COUNTY OF IIAWAI`I STATE OF IIAWAI`I <br /> y.7o' v <br /> IZESOLUTION NO. ~ <br /> <br /> RESOLUTION AUTHORIZING THE CONVEYANCE AND ACCEPTANCE OF GRANTS <br /> OF EASEMENTS LOCATED AT HONUAINO 1ST, NORTH KONA, HAWAII, BEING <br /> PORTIONS OF TAX MAP KEY (3)7-9-009:021 AND 051, BETWEEN KRC BUILDING, INC. <br /> AND THE COUNTY OF HAWAII. <br /> WHEREAS, the County of Hawaii is the owner of the real property and right-of--way <br /> located at Honuaino 1st, North Kona, specifically identified as Tax Map Key <br /> <br /> No. (3)7-9-009:051, being more particularly described in and delineated on the attached <br /> <br /> Encroachment Agreement and License attached hereto; and <br /> WHEREAS, KRC, INC. is the owner of the real property and improvements located <br /> thereon, situate at Honuaino 1st, North Kona, specifically identified as Tax Map Key <br /> <br /> No. (3)7-9-009:021, being more particularly described in the above-described agreement and <br /> license; and <br /> WHEREAS, the County of Hawaii and KRC, INC. wish to resolve the issues arising out <br /> of and related to the encroachments detailed in the above-described agreement and license; and <br /> WHEREAS, Section 2-111 of the Hawaii County Code requires that the Council, by <br /> resolution, authorize the conveyance of the above-described easements, subject, however, to <br /> reversion to the County of Hawaii upon termination or abandonment of the easements for the <br /> specific purpose for which they were granted; and <br /> WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides that the <br /> Council, on behalf of the County, may accept gifts of donations of money, securities, or other <br /> personal property or of real estate or any interest in real estate. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF <br /> HAWAII, in accordance with Section 2-111 of the Hawaii County Code and Article XIII, <br /> Section 13-12 of the Hawaii County Charter, that the County of Hawaii conveys and accepts the <br /> grant of easements located at Honuaino 1st, North Kona, Hawaii, being portions of Tax Map <br /> Key Nos. (3)7-9-009:021 and 051, as detailed in the attached agreement and license, until <br /> termination or abandonment of the easements for the specific purposes for which they were <br /> granted. <br /> <br />
