TMK: 7-3-10: 37 Kalaoa 4th North Kona Hawaii This letter will formally respond to your request dated June 29, 2000, regarding the proposed dedication of a portion of the project site for use as a community recreation facility and volunteer fire station, in lieu of providing a fair share contribution to mitigate the project's regional impacts to park and recreation and fire resources as required by Condition J of the above-described ordinance. We apologize for the delay in responding to your request. As a matter of background, the subject properly, consisting of 10.283 acres, was rezoned to a Single Family Residential (RS-10) zoned district to accommodate the development of a 34-lot residential subdivision. This rezoning was approved subject to, in part, the following condition: "J. The applicant shall make its fair share contribution to mitigate the potential regional impacts of the subject property with respect to parks and recreation, fire, police, solid waste disposal facilities, and roads. The amount of the fair share contribution shall be the sum which is the product of multiplying the number of residential lots proposed to be subdivided by the amounts allocation herein below for each such lot, and shall become due and payable prior to final subdivision approval for any portion of the subject property or its increments. If the subject property is subdivided into two or more increments, the amount of the fair share contribution due and payable prior to final subdivision approval of each increment shall be a sum calculated in the same manner according to the number of additional proposed residential lots in each such increment. The fair share contribution may be in a form of cash, land, facilities or any combination thereof acceptable to the director in consultation with the affected agencies. The fair share contribution shall have a maximum combined value of $7,239.16 per lot. Based upon the applicant's representation of intent to subdivide and develop up to thirty-four (34) residential lots, the indicated total fair share contribution is $246,131.44, however, the total amount shall be increased or reduced in proportion with the actual number of subdivided lots according to the calculation and payment provisions set forth in this Condition J. Pack June 28, 2001 Page 2 1. $3,490.85 per lot, for an indicated total of $118,688.90 to the county to support park and recreational improvements and facilities; 2. $168.40 per lot, for an indicated total of $5,725.60 to the county to support police facilities; 3. $332.61 per lot, for an indicated total of $11,308.74 to the County to support fire facilities; 4. $145.62 per lot, for an indicated total of $4,951.08 to the County to support solid waste facilities; 5. $3,101.68 per lot, for an indicated total of $105,475.12 to the State or county to support road and traffic improvements. The fair share contributions described above shall be adjusted annually beginning three years after the effective date of the change of zone, based on the percentage change in the Honolulu Consumer Price Index (HCPI). In lieu of paying the fair share contribution, the applicant may construct and contribute improvements/facilities related to parks and recreation, fire, police, solid waste disposal facilities, and roads within the region impacted by the proposed development, subject to the approval of the director. The cost of providing and constructing the segment of roadway which establishes a roadway connection between Holoholo and Nana Streets (exclusive of interior subdivision roads), as set forth in Conditions F (sic), shall be credited against the sum specified in Condition J (5) for road and traffic improvements. For purposes of administering Condition J, the fair market value of land contributed for such roadway segment and the cost of constructing its improvements shall be subject to the review and approval of the director, upon consultation with the appropriate agencies." (emphasis added) Daryn Arai of our West Hawaii Office has been in discussions with you as well as with representatives of the Department of Parks and Recreation and Fire. Both agencies, including this office, are willing to discuss the option of providing recreational and fire improvements in lieu of the fair share contributions in accordance with the requirements of Condition J. At this point, we would like to ask you to initiate and coordinate further discussions with the affected agencies, including this office, to confirm the acceptability of such improvements and facilities within this section of Kalaoa as well as to specifically identify the location of the site proposed for dedication to the County. The applicant shall also work with this office to determine the fair market value of the land to be dedicated as well as to adjust the amount of the fair share contribution in accordance with the percentage change in the Honolulu Consumer Price Index (HCPI) since Apri17, 1997, the effective date of Ordinance No. 97-56. Finally, your letter references similar fair share contributions required by Ordinance No. 99-87 (REZ 920), which rezoned lands just makai of the Mamalahoa Highway and north of Kona Palisades Subdivision. Your letter indicates that the applicant (Peter Dungate), fully supports Mr. Thomas W. Pack June 28, 2001 Page 3 the use of this fair share contribution ($94,109.08 paid on January 31, 2001) to assist with the development of the proposed park and volunteer fire station. We appreciate this comment and will consider the use of these funds for the proposed park and volunteer fire station facilities should the County approve the construction of such facilities at the subject property. It is now agreed that the site will generally be used as a community recreation facility, with the Volunteer Fire Station sharing space. Therefore, we request your determination that the lot dedication may be applied against the fair share contribution. Thank you for your assistance. As discussed in our June 8 meeting with Gary Ashikawa, I have met with Mr. Dungate (Ordinance No. 99-87, TMK: 7-3- 05:89) concerning his required fair share contribution.
