Change of Zone Ordinance No. 96-150 (REZ 837)

Subject: Extension of Time to Condition No. C (Final Plan Approval)

This is in response to your letter dated July 18, 2001 requesting an extension of time to
Condition C of Change of Ordinance No. 96-150.
Please be informed that a request for an extension of time should also be filed for
Condition C of Change of Zone Ordinance No. 96-148 (TMI~: 2-5-46:1) vahich also
affects your development.
In reference to your letter of request, Condition C of Change of Zone Ordinance No. 96-
150 requires that you secure Final Plan Approval or Final Subdivision Approval for the
subject property within five (5) years from the effective date of this ordinance, but not
until the final determination of the right-of--way for the Puainako Street extension is
determined.
You have explained that you have experienced trying economic times, however, you are
working on the condemnation agreement for the Puainako Extension. Based on the
above, the Planning Director has determined that non-performance is a result of
conditions that could not have been foreseen and is not a result of fault or negligence.

The granting of a time extension would not be contrary to the General Plan or Zoning
Code, or the original reasons for granting the change of zone. Therefore, the Planning
Director grants you a five (5) year extension of time until December 5, 2006 to secure
Final Plan Approval or Final Subdivision Approval.
Please be informed that should you require any further extensions of time, your request
with reasons must be resubmitted to this department with the appropriate $250 filing fee
and 20 copies of your request. A public hearing with the Planning Commission will be
held with a final decision to be made by the County Council.

Request for Extension of Rezoning (CN40)
Reference: County of Hawaii Ordinance No. 96-150
Dear Mr. Yuen,
We request an extension of the rezoning of the Kaumana parcel with TMK (3)2-5-046:007 for an
additional 5 years from December 5, 2001 when the Ordinance No. 96-150 was to expire. We have
experienced trying economic conditions that precluded any prior action. We are cooperating as best as we
can with the County and the State of Hawaii in agreeing to the condemnation agreement for a portion of the
property.
Also we are allowing the State and the Contractor for this Puainako Extension project to use this property
for the basing of their construction operations and further we have brought current the water commitments
on this property by paying the $9,000 required.
