SUBJECT: ORDINANCE AMENDING CHAPTER 21 OF THE HAWAII COUNTY CODE,
1983, AS AMENDED, RELATING TO SEWERS
Attached is a proposed amendment to Chapter 21, Hawaii County Code to establish a building
sewer connection loan program As a condition of receiving Federal construction grants for
wastewater treatment facilities, the County of Hawaii is required to construct sewer lines and
laterals in Hilo and Kona and to expedite full utilization of the sewer lines and laterals by
requiring existing properties adjacent to the sewer lines and laterals to connect to the sewer
system.
The administration recognizes that installation of sewers to customers currently using other
means of wastewater disposal may pose a significant financial burden for certain customers. We
believe that it would be beneficial for the County to implement a loan program to assist these
customers by allowing them to pay sewer installation costs over time.

The County of Hawaii Wastewater Division (Division) proposes to adopt new fees charged
to customers who connect to the wastewater systems.
The Division has received federal grant funds in previous years to construct wastewater
treatment facilities. A condition of these grants has been that the wastewater collection
systems be expanded to ensure full use of treatment plant capacity. Expanding the
collection systems includes connecting existing unsewered neighborhoods to the Division s
sewer system. These expansions may pose a financial burden for certain residents due to
the cost of constructing the portion of the sewer on private property (called the building
sewer) that must be paid by the resident. The Division is proposing a building sewer loan
program to assist customers required to pay for building sewers.
With the proposed building sewer loan program, the County would use State of Hawaii
State Revolving Fund (SRF) loan proceeds to construct building sewers. SRF loan proceeds
would be obtained and transferred to the County Sewer Fund. A portion of the SRF loan
proceeds would be used to pay the construction costs of building sewers and the remainder
would be used to cover the County's design, inspection, and administration expenses.
The property owner would repay the County at terms identical to the terms of the SRF loan
the County receives from the State of Hawaii. The County would repay the SRF loan using
payments from property owners. The property owner must agree that the County of
Hawaii shall place a lien on the property at the time the loan agreement between the
County and the property owner is executed. Additionally, the property owner must sign a
Grant of Easement that will allow the Division access to the building sewer and a waiver of
liability agreement. The Division would retain ownership of the building sewer.
