Services are provided through two Winnebago vans that are equipped with dentaloperatories and medical equipment. The vans park at nine different partner sites on the island on scheduled days to provide the above -listed services. -1- Cornm. Na,2L. z 6 I. QUALIFYING STANDARDS FOR APPLICANTS An applicant must meet all of the following standards ® Be chartered or otherwise authorized to do business in the State for chantable purposes and exempted from the federal income tax by the Internal Revenue Service L^? Have a governing board whose members serve without compensation and have no conflict of interest between their regular occupations and the services provided rVV Have bylaws or policies which describe the manner in which business is conducted, including management, audit, fiscal policies and procedures, policies on nepotism, and policies on management of potential conflict of interest Lam` Have at least one year's experience with the service or activity for which the appropriation is sought or can otherwise demonstrate to the satisfaction of the County sufficient expertise to successfully carry out the service or activity ® Be licensed and accredited in accordance with applicable requirements of Federal, State and County laws. II. GRANT COMMONS The applicant agrees to comply with the following terms and conditions prior to receiving a grant award A Comply with applicable Federal and State laws prohibiting discrimination against any person on the basis of race, color, national ongm, religion, creed, sex, age, or handicap. B Agree not to use any public funds for purposes of entertainment or perquisites. C Comply with such other requirements as the Director of Finance may prescribe to ensure adherence by the nonprofit organization with Federal, State, and County laws, and estabbshed standards for fiscal and program management D Allow the Director of Finance, the committees of the council and their staffs, and the Legislative Auditor access to records, reports, files, and other related documents in order that the program, management, and fiscal practices of the nonprofit organization may be monitored and evaluated to assure the proper and effective expenditure of public funds. III. RECORDS AND REPORTS A The applicant shall follow generally accepted accounting procedures; and practices and shall mamtarn books, records, documents and other evidence which sufficiently and properly account for the expenditure of County funds The books, records and documents shall be subleot at all reasonable times to inspection, reviews, or audits by the County expending agency, the Dtiector of Finance, and the Legislative Auditor, or by their representatives B The County expending agency, Director of Finance, or County Council may request periodic written reports on the use of County hinds C The nonprofit organization shall submit a final written report to the Legislative Auditor within sixty (60) days after lune 30 of the fiscal year The report shall include an explanation of the public benefits derived from the awarding of the grant, a Bating of other funding sources and amounts obtained during the grant penod, and a complete accounting of all expenditures supported by County of Hawaii grant funds (per Chapter 2, Article 25, Section 2-142(d), Hawaii County Code, amended August, 1999) Q'AM IV. QUARTERLY ALLOCATION Under no circumstances shall grant funds be disbursed in a lump sum payment Grant funds will be disbursed to Grantees only through a quarterly allocation process The disbursement of grant funds can be formulated on an equal quarterly apportionment basis V. GRIEVANCE PROCEDURE The applicant will adopt and mamtam a grievance procedure to assure proper accounting for any concem and complaints about its program or services that may anse from its members, employees, clients or from other members of the public VL DISCLOSURE OF INFORMATION All information, data or other material provided to the County by virtue of this application shall be subject to the Uniform Information Practices Act (UIPA), Chapter 92F, Hawsu Revised Statutes. All such material is deemed government record and shall be open to the public and may be provided to other public and/or private funding sources VII. CONTINUED ELIGIBILITY ORO Any applicant or recipient who withholds or omits any material facts or deliberately misrepresents such facts to the County of Hawaii shall: (1) Immediately be disqualified from cooadmanon for Nonprofit Grant funding; OR (2) be in violation of the terms of the Giant Agreement of County hinds in which can a grant agreement can be terminated by the County and the recipient or provider may be liable to reimburse all or a portion of any funds received therem. Overview 1) Describe the program for which funding is being requested. Funds are being requested for continuing support of the MObilevCare Health Project (hereinafter "MCHP") The MCHP is a joint partnership between the Office for Social Ministry (hereinafter "OSM"), St Francis Health Care System and the community of the Big Island The project provides primary medical and dental care in the rural areas of Hawaii Island and in the town centers of Hilo and Kona. Services are delivered to the low -Income, uninsured and underinsured people around the Island through two (2) Winnebago vans that contain dental operatories and medical offices. Currently, the MCHP has established outreach sites at the following locations • West Hawaii* Ocean View, Honaunau, Kailua-Kona, Kapaau, Kawaihae, and Waimea. • East Hawaii: Hilo, Pahoa and Pahala Services will begin to be provided in the Hamakua region beginning in the 2nd quarter of FY2001-2002 The MCHP has been operating for four years and has served over 4,500 patents since it began providing services in January of 1997 The project partners with many different agencies to achieve the goals and objectives of meeting the needs of the Big Island rural poor. 2) What unique or significant service will be provided? Dental, medical and social services are provided at nine clinic sites on the Big Island from mobile dental and medical offices. Staff from St Francis (dentists) provides urgent and preventive dental care and medical staff from the two Community Health Centers provides primary care. Health assessments are provided for all people who visit one of the MCHP clinics, whether or not they are seen for other medical or dental services The MCHP also sponsors or provides health screening/assessment services through community health fairs held around the island throughout each year. Services of the MCHP are unique in that it is the only option, a safety net, for dental and health care for many of the island's low-income, uninsured/undennsured people and because of its mobility and ability to travel to rural areas, its utilization of existing services and its partnership with the community 3) What specific outcomes are to be achieved? 1) At least 3,000 people who cannot access care elsewhere due to low-income, lack of insurance, or geographic isolation or transportation barriers will be seen for medical and dental care at the MCHP sites 4) How will the proposed program empower participants to become self-sufficient and facilitate positive social change? The MCHP understands that when the patients we serve through the project are able to access care and understand their dental and medical conditions, they will be empowered to make the 5 FY2001-2002 County of Hawaii Non -Profit Grant Application, MobdevCare Health Project necessary changes to help themselves whether through better self advocacy or through prevention techniques Lack of appropriate dental or medical care can further exacerbate problems faced by those suffering from pain or illness caused by lack of preventive care or regular health assessments For example, those who are ill and unaware of what may be causing their illness or those suffering from toothaches may miss work and will thus lose necessary income for their households Treatment and preventive care helps to contribute to overall health, which affects a person's overall living situation B. Problem/Need 1) What is the problem/need the proposed program is designed to meet? The MCHP addresses the need for dental, medical, and social services care In the rural areas of the Big Island for the homeless and uninsured/underinsured populations Many people cannot access this care elsewhere due to lack of Insurance, geographic Isolation, and lack of transportation 2) Who Is the target population and what are the specific needs? The target populations are the homeless people and the uninsured and undennsured low - Income people of the Big Island. These are people who do not have access to medical, dental or social service care due to economic Issues, transportation, mental or physical disabilities, or other hardships Homeless people who do not access timely health care often let minor health problems tum into major emergencies The specific needs are many and range from medical and dental emergencies to regular preventive care and education Perhaps the most important need the MCHP serves is the access to care Issue We are not talking about geographic issues as much as acceptance issues. In fact, people from East Hawaii will hitchhike the 200 miles round trip to our Ka'u and Waimea clinic sites because they are In need of Immediate dental services and because they are unable to access care from providers In their areas The following scenarios Illustrate some of the stark realities of this population who experience such barriers to care One of our first patients was a young man who pulled his own tooth because he was in so much pain and could not access care He was employed part-time, did not have enough money to go to a dentist, could not find a dentist who would see him without paying over $100 to have his tooth pulled, and was treated very badly by everyone he called. He came to our project because he had not been able to extract the entire root of the tooth when he pulled It out and it had become infected and a life-threatening situation A 19 -year-old man came to the MCHP for a dental problem The initial screening includes a visit to the program's Physician Assistant. The PA discovered that the young man was experiencing symptoms related to the early signs of glaucoma, an eye disease that is treatable If found in the early stages, but will cause blindness if left untreated. This young man was seen for his dental problem, referred to an eye specialist for tare, assisted with health Insurance applications and eligibility and linked to a provider for treatment. His eyesight will be saved Asking the people who need services exactly what they need is the most effective needs assessment study that can be performed. Market Trends Pacific, Inc. conducted a needs assessment in 1999 on the Big Island for a homeless study commissioned by the State of Hawaii and reported the following Items as being the top three unmet needs faced by this population FY2001-2002 County of Hawall Non -Profit Grant Application, MobiletCare Health Project 1) Housing placement 2) Transportation 3) Dental care Survey participants listed medical care as the number one need with 92% of those surveyed 3) What Is the geographical area to be served and hours of operation? The MCHP's two vans serve the entire Island of Hawaii by traveling to and providing services at the following sites West Hawaii Ocean View: Ocean View Community Center, 8-3, as scheduling permits. Honaunau: St. Benedict's Catholic Church, 8-3, every other Friday. Kallua-Kona: St. Michael's Catholic Church, 8-3, most Mondays. Kapaau: St Augustine Episcopal Church, 8-3, most Mondays. Kawalhae: Kawalhae Transitional Shelter, 8-3 every other Thursday Waimea: Annunciation Catholic Church, 8-3, most every other Thursday. East Hawaii Hilo: Malia Puke O Kalani Catholic Church, 8-3, two times a month. Pahoa: Sacred Heart Catholic Church, 8-3, two — three times a month. Pahala: Holy Rosary Catholic Church, 8-3, as scheduling permits. Plans are under way to add clinics to the Hamakua region in the second quarter of FY2001-2002. C. Collaboration/Coordination 1) What specific measures will be taken to collaboratelcoordinate with other community resources to achieve maximum program efficiency and cost effectiveness? The MCHP is a grassroots, community organization that partners with many different entities in order to accomplish its goals - Partnership with St Francis Healthcare System to assist with dental clinic set-up, supervision, operating protocols and procedures St Francis donates approximately $100,000 of goods such as medications, dental supplies, malpractice insurance coverage, payroll services, billing assistance, and staff time of vice president and planners • The Big Island's community health centers (Hamakua Health Center and Bay Clinic, which has three different clinic sites- Pahoa, Hilo and Ka'u) have assigned a mid-level practitioner to the MCHP in Ka'u, Waimea and Kona to provide primary care medical services. In February 1997 the Rural Health Outreach Network was formed, made up of the Hamakua Health Center, GTE Hawaiian Telephone, St. Francis Healthcare System, Office for Social Ministry Care -A -Van Project, Hamakua Health Center, Ka'u Family Health Center, and the MCHP The network received a federal telemedicine grant for a demonstration project utilizing the MCHP outreach sites to bring technology opportunities to the poor and the very rural communities The grant is in its third year of operation VA FY2001-2002 Countv of Hawaii Non -Profit Grant Application, MobiletCare Health Project • The MCHP is a member of the State Dental Task Force This group is comprised of State agencies, insurance companies, and health care providers and seeks to better the dental health of state residents by identifying needs and setting strategies that address the need for care and the need for more participating QUEST and Medicaid dentists, among other issues The task force will also be forwarding a legislative agenda this year that supports the initiative for license waivers for mainland dentists • The MCHP joined Denticare and AlohaCare, HMSA insurance plans as a provider for QUEST patients, which allow people on QUEST better access to providers. Currently, there are no QUEST providers in the Ka'u district or in Waimea area for dental services Our pro/ect is the only provider in these two areas. • Catholic parishes at which the vans park donate electricity and the use of land -line phones All these partnerships work to eliminate duplication of services to this population by providing accessible services at one site location in the different rural areas The medical and dental services provided are lust not available to people so there is no problem in duplication services in these areas D. Goals and Oblectives 1) What are the specific goals/benchmarks of the proposed program? 2) What specific objectives/actions steps are planned for each goal? 3) What is the timeline for each action step? GOAL #1 1) Goal- To provide direct dental and medical care and health education to 3,000 people unable to previously access care due to financial hardship, geographic/transportation barriers, or other barriers 2) Action Steps A. Recruit, through dental associations, local dentists for ongoing volunteer & stipend service B Prepare staff and volunteers to deliver health education in a culturally sensitive and appropriate manner. 3) Time fine. Include how many participants/clients will: a) Attain at least one personal program outcome; or b) Show measurable progress towards program goals. At least 3,000 people who cannot access care elsewhere due to low-income, lack of insurance, or geographic isolation or transportation barriers will be seen for medical and dental care at the MCHP sites E. Service Delivery 1) What methodology will be used in the proposed delivery of services? The methodology to be used to deliver these services is through the use of mobile, dental and medical vans that parks at community sites around the Big Island. Each of the two Winnebago vans holds a self-contained dental and medical office The units can operate on a generator's power or plug into electricity at different sites. The van does plug into the electricity at a number of the facilities that donate the electricity as their contribution to the project. Staff providing services includes 1 full-time coordinator; 2 part-time drivers; 3 part-time dental assistants, 1 full-time Physician's Assistant, and volunteers who provide language translation, dental education and perform intakes Stipend dentists and volunteer dentists provide dental pre All patient records are recorded and managed in a secure, electronic web -based system enabling providers to access a patient's medical/dental history in a convenient manner, no matter where a particular clinic day may be taking place The telemedicine project allows for unique delivery of services. Just recently, the MCHP dental director consulted with the MCHP Clinic Coordinator via a web -enabled camera in order to discuss the case of a particular Big Island patient who was experiencing complications. After the patient's symptoms were described, the dental director called in a prescription to a local pharmacy for the patient. F. Evaluation 1) What processes will be used to evaluate the program and services? The MCHP utilizes a number of evaluation tools to measure outcomes and manage the project efficiently A Patients fill out evaluation forms after services have been performed; this feedback is used in daily evaluation. B. Intakes are performed for each patent seen C Weekly meetings with line staff and regular volunteer staff to cover project management issues D Monthly clinical meetings to cover technical issues. E Quarterly staff meetings that offer a forum for communication, problem solving and feedback F Annual staff evaluation/planning meeting review results patient surveys and outcome data 2) How will this process measure the outcomes specified In Item D, (1-4)? (Note: Letters in this section correspond to the letters in the previous section). A Direct patient evaluations allow project supervisors to get immediate feedback about the level of care provided by project staff U FY2001-2002 County of Hawaii Non -Profit Grant Application, MobileVCare Health Project B Intakes are entered into a computer on site at each clinic Reports generated from the intake database give an accurate account of how many people have been served the MCHP, what types of services were provided and where services were provided C,D,E Regular meetings allow for project staff to address any issues, technical or otherwise F Annual evaluation and planning allows for program to set direction for coming year G. Program Fees 1) Does your organization charge a membership fee for participants? No membership fees are charged 2) Does your organization charge a fee for service(s) provided by your organization? Currently, no fees are charged for emergency services. Fees are established on a sliding fee scale for clients who need non -urgent care. For instance, if a client needs a filling, based on their income, they might pay $2 00 for the filling. It has been the experience of the project that most people can pay a nominal fee and are happy to do so. No one is turned away; if they are unable to pay, patients are given a bill and the option to mail in the payment at a later date. All patients who are uninsured interview with a QUEST eligibility worker to determine if they are eligible for insurance coverage H. Vlability 1) What is your Justfficatlon or rationale for the expenditure of public funds for the proposed program? The County of Hawaii General Plan states, "the County of Hawaii is responsible for the general welfare of its residents and must continue to make every effort to ensure that adequate health services are provided" (General Plan, County of Hawaii, page 57). Health care is a basic need. To maintain a healthy community, access to appropriate health care is necessary and vital. Access to dental care for people on Medicaid is unavailable in our County except through the MCHP Access to care for people on QUEST is dilficult due to practitioners putting the QUEST population on long waiting lists for appointments or refusing to see them Over the last 11 years, as different community planning processes have taken place, the need for dental and medical care for the homeless and uninsured has been identified as a priority at State, County and community levels There is a huge lack of access in the area of dental services The MCHP has been the first response to this identified need and has a strong grass roots development Listed below is a summary of the issues that the MCHP addresses 1) At 33%, Hawaii County has the highest percentage of dental uninsured residents in the State (Dental Health 2000 Report) 2) April 2000 Big Island Strategic Plan on Homelessness identified the need in the Health and Social Services committee to have medical clinics or services that have a specific mission to serve the homeless 10 FY2001-2002 County of Hawaii Non -Profit Grant Application, MobilevCare Health Project 3) The Hawaii State Primary Care Association Identified the need for dental and medical care for rural areas as a priority for the State Primary Care Association to address 4) People on Medicaid (Medicaid is for the aged, blind and disabled) have only one dentist in the County of Hawaii that will provide service for them Our project staff has called most of the dentists on the Big Island trying to find out which dentists will take Medicaid We have found one in the Honoka'a area 5) Some of the people that come to the clinic for care have not been to a dentist In over 10 years, and the majority of people who are seen at the project have not seen a dentist in 2-3 years 6) Over 20,000 Big Island residents are assigned to the QUEST (State Health Insurance Program, 1998) program; however, there Is less than 5 dentists who accept QUEST patients care on the island In 1996, our office applied for a federal designation of Health Professional Shortage Area (HPSA) for dental services based on some of these facts of access. We were awarded this HPSA designation for the entire island (HPSA designations can be verified at the State of Hawaii Primary Care Office in Honolulu). 7) Adults enrolled in QUEST and Medicaid receive only emergency coverage; only children in these programs receive full coverage 8) No oral surgeons on the island take Medicaid patients. 9) Medicare and VA do not have dental benefits. 2) What are your financial and programmatic plans to sustain the proposed program beyond the upcoming fiscal year? The Project receives some third party reimbursements from DentiCare, AlohaCare, MEDICAID and HMSA. St. Francis Healthcare System has provided a full-time dentist position to the project This program continues to be a grant -driven program however and donations from private trusts and foundations are always sought The MCHP recently received $10,000 from both the Atherton Foundation and the Cooke Foundation for FY2000-2001. Also, the OSM embarked on a development program in 1999. The roles and responsibilities of the Diocese of Honolulu Board of Directors entail governing the Diocese of Honolulu and the programs of the Roman Catholic Church in the State of Hawaii. Operations have remained the same We are looking to hire a full-time dentist for this next fiscal year in order to offer clinics 4 days a week in both East and West Hawaii (a total of eight clinics a week), one side of the island will be staffed by volunteer and stipend dentists while the full-time dentist provides services on the other side This will allow us to increase our operations 60% to meet the projection of serving 3.000 people We are planning to apply for funding through Alu Like for a Dental Assistant Training Program that will allow the MCHP to serve as a training site for four individuals interested in the dental assisting profession. Monitoring 1) During the past two years, what financial and or administrative monitoring has your organization received from any and all funding sources? The OSM under the Diocese of Honolulu undergoes an all agency financial audit every year by Choo, Osada and Lee, CPAs, Inc., (Choo, Osada & Lee, CPAs, Inc, 3536 Harding Avenue, Suite 605, Honolulu, HI 96816; 808-734-1921, contact, Jeff Lee) The MCHP undergoes periodic monitoring from St Francis Healthcare System for compliance with clinical issues, (St. Francis Healthcare System, P O Box 29380, Honolulu, HI 96820; 808-547- 6020; contact, Vince Lee, Vice President) The MCHP also undergoes monitoring from agencies that provide third -party reimbursements, HMSA, DentiCare, AlohaCare and Medicaid. In order to be eligible to receive third -party reimbursements, MCHP and other like agencies must receive a rating of 85% or better in such monitoring visits The MCHP was recently monitored by HMSA and received ratings of 95% in the Record Review section and 100% in the Office Evaluation section, (HMSA; 818 Keeaumoku Street, Honolulu, HI 96808, 808-948-5110, contact, Lynn Sawa!) Alcohol, Tobacco and Drua-Free Workplace Policies and Information: 1) How does your organization address alcohol, tobacco, and other drug prevention Information dissemination as part of your workplace and or program environment? All programs of the OSM disseminate rules of conduct to all lay employees as issued by the Diocese of Honolulu and sign off on policies, on the date of hire, that they agree to said policies that prohibit the use or possession of drugs and alcohol on the premises of or within Diocesan offices/vehicles All OSM programs also disseminate OSM rules of conduct which employees sign, on the date of hire, that they agree to contribute to a smoke-free environment by smoking in designated smoking areas outside of all OSM offices and by not smoking in OSM vehicles. The Diocesan Administrative Offices conduct programs which include ministering the faith, care and training of priests, religious education, public information, social services and a cooperative investment and lending program for the benefit of the parishes of the Diocese. The accompanying financial statements include the assets, liabilities, net assets and financial activity under the direct control of the Diocesan Administrative Offices; those of the individual parishes, schools, and other organizations which are not fiscally responsible to the Diocesan Administrative Offices have been excluded. During the years ended June 30, 1999 and 1998, the Diocesan Administrative Offices waived interest due on loans to certain parishes of approximately $226,000 and $221,000, respectively; this amount has been reflected in the financial statements as interest income and program services expense. The Diocesan Administrative Offices have made certain real properties available for the use of an affiliated nonprofit corporation without charge. The fair value of the use of these properties, estimated at $239,172 for the years ended June 30, 1999 and 1998, has been reflected in the financial statements as rental income and program services expense. An affiliated nonprofit corporation has made certain equipment available for the use of the Diocesan Administrative Offices without charge. The fair value of the use of this equipment, estimated at $33,000 for the years ended June 30, 1999 and 1998, has been reflected in the financial statements as support and as program services expenses. The Diocesan Administrative Offices are the guarantor of a $600,000 line of credit extended by a bank to an affiliated school of the Diocese. The latest ruling reaffirms the exemption from federal income tax under section 501(c)(3) of the Code of "the agencies and Instrumentalities and educational, charitable, and religious Institutions operated, supervised or controlled by or In connection with the Roman Catholic Church in the United States, Its territories or possessions appearing in the Official Catholic Directory for 2000" (with the exception of organizations noted with an asterisk and foreign organizations). 2. Federal Excise T xac, Inclusion in the Group Ruling has no effect on an organization's liability for federal excise taxes. Exemption from these taxes is very limited. Please refer to your attorney any questions you may have about excise taxes. 3, State/Local Taxes, Inclusion in the Group Ruling does not automatically establish an organization's exemption from state or local income, sales or property taxes. Typically, separate exemptions must be obtained from the appropriate state or local tax authorities in order to qualify for any applicable exemptions. Please refer to your attorney any questions you may have about state or local tax exemptions. 4. Deductibility of Contributions The Group Ruling assures donors that contributions to the Institutions listed in the 2000 OCD and covered by the Group Ruling are deductible for federal Income, gift, and estate tax purposes. (SPA OGC Memo dated December 21, 1993 concerning substantiation and disclosure requirements applicable to contributions over $250 and quid pro quo contributions over $75.) 5. Unemployment Ta x, The Group Ruling establishes exemption from federal unemployment tax only. Individual states may impose unemployment tax on organizations included in the Group Ruling, even though they are exempt from the federal tax. Please refer to your attorney any questions you may have about state unemployment tax. 6. social Security Tax. All section 501(c)(3) organizations, including churches, are required to pay taxes under the Federal Insurance Contributions Act (FICA) for each employee who is paid $100 or more in a calendar year.' Services performed by diocesan priests in the Section 3121(w) of the Code permits certain church -related organizations to make an irrevocable election to avoid payment of FICA taxes, but only if such organizations are opposed for rphpip in reasone to payment of social security taxes -2- an exercise of their ministry are not considered "employment" for FICA (Social Security) purposes," and FICA should not be withheld from their salaries For Social Security purposes, diocesan priests are subject to self-employment tax ("SECA") on their salaries as well as on the value of meals and housing or housing allowances provided to them y The Ticket to Work and Work Incentives Improvement Act of 1999 established a two-year window of opportunity for priests who previously elected not to participate in Social Security to re-enter the program. Priests wishing to re join Social Security must file Form 2031 with IRS no later than the due date for their federal Income tax retums for the second taxable year beginning after December 31,1999 [generally April 15, 2002)5( Neither FICA nor income tax withholding is required on remuneration paid to religious institutes for members who are subject to vows of poverty and obedience and are employed by organizations included in the Official Catholic Directory.d 7 Form 990. All organizations included in the OCD must file Form 990, Return of Organization Exempt from Income Tax, unless they are eligible for a mandatory or discretionary exception. There is no automatic exemption from the Form 990 riling requirement simply because an organization Is listed in the OCD. Organizations required to file Form 990 must do so by the 15th day of the fifth month after the close of their fiscal yearY Among the organizations nol required to file Form 990 under section 6033 of the Code are: churches; integrated auxiliaries of churches°; the exclusively religious activities of religious orders; schools below college level affiliated with a church or operated by a religious order, organizations with ' I.R. ' The penalty for failure to file the Form 990 is $20 for each day the failure continues, up to a maximum of $10,000 or 5 percent of the organizations gross receipts, whichever is less. However, organizations with annual gross receipts in excess of $1 muton are subject to penalties of $100 per day, up to a maximum of $50,000. LR. C. § 6652(c)(1)(A). ° I R.C. § 6033(4)(2)(A)(i); Treas. Reg § 1.6033-2(h). Effective December 20, 1995, the internal support test formerly contained in Rev. Proc. 86-23, 1986-1 C B. 564, is the sole test for determining whether an organization qualifies as an integrated auxiliary of a church. To qualify, an organization must be descnbed in section 501(c)(3), qualify as other than a private foundation, be affiliated with a church, and qualify as internally supported. An organization will be considered internally supported unlass it both - (1) Offers admissions, goods, services, or facilities for sale, other than on an incidental basis, to the general public (except goods, services, of facilities sold at a nominal charge or substantially below cost), and (2) normally receives more than 50 percent of its support from a combination of governmental sources; public solicitation of contributions (such as through a community fund drive); and receipts from the sale of admissions, goods, performance of services, or furnishing of facilities in activities that are not unrelated trades or businesses -3- 61 gross receipts normally not in excess of $25,000' and certain church -affiliated organizations that finance, fund or manage church assets, or maintain church retirement insurance programs, and organizations controlled by religious orders that finance, fund or manage assets used for exclusively religious activities 1D' Organizations that are required to file Form 990 must upon request make a copy of the form and its schedules and attachments (other than contributor lists) available for public inspection during regular business hours at the organization's principal office and at any regional or distnct offices having three or more employees. Form 990 for a particular year must be made available for a three year period beginning with the due date of the return1'r In addition, effective June 8, 1999, organizations that file Form 990 must comply with written or in-person requests for copies of the Form 990. The organization may impose no charge other than a reasonable fee to cover copying and mailing costs If requested, copies of the Form 990 for the past three years must be provided. In-person requests must be satisfied on the same day Written requests must be satisfied within 30 daysl'' 8. Revenue Procedure 75-50. Rev. Proc. 75-501Ysets forth notice, publication, and recordkeeping requirements regarding racially nondiscriminatory policies that must be complied with by private schools, including church -related schools, as a condition of establishing and maintaining exempt status under section 501(c)(3) of the Code Under Rev. Proc. 75-50 private schools are required to file an annual certification of racial nondiscrimination with the IRS. For private schools not required to file Form 990, the annual certification must be filed on Form 5578, Annual Certification of Racial Nondiscrimination for a Private School Exempt from Federal Income Tax. This form may be obtained from your local IRS office. Form 5578 must be filed by the 15th day of the fifth month following the close of the fiscal year. Form 5578 may be filed individually or by the diocese on behalf of all its diocesan schools. The requirements of Rev. Proc. 75-50 remain in effect and must be complied with by all schools listed in the OCD. Diocesan or school officials should Insure that the ' Rev Proc. 83-23,1983-1 C.B. 687. io Rev. Generally, a copy of an organization's exemption application and supporting documents must also be provided on the same basis. However, since Catholic organizations covered under the Group Ruling did not file exemption applications with IRS, nor did USCC, organizations covered under the Group Ruling should respond to requests for public inspection and written or in-person requests for copies by providing a copy of the page of the current OCD on which they are listed. If a covered organization does not have a copy of the current OCD, it has two weeks within which to make it available for inspection and to comply with in-person requests for copies. Proc. 75-50 are met since failure to do so could jeopardize the exempt status of the school and, in the case of a school operated by a church, the exempt status of the church itself. 9 Lobbying A _tr ivitLes Organizations included in the OCD may lobby for changes in the law, provided such lobbying is not more than an insubstantial part of their total activities Attempts to influence legislation both directly and through grassroots lobbying are subject to this restriction The term "lobbying" includes activities in support of or in opposition to referenda, constitutional amendments, and similar ballot initiatives. There is no distinction between lobbying activity that is related to an organization's exempt purposes and lobbying that is not. There is no fixed percentage that constitutes a safe harbor for "insubstantial" lobbying. Please refer to your attorney any questions you may have about permissible lobbying activities. 10. Political Activities. Organizations included in the Group Ruling may not participate or intervene in any political campaign on behalf of or In opposition to any candidate for public office. Violation of the prohibition against political activity can jeopardize the organization's tax-exempt status. In addition to revoking exempt status, IRS may also impose excise taxes on an exempt organization and its managers on account of political expenditures. Where there has been a Flagrant violation, IRS has authority to seek an injunction against the exempt organization and immediate assessment of taxes due. The latest Group Ruling affirms that organizations included in the OCD are not private foundations under section 509(a) of the Code. However, the Group Ruling does not identify the subsection of section 509(a) under which a particular organization is covered. Organizations must determine for themselves whether they qualify for such status under the provisions of section 509(a)(1), (a)(2) or (a)(3). Newly -created or newly - affiliated organizations must establish that they are not private foundations as a condition of inclusion in the Group Ruling and OCD. 12. Group. Exemption Number. The group exemption number assigned to USCC is 928 or 0928. This number must be included on each Form 990, Form 990-T, and Form 5578 required to be filed by any organization exempt under the Group Ruling." We recommend against using the group exemption number on Form SS -4, Request for Employer Identification Number, because in the past this has resulted in IRS including USCG as part of the organization's name when it enters the organization in its database.
