RESOLUTION AUTHORIZING THE LEASING OF COUNTY LANDS FOR PASTORAL USE AS SPECIFIED IN THE HAWAII COUNTY CODE, CHAPTER 2, ARTICLE 19. WHEREAS, Chapter 2, Article 19, Section 2-111, of the Hawaii County Code provides that the County Council may, by resolution approved by a majority of its members, dispose of real property by lease, license or permit; and WHEREAS, in accordance with Chapter 2, Article 19 of the Hawaii County Code, the County Council may authorize the Director of Finance through auction, sealed bids or negotiation to lease County-owned lands; and WHEREAS, the County desires to lease those lands identified in Exhibit A, herein attached; and WHEREAS, the County of Hawaii has received inquiries about the use of these properties on a short-term basis; and WHEREAS, the Administration has no objection to offering short-term leases on the former Hamakua Sugar Company lands, now under County ownership, for the purpose of keeping weeds, grass, and other vegetation under control. This will be done as a short-term measure until a more definitive disposition plan for the Hamakua lands is established; and WHEREAS, the County desires to utilize ashort-term lease of up to one (1) year for pastoral use with amonth-to-month lease option thereafter; and WHEREAS, if the disposition is performed by negotiation, the public interest demands it because of the potential fire hazard to the surrounding community. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it authorizes the leasing of those County lands delineated in Exhibit A for pastoral use by auction, sealed bids or negotiation. BE IT FURTHER RESOLVED that copies of this resolution be transmitted to the Honorable Harry Kim, Mayor of the County of Hawaii and the Director of Finance. Dated this 29th day of August , 2001. This leasing program must ensure that: • Lessees understand our purpose and use the land to accomplish this purpose; • The terms of leases do not exceed one year, although provisions for extensions may be included, with the consent of the Mayor; • Lessees are responsible for all expenses associated with their activities; • Lessees indemnify the County of any liability resulting from their activities on the property; • Lessees are selected through a method that promotes fairness to interested parties and complies with Chapter 2, Article 19 of the Hawaii County Code; and • Its rules and procedures are clearly established and are approved by the Office of the Corporation Counsel and Mayor prior to implementation.
