REPORT OF THE <br /> COMMITTEE ON PUBLIC WORKS & <br /> INTERGOVERNMENTAL RELATIONS <br /> DATE: March 8, 2001 RE: Communication No. 123/Res No. 52-01 <br /> PLACE: Councilroom <br /> TIME: 9:05 a.m. <br /> Chair and Members <br /> Hawaii County Council <br /> Hilo, Hawaii 96720 <br /> Your Committee on Public Works and Intergovernmental Relations, to which was referred Communication No. 123 and <br /> attached Resolution No. 52-01 reports as follows: <br /> Communication No. 123 from Assistant Corporation Counsel Gerald Takase transmits for council consideration <br /> Resolution No. 52-01 accepting the dedication of a roadway parcel that is a portion of Hienaloli-Kahului Road in the <br /> Keaolani Subdivision. The parcel is owned Maryl Group, Inc. and is identified as Tax Map Key (3) 7-5-O11:002. In his <br /> letter, Mr. Takase states that the Departments of Public Works, Water Supply and Planning all recommend the acceptance <br /> of this roadway. Communications from these departments are attached to the resolution. <br /> Resolution No. 52-O1 states that this parcel is in full compliance with all subdivision and road improvement provisions set <br /> out in Chapter 23 of the Hawaii County Code. Exhibit A delineating the parcel and a dedication deed are also attached to <br /> the resolution. <br /> At the meeting, the Committee questioned the relevance of Chapter 23 to the dedication and the justification for accepting <br /> the roadway parcel at its current width of 40-ft wide. Assistant Corporation Counsel Gerald Takase informed the <br /> Committee that both the improvements and dedication of the parcel by Maryl Group, Inc., is voluntary and is not a county <br /> mandate. After discussion, the Committee decided that this parcel is currently used as a public right-of--way and therefore, <br /> should be acquired as such by the county. The Committee directed the Office of the Corporation Counsel to introduce a <br /> second draft of Resolution No. 52-01 that eliminates references to Chapter 23. <br /> For informational purposes Committee Member J.
