
era under construction in the Upper Beach Development for
irrigation of the Golf Course. The location of these two
wells will be shown on the subdivision plan of the "Upper
Beach" that will be submitted shortly. A sewer treatment
plant that will service both developments will also be
located in this upper area. These utilities will also
remain private. All electric and telephone lines will be
underground. Lakes and retention area will be constructed
in strategic locations within the golf course and will be
used as holding ponds for drainage.

Access for the public to the beach area will be
provided, with parking for approximately 40 stalls with a
foot trail from the parking area to the beach. A sketch of
the ,tentative location of the easements is attached.
Easement documents will be provided for these facilities.
Anchialine Ponds located in the Hotel-Resort site will be
preserved.
A tentative development schedule is also included as
part of this submittal. A check Por $42.00 for •the
subdivision filing fee is also enclosed.

We have reviewed the various documents relating to compliance with wnditions of approval for
the above-referenced Ordinance No. 88-158, SMA Use Permit No. 273 and SMA Use Permit
No. 311. Based on our review and wordination with the affected agencies, we hereby find the
following condiuons have been complied with.
1. Ordinance No. 88-158 Condition C: The landscaping plan for the 150-foot wide planting
easement fronting Queen Kaahumanu Highway as stated in your July 27, 2000 is
approved.
2. Ordinance No. 88-158 Condition E and SMA Use Permit No. 273 Condition No. 6: By
letter dated August 8, 2000, the State Department of Transportation reviewed and
approved the Traffic Monitoring Program ofthe Queen Kaahumanu Highway-Kuki`o
Beach Resort's intersection.

letter dated April 13, 2000 to Mr. Stephen Lim, the Office of Housing and Community
Development aclrnowledged receipt of 5236,000.00 as in-lieu payment to satisfy the
affordable housing and employee housing requirements.
4. Ordinance No. 88-158 Condition P(3), SMA Use Permit No. 273 Condition No. 13 and
SMA Use Permit No. 311 Condition No. 16: We have reviewed the revised
Comprehensive Public Access Plan (July 2000) and hereby approve said plan.
5. Ordinance No. 88-158 Condition P(4), SMA Use Permit No. 273 Condition No. 19 and
SMA Use Permit No. 311 Condition No. 20: In coordination with the Office of Housing
and Community Development, we have reviewed and hereby approve the Construction
Housing Mitigation Plan.
6. SMA Use Permit No. 273 Condition No. 18 and SMA Use Permit No. 311 Condition
No. 22: In coordination with the Office of Housing and Community Development, and
the Department of Civil Service, we have reviewed and hereby approve the Job Training
Progtarrt.

Condition 3 of•the tentative approval to subdivider, W.B. Kukio
Resorts, forwarded by your February 4, 2000 letter to Mr. Dennis
I. Hirota, President, Sam 0. Hirota, Inc.; states that the
subdivider is to provide assurance, in consultation with the
Department of Health, that a water source and treatment facility
of adequate quality and quantity is available.
This letter is to inform you that the State Department of
Health's Safe Drinking Water Branch (SDWB), has reviewed the
engineering report submitted to provide potable water for the
proposed resort subdivision, Kukio Bay Beach Club. We have
determined through our review, that the proposed water system
will provide drinking water meeting the State's potable water
regulations. The proposed water system will also have sufficient
quantity to meet the anticipated water demands of the proposed
subdivision.
As such, we have determined that the proposed water source and
treatment facility will satisfy condition 3 of your February 4,
2000 letter. We understand that Condition B of Rezoning
Ordinance No. 88-158 has a similar requirement.

Associates L. P., we are transmitting ten (10) copies of the
above subject subdivision for your preliminary approval.
The SMA for this development was approved on October 27,
1988.
Although the configurations of the various parcels that
were previously approved has changed, the basic development
concept of a Resort Hotel zone, Golf Course and both RS
single-family residential and RM multiple-family residential
zoainq remains the same.
All roadways within the parcels will remain private.
Water will be supplied from wells at the Huehue Ranch parcel
currently under construction. Two wells with brackish water
are under construction in the Upper Beach Development for
irrigation of the Golf Course. The location of these two
wells will be shown on the subdivision plan of the "Upper
Beach" that will be submitted shortly. A sewer treatment
plant that will service both developments will also be
located in this upper area. These utilities will also
remain private. All electric and telephone lines will be
' underground. Lakes and retention area will be constructed
in strategic locations within the golf course and will be
used as holding ponds for drainage.

this plan. Ne met with hr. Leonard of PBR and with Mt. Carlson of
Huehue Ranch on January 1990, and discussed the plan.
Ne !find the plan acceptable, with the conditions (1) that the Pour

that the follo~lnq two alterations are wade to the plan:
1. Page 15, Last Item (Item 4). This should be reworded to
indicate Chat, "On-site monito[inq o! grubbing and grading in
the immediate vicinity of the historic sites shall take place
to assure preservation o! !lagged sites."
2. Pape 16, Altar !'first Paragraph. An additional paragraph
' should be inserted s+hich reemphasizes that the existing plan
is to p~.esucve the two bu[Lal wiles, but that should
disinterment have to occur, for some unforeseen reason, then
the lollovinq procedures shall be followed. Note: Otave
goods must also be reburied in any case of disinterment and
csintermant. ,
Ne would also like to emphasize that i! the burials •re preserved
in place. then analysis o! these burial sites should only document
archaeological context and deposits, while the remains themselves
should not ba disturbed, othe[ than brief analysis to help
datatwine numbers of individuals, ethnicity, age and sex.

With the enclosed petition, Huehue Ranch Associates, LP., is seeking a Special Management
Area Use Permit for development of a 350-unit hotel and supporting facilities and f43 lot
single family residcntial subdivision at Uluweoweo Bay, Kukio, North Kona, Hawaii. The
petition area covers an area of approximately 105 acres at Uluweoweo Bay.
In October 1988, Huehue Ranch Associates, LP., received approval of SMA Permit No. 273
(SMA 273) which allowed for a 19-lot subdivision, golf course and clubhouse,
infrastructure, plant nursery, and other support facilities which were part of an approximately
675-acre master planned t'esort community at Kukio.
At the time of the previous SMA submittal, hotel plans were not completed and, therefore,
not included with the earlier submittal. Huehue Ranch Associates, LP., having completed
their plans for the hotel portion of the development is seeking a SMA Use Permit for the
Regent Kona Coast Resort Hotel and the supporting facilities, including restaurants, health
spa and service facility, sewndary roads, and related utilities. The petition also includes a
f43 lot tesidenttal subdivision.
When the application was made for SMA 273, the plan envisioned two high-rise hotels with
a total of 1,250 units. The present SMA petition is for the consWction of a low-rise,
predominately single-story, 350-unit hotel, representing a significant reduction in the scale
and density from the previous plans and existing inning.
To satisfy the submittal requirement for a Special Management Area Use Permit and to
provide you with information to assess the request, enclosed are the following:

' In meeting Condition 4 of SHA Uee Permit No. 311, we are submitting the
enclosed nine (9) copies of the preliminary subdivision plan for the Phase I
residential subdivision at Regent Kona Coast, a subdivision application and a
check for 5138.00 to cover the processing fee (41 lots $ S3.00 per lot +
S15.00 ~ S138.00). From our dlacuasiona with Hasa Onuma and Nally Hataunami,
we understand that this application cannot be acted upon until the applicant
has received final approval for the large lot subdivision for the subject
property. Plesae note that although the lot boundaries within the subdivision
plans are not entirely consistent with the undnrlyinq zoning boundaries, the
subdivision has, however, been configured to meet the minimum lot requirements
for each zone (7,500 square leet for RH-3.0 and 4.0 zones). Also, remnant
portions and their corresponding acreage are shown as requested.
The enclosed plena are consistent with the Regent Kona Coast Haater Plan which
hae been revised since the time of the sul~ittal of the large lot subdivision
plans. The changes to the Resort Raster Plan were necessitated in large part
by a request by the Department of Land and Natural Aeaouroea Historic
Preservation Division to preserve maior portions of the mauka-makai trail and
trail spurs to the adjoining properties. In order to bring the large lot
subdivision plans in conformance with the current Resort Raster Plan, the
applicant will be submitting, under separate cover, revised plans for the
large lot subdivision of the resort property.
Additionally, Huehue Ranch Associates, L.P. plans to submit a rezoning
application within three (3) months which will seek to rezone the entire
resort property to bring this in conformance with the Resort Raster Plan and
pending subdivision applications.

Thank you for your letter of November 21, 1989, which submitted
Chia plan. Ne net with Mr. Leonard of PHR •nd with Mr. Carlson of
Huahue aanch on January 4, 1990, and discussed the plan.
We find the plan acceptable, with the conditions (1) that the four
conditions in your letter ace considered past of the plan, and (2)
that the following two alterations era made to the plan:
1. Page 15, Last Item (Item This should be reworded to
indicate that, "On-site monitoring of grubbing and grading in
th• immediate vicinity of the historic sites shall take place
to assure preservation o[ flegged sites."
Z. Page 16, Alter liret Paragraph. An additional paragraph
should be insetted which reemphasizes that the •xiatinq plan
is to piearrve the two burial sllea, but that should
disinterment have to occur, Eor some unforeseen reason, then
the lollowinq procedures shall ba followed. Nora: cicave
goods moat also be reburied in any caee of disinterment and
reintarmant. ,
Fie would also lik• to emphasize that i! the burials are preserved
in place, then analysis of these burial sites should only document
archaeological context and deposits, while the remains themaelvea
should not be disturbed, other than brief analysis to help
determine numbers of indlviduale, ethnicity, age and sa:.
Nith the approval of this mitigation plan, the next step will be
to submit butler zones for the sites to ba protected in the
Interim Site Preservation Component. Mc. Leonard and Mr. Carlson
indicated that they thought a 9o foot buffer zone had been fixed
for the anchialine pond site that ie being preserved; however, our

review of the LUC documents shows that a minimum ~0 foot buffer
zone was •at around the edge of the anchialine pond for biotic
pond management plane, but no buffer zone has yet to be
established or reviewed for the anchlaline pond under the his[oric
preservation mitigation plan. Thus, we recommend that your Eicm
recommend buffer zones for each site [o your client and then have
your client submit the buffer zones for our review. Ne believe
[hat a lleldcheck of the buffer zones will ba useful at that
time. we will await this buffer zone submittal. .

Comprehensive Public Access Plan (July 2000) and hereby approve said plan.
