Your Committee on Planning, to which was referred Bill No. 32, transmitted by Mayor
Harry Kim per Communication No. 125, dated February 1, 2001, regarding the Change of Zone
request by Joshua K. Leo at Kapoho and Halekamahina, Puna, Hawaii, TMK: 1-4-73: 27,
reports as follows:
Bill No. 32 amends Section 25-8-22 (Puna District Zone Map), Article 8, Chapter 25 (Zoning
Code) of the Hawaii County Code, by changing the district classification for approximately
3.232 acres of land from an Open (O) and Agricultural (A-la) to a Family Agricultural (FA-2a)
zoned district.
The rectangular-shaped subject property, owned in fee by the applicant, is located in the
Vacationland Hawaii Subdivision on the northeast side of Halepueo Road.
The applicant is seeking the change of zone so he can construct a farm dwelling. The current
State Land Use classification is Agricultural, although prior to 1971, it was zoned Conservation.
The State Land Use boundaries were designated in 1964 after the Vacationland Subdivision
(1962 and 1963) was established. At that time, the subject property was split between the SLU
Agricultural and Conservation District as were several other lots along the northern corner of the
Vacationland Hawaii II subdivision. The SLU boundary lines were drawn using the
Halekamahina land division as a dividing line without consideration of the subdivision. Because
of the Conservation designation, when the Zoning Code was implemented in 1967, the parcel
was placed in the Open (O) zoned district for consistency. In 1970, Vacationland Associates
applied for a SLU Boundary Amendment to reclassify land from Conservation to Agricultural to
be consistent with the remainder of the subdivision. A majority of the subdivision was within the
SLU Agricultural district with an A-1 a zoning. On February 26, 1971, the SLU Commission
approved the request, however, the County zoning remained at Open (O). The General Plan
LUPAG Map classification is Orchards.
Approximately .23 acre of the southwestern corner of the subject property is presently zoned
Agricultual A-la. The Open designation does not allow for the development of a residence on
the subject property. This change of zone request would permit the applicant to have one zoning
designation on the property instead of being split, like we had seen earlier in the Hilbert change
of zone request.

The subject property is not situated within the Special Management Area (SMA) and is
approximately one mile from the nearest shoreline.
The Soil Conservation Service Soil Survey Report classifies soils within the project site as
Malama extremely stony muck, which consists of well-drained, thin, extremely stony organic
soils over A'a lava with rapid permeability, very slow runoff and slight erosion hazard. This type
of soil is used for woodland, pasture and orchards. The Land Study Bureau's Detailed Land
Classification is "E" (Very Poor) for agricultural productivity. The ALISH System classifies the
soils as "Other Important Agricultural Lands", which includes lands other than Prime or Unique
agricultural land that is also of statewide or local importance for agricultural uses.
The subject property is located within Zone "X", an area determined to be outside the 500-year
tlood plain.
The U.S. Geological survey has categorized the subject property as being in Zone 1, which has
the highest severity of hazard because it includes the summits and rift zones of Kilauea and
Mauna Loa where vents have been repeatedly active in historic time.
Surrounding properties to the south are zoned Open and Agricultural (A-la). The property to the
southeast was rezoned from Open to Agricultural (A-Sa) in 1991. The property to the east was
rezoned from Open and Agricultural (A-la) to Family Agricultural (FA-2a) in 1999.
Immediately to the south and the southwest are Vacationland Hawaii II lots which are zoned
Agricultural (A-la) and approximately 5 acres in size. Further south lie Vacationland Hawaii I
with lots zoned Single Family-Residential (RS-10) and ranging approximately 8,000-9,000
square feet in size. The Kapoho Beach Lots subdivision to the southeast is zoned Single-Family-
Residential (RS-10). There is a large 140-acre parcel bordering Vacationland Hawaii II to the
north which is zoned Open (O) and within the State Land Use Conservation District.
Access is from Moani Road (also known as Kapoho Beach Road), a County road that is paved
with an approximate pavement width of 26 feet, then turning onto Ililani Road, a 15' red cindered
private road within a 40 feet right of way.
County water lines run along Moani Road and end in the vicinity of the Moani/Ililani Roads
intersection, which is approximately 2,600 feet from the subject property. According to the
Department of Water Supply, water for one dwelling on the subject parcel is available from the
existing 8-inch pipe, but the subject parcel does not have a water service with them.
According to the Department of Health, wastewater will be disposed of through a septic tank
system, which has to be installed.
Bill No. 32, Draft 2, which corrected the acreage of Parcel 2 in the metes and bounds from 2.16
acres to 0.216 acre, amended the word acres to acre on the map, and inserted the standard
language in Condition F, was approved by Your Committee.

Your Committee concurs with the Planning Commission and the Planning Director for
recommending a favorable consideration for the Change of Zone request.
Your Committee on Planning is in accord with the intent and purpose of Bill No. 32, Draft 2, and
recommends it pass first reading.
