The issues you raise, certainly appear to be valid, and I was glad to learn you have discussed them with personnel in the Real Property Tax Division. As for the equity and fairness issues you mentioned, I believe that these must be central and fundamental to our tax code. At the same time, I know that there is always room for improvement. Toward this end, it is my understanding that a subcommittee of the Finance Committee will be formed in the near future to review the county tax code and make recommendations as to how it can be improved. I will bring your letter and specific concerns to the attention of the committee members. In the meantime, I will also provide copies of your letter and my response to all Council Members, so they may consider it during the public 1learings this week. Curtis Tyler, III 25 Aupuni St. Ste. 209 Hilo, Hi. 96720 April 9, 2001 Dear Mr. J. Curtis Tyler, III I'm writing this letter to you because it involves your district. My name is Ronald Dalessio and I reside in Kaumana on Agricultural land at 147 Akala Road. Since 1992, I have been aware of the fact that there is a discreprancy in the property tax rate between what T pay on my property and what my neighbor pays on similar property. I have inquired at the Real Property Tax Office about this numerous times. Their answer: even if the property is for Agricultural use and documented on records as land used for growing ginger, taro, and vegetables, and they are not using it as registered with the County, if they do get turned in, they have one year to go back to farming. I feel that it's not fair for all taxpayers that are paying their fair share. It is very stressful for me when this goes on and on with the County and it still goes on. On March 30, 2001, I spoke with Wesley Takai and again he assured me that if the Agricultural land is not in use as registered with the County, all they need to do is to go back to farming or whatever they want within twelve months and I again told him that it wasn't fair for every taxpayer that pays his required tax rates and shame on him that he doesn't correct the problem as a County employee that knows right from wrong, because he told me that it was wrong. As a Council member in your district, do you think that it is fair that your homeowners pay their share of property taxes and yet the County allows some to get away with owning large pieces of property and not paying their share? I would like to know what could be done regarding this matter because if I were to make 5000 flyers and distribute it in Kona house to house, I'm sure I wouldn't be the only taxpayer that would feel the way that I do. Could I please get a written reply from you on your district in regards to this letter. Sincerely, Ronald Dalessio
