(11 (Draft 2) RESOLliTION ACCEPTING THE DEDICATION OF THE IMPROVEMENTS AND THAT CERTAIN ROADWAY PARCEL BEING A PORTION OF HIENALOLI-KAHULUI ROAD, SITLATE INN KONA, ISLAND AND COLnITY OF HA~'~'AI`I, STATE OF HAVb'AI`I, FROM MARYL GROUP, INC , BEING A PORTION OF TAX MAP KEY (3)7-5-011 002, TO THE COUNTY OF HAWAII WHEREAS, Maryl Group, Inc , a Hawai i corporation, ~s the owner of that certain roadway parcel being a pomon of Htenalolo-Kahulw Road, located m N Kona, Hawat`t, specifically identified as a portion of Tar Map Key (3)7-5-O1 1 002, being more particularly descnbed in the attached dedication deed (Exhibit "A") and delineated on Exhibn "B" attached hereto, and V1•'I-IEREAS, Maryl Group, Inc has constructed roadway and drainage improvements and has received final subdivision approval, and WHEREAS, MaryI Group, Inc is desirous of dedicating the subject parcel, including all subdivision improvements thereon, to the County of Haw•ai`i for road and drainage purposes, and the improvements have been inspected and approved by the County of Hawaii Department of Public Works, Department of Water Supply and the Planning Department, and W7IEREAS, the subject road and drainage improvements have been completed according to County of Hawaii standards, are m acceptable condition for dedication, and WHEREAS, the roadway lot was platted pnor to December 2, 1966, and is a portion of the Hienaloli-Kahului Road, which is open to and used by the public on a continuous basis, and WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides that the Council may accept gifts which include the dedtcatton of land on behalf of the County of Hawaii, NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it finds the subject road and drainage improvements thereon aze in acceptable condition for dedication and approved by all applicable agencies. NOW, THEREFORE, BE IT FURTHER RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in accordance with Article XIII, Section 13-12 of the Hawaii County Charter, that the County of Hawaii accepts the real property in the attached dedication deed (Exhibit "A") and more specifically identified as a portion of Tax Map Key (3)7-5-011:002, including all improvements thereon or attached thereto, for public road and drainage purposes.
