Your Committee on Finance, to which was referred Resolution No. 53-O1, reports as follows:
Resolution No. 53-O1, transmitted by Assistant Corporation Counsel Gerald Takase, via
Communication No. 124, dated February 16, 2001, authorizing and empowering the Finance Director
to acquire tax map keys (3)2-4-025:044 and 2-4-025:046 for future expansion of the Public Safety
Building complex for law enforcement purposes.
The aforementioned properties are owned by Robert Eugene Witthans and is the subject of a
bankruptcy proceeding. The County of Hawaii on behalf of the Hawaii County Police Department
has been working with the bankruptcy trustee and the debtors' attorneys and can acquire the parcels
for $175,000 with proceeds from the asset forfeiture account.
The Department of Justice has approved the use of the asset forfeiture funds for the acquisition of
these parcels, and the County is able to acquire these parcels at below their current assessed values.
The County has been afforded a unique opportunity to purchase these properties, which would be
desirable for the future expansion of the Hawaii County Police Department with the use of asset
forfeiture funds approved by the Department of Justice.
For informational purposes, Mr. Tyler voted kanalua twice.
Your Committee on Finance is in accord with the purpose and intent of Resolution No. 53-O1 and
recommends its adoption.
