I am compelled to speak bo the council today to demand that you ro give a resoundling NO voce, or oo'defer, Resolution 46-01, federal funding for the okl, failed, delusional, counter-productive marijuana eradication program. I have a beef with the police department for even asking for this money, I have ~n appdntment with the Chief soon on the matter. But it is you, the dvilians who are supposed to oversee the program, who I kx>k at and speak to today. My 3 minute testimony goes to the heart of the matter, and proposes a sdution for everyone. As I watched you swear ro uphold the Constitution against all enemies, foreign AND domestic, I happened to actually read some of that critically important document that I feel applies here today. Arucle 3, Section 3 states very clearly: 'Treason against the United States, shall consist only in levying War against them...'. Are you attempting to levy War against us today with dtls Resolution and request from the Fblice departments' I say that Is exactly what is on the agenda. Blood money for an unjust War against civilians, people of this Island that you have sworn to protect, a violation of the basic te- nent of international law that says civilians can not be the targets' rn any conflict. I asked the attorney general's office what the definition of a 'hate crime' is and this is part of what I heard: any cnminal offense against a person or property based on that person's ethnicity or religon. Many of us on this island, including me, are members of a religion that uses cannabis hemp, 'the tree of life' as our sacrament. Terrorizing us with helicopters and spraying prison on our gardens and our rooftops and our children's rays is a'hate crime' by definition. Please look it up, and 'rf the shoe fits...wear iC, as they say, and prepare for the consequences. Genocide: another very serous charge defined as any crime with the intent to destroy a specific reli~ous group, wbiecting that group tp conditions intended to cause the physical destrudlon of the group, and/or the transfer of children of the group ro other homes and famiBes. The decision was based on the Guam courts interpretation of Guam's Free Exercise Clause, rather than the Free Exercise Clause of the Federal Constitution. In reaching it's decision, the Guam Supreme Court reasoned that the proper test under Guam's Free Exercise protection is the stria scrutiny test that the U.S. Supreme Court used prior to its disastrous 1990 opinion in the Smith peyote case (494 US 872). Under the stria scrutiny test, the Guam court held that the prosecutor had the burden of proving that Guam's ban on all marijuana importation was justified by a rnmpelling governmental interest, and that the importation ban achieved its objective by the least restrictive means possible. The prosecutor, in a foolish strategic decision, presented absolutely no evidence to justify Guam's wholesale ban against importing marijuana. Thus, the Cuam Supreme Court wasted no time concluding that because marijuana was a necessary sacrament of the Rastafarian religion, and because the prosecution failed to justify the burden placed on the practice of the Rastafarian religion by the law against importing marijuana, the importation ban violated Guam's free exercise protection. This opinion (Guam v. Guerrero, September 8, 2000. 2000 Guam 26, CRA 99-025) is a major breakthrough for religious users of controlled substances. The published opinion from Cuam's highest court will be persuasive precedent for defendants outside of Guam, who will be able to cite the case for the proposition that strict scrutiny is, indeed, the proper test to apply when a religious defense is raised m criminal drug charges. Such activity may be analogized to mass conversions at a typical revival or religious crusade. Neither this Court, nor any branch of this Government, will consider the merits or fallacies of a religion. Nor will the Court compare the beliefs, dogmas, and practices of a newly organized religion with those of An older, more established religion. Nor will the Court praise or condemn a religion, however excellent or fanatical or prepost- erous it may seem. Were the Court to do so, it would impinge upon the guarantees of the First Amendment... The study, sponsored by the United States RAND Drug Policy Research Centre, notes that a far greater percentage of Americana aged 12 and older (33 per cent) reported having tried cannabis than their Dutch counterparts (16 per cent This was despite the sale and possession of the drug being permitted Ln the Netherlands. Dutch figures also indicated that decrim>nahsat>on appeared to have some success >,n separating cannabis from the hard-drug market. Similar findings were noted Ln Italy and Spaln. The authors concluded: "Our judgement, based on rev>ew of the research literature, is that at present the primary harms of marihuana use come from crLminahsat>on. This prohibition inflicts harms directly and is costly."
