RESOLUTION AUTHORIZING THE ACCEPTANCE OF ROAD PARCEL A-3, TOGETHER
WITH 10-FOOT WIDE FUTURE ROAD WIDENING EASEMENT, FROM THE TRUSTEES
OF THE ESTATE OF BERNICE PAUAHI BISHOP, SITUATE AT ALAS, DISTRICT OF
SOUTH HILO, COUNTY AND STATE OF HAWAII, BEING PORTION OF TAX MAP KEY
NO. (3)2-6-009:022.
WHEREAS, the Estate of Bernice Pauahi Bishop is the owner of Road Parcel A-3, along
with a 10-foot wide future road widening setback, specifically identified as being a portion of
Tax Map Key (3)2-6-009:022, being more particularly described and delineated in the attached
Quitclaim Deed (Exhibit "A") attached hereto; and
WHEREAS, the County of Hawaii has made roadway improvements to the affected
areas; and
WHEREAS, acquisition of the subject road parcel and adjoining right-of--way is required
to replace the bridge on Kaiwiki Road, which the County of Hawaii has been maintaining for at
least thirty years; and
WHEREAS, the Estate of Bernice Pauahi Bishop has agreed to quitclaim its interest in
the subject road parcel and to grant a 10-foot wide future road widening setback to the County of
Hawaii; and
WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter provides that the
Council, on behalf of the County of Hawaii, may accept gifts or donations of real property.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII, that in accordance with Article XIII, Section 13-12 of the Hawaii County Charter, the
County of Hawaii accepts the donation of Road Parcel A-3, along with the adjoining 10-foot
wide future road widening setback, being a portion of Tax Map Key (3)2-6-009:022, consisting
of 4.029 acres, from the Estate of Bernice Pauahi Bishop.
BE IT FURTHER RESOLVED that a copy of this resolution be sent to: (1) the Trustees
of the Estate of Bernice Pauahi Bishop, c/o Jeffrey Melrose, P. O. Box 495, Paauilo, Hawaii
96776; (2) William Takaba, Director of Finance; (3) the Department of Public Works; and
Gerald Takase, Assistant Corporation Counsel, who will record said Quitclaim Deed.

THAT, ROBERT KALANI UICHI KIHUNE, RONALD DALE LIBKUMAN,
CONSTANCE HEE LAU, DAVID PAUL COON, AND FRANCIS AHLOY KEALA,
Trustees of the Estate of Bernice Pauahi Bishop, whose place of
business and post office address is 567 South King Street, Suite
200, Honolulu, Hawaii 96813, hereinafter referred to as the
"Grantors", for and in consideration of the sum of ONE DOLLAR
($1.00), to them paid by the COUNTY OF HAWAII, a municipal
corporation of the State of Hawaii, whose place of business and
post-office address is 25 Aupuni Street, Hilo, Hawaii, hereinafter
referred to as the "Grantees", receipt whereof is hereby
acknowledged, do hereby remise, release and forever quitclaim unto
said Grantees, all of their right, title, interest, claim and
demand in and to all of the premises described in Exhibit A and
also shown on the sketch attached hereto.
TO HAVE AND TO HOLD the same, together with all rights,
easements, privileges and appurtenances them=.unto belonging, or in
any way appertaining or held and enjoyed therewith unto said
Grantees, as Trustees aforesaid.
TRUSTEES NOT PERSONALLY LIABLE. This instrument has been
approved or executed by the Trustees of the Estate of Bernice
Pauahi Bishop in their fiduciary capacities as said Trustees, and
not in their individual capacities. No personal liability or
obligation under this instrument shall be imposed or assessed
against said Trustees in their individual capacities.
