RE: Salary Adjustments
Pursuant to our conversation on February 24, 1997, and upon completion of
your requested inquiry into the proper avenue for submissions, I am hereby
submitting a proposed adjustment to the salary schedule.
The current schedule was adopted pursuant to Resolution 176-90. In 1991, the
Hawaii County Charter section 13-28 was amended to allow the Salary Commission
to set the salaries of the Mayor and Prosecutor. This change recognized that both
elected positions in the executive branch should be subject to the Salary
Commission's review.
In 1993, the Salary Commission adjusted the salaries of the Council, Mayor
and Prosecutor. In 1994, Communication 5, Bill 1 was submitted to the Council
requesting a change in the salaries paid to Deputy Prosecutors and Deputy
Corporation Counsels. In 1995, the Council adopted Ordinance 95-17 which
referenced the salaries of deputies to the appointing authority in a 50-90% range.
This amendment was passed upon a representation that the current 95-96 budget
would not be affected and subject to funds available in the 96-97 budget year.
It has now been seven years since the passage of Resolution 176-90 and I
request that the attached resolution be adopted.

WHEREAS, Ordinance No 95-17 was duly enacted on January 25, 1995; and
WHEREAS, said Ordinance mandates that the prosecuting attorney shall establish
salary schedules for deputy prosecuting attorneys, Grades LG-1 and LG-2,
within a range between fifty percent (50%) and ninety percent (90°~) of the
salary established for the prosecuting attorney; and
WHEREAS, the annual salary of the prosecuting attorney was duty established in
accordance with law on July 1, 1993 at $74,064.;
NOW THEREFORE BE IT RESOLVED that deputy prosecuting attorneys, Grades LG-
1 and LG-2 shall be paid at rates of compensation as set forth in the following
schedule at the pay grade fixed and established by Section 2-145 Hawaii County
Code, and Ord. No 95-17, effective January 25, 1995. Deputy prosecuting
attorneys shall be placed at their existing pay grade level unless such
placement would result in a decrease of salary. Under the latter condition,
affected deputy prosecuting attorneys shall be placed at the next highest pay
grade level equal to or greater than their existing salaries.
