Your Committee on Public Works and Intergovernmental Relations, to which was referred Communication No. 123 and
attached Resolution No. 52-01 reports as follows:
Communication No. 123 from Assistant Corporation Counsel Gerald Takase transmits for council consideration
Resolution No. 52-01 accepting the dedication of a roadway parcel that is a portion of Hienaloli-Kahului Road in the
Keaolani Subdivision. The parcel is owned Maryl Group, Inc. and is identified as Tax Map Key (3) 7-5-O11:002. In his
letter, Mr. Takase states that the Departments of Public Works, Water Supply and Planning all recommend the acceptance
of this roadway. Communications from these departments are attached to the resolution.
Resolution No. 52-O1 states that this parcel is in full compliance with all subdivision and road improvement provisions set
out in Chapter 23 of the Hawaii County Code. Exhibit A delineating the parcel and a dedication deed are also attached to
the resolution.
At the meeting, the Committee questioned the relevance of Chapter 23 to the dedication and the justification for accepting
the roadway parcel at its current width of 40-ft wide. Assistant Corporation Counsel Gerald Takase informed the
Committee that both the improvements and dedication of the parcel by Maryl Group, Inc., is voluntary and is not a county
mandate. After discussion, the Committee decided that this parcel is currently used as a public right-of--way and therefore,
should be acquired as such by the county. The Committee directed the Office of the Corporation Counsel to introduce a
second draft of Resolution No. 52-01 that eliminates references to Chapter 23.
For informational purposes Committee Member J. Curtis Tyler voted kanalua times two.
Your Committee is in accordance with the purpose and intent of Resolution No. 52-01, and recommends its adoption.
