HomeMy WebLinkAboutREP PC 030 08/01/2001 2000-2002 REPORT OF THE COMMITTEE ON PLANNING DATE: August 1, 2001 RE: C-253/Bill No. 73 PLACE: Councilroom TIME: 2:13 p.m. Chair and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Bill No. 73, transmitted jointly with Bill No. 72 by Mayor Harry Kim per Communication No. 253, dated June 6, 2001, regarding the Change of Zone request by the Imamupa Faanity, et al., at Waiakea, South Hilo, Hawaii, TMK: 2-4-30:004, reports as follows: Bill No. 73 amends Section 25-8-33 (City of Hilo Zone Map), Article 8, Chapter 25 (Zoning Code) of the Hawaii County Code, by changing the district classification for approximately 3.000 acres of land from an Agricultural (A-3) to a Residential and Agricultural (RA-.Sa) zoned district. The rectangular shaped subject property, owned in fee by Tsuneko Imamura, Clifford S. Imamura, Esther T. Imamura, Clarence T. Imamura and Susan F. Decleene, is located along Ainalako Road approximately 205 feet south of its intersection with Leimamo Street. The applicants are proposing to create asix-lot family residential subdivision consisting of lots not less than .50 acres each. The existing two dwelling will be incorporated into the subdivision design. Future development will be dependent on when each family member is able to secure the necessary financing. The subject parcel was originally part of a larger 10-acre lot, which was subdivided in 1976. The main dwelling was constructed in 1950. In 1984, an ohana dwelling permit was secured, but voided because the home was not constructed within the required two-year timeframe. In 1987, a new ohana permit was obtained and the second dwelling was constructed in 1988. The farm dwelling agreement for this ohana dwelling was recorded with the Bureau of Conveyances on November 28, 1988. The General Plan designation is Low Density Urban, which allows for single family residential, ancillary community and public uses, and convenience-type commercial uses. The property is not situated within the Special Management Area and is located approximately five miles mauka from the shoreline. The Hilo Community Development Plan designates the parcel for A-3a zoning. Immediately north (makai) of the subject property is the Sportsman's Paradise Subdivision with 103 lots ranging in size from 12,000 to 15,000 square feet. These non-conforming lots are zoned A-1 a and were subject to a boundary amendment from Agricultural to Urban initiated by the State Land Use Commission in 1971. This Urban pocket is surrounded by State Land Use Agricultural lands. To the south are various properties ranging in size from approximately 3 to PC-30 PC-30 Page 2 August 1, 2001 50 acres. Opposite the subject parcel and along Ainalako Road are Agricultural lots (A-la, A-2a, A-3a, and A-20) with scattered dwellings, macadamia nut and citrus orchards, and cattle grazing. Although there are some intermittent residential zoned lands along Ainaola Drive, to the west along Ainalako Road, lots are zoned agricultural and are rural in nature. Soils are classified as Olaa extremely stony, silty clay loam with rapid permeability, slow runoff and slight erosion hazard. The Land Study Bureau Soil Rating is "C" or Fair. The ALISH classification is Other Important Agricultural lands. The subject property is located in Zone X, an area determined to be outside the 500-year flood plain. Because the parcel was previously grazed by cattle and extensively cleared for agricultural use, rare or endangered flora or fauna, as well as historical, cultural or archaeological features are not anticipated to be found. Access to the property is from Ainaola Drive onto Ainalako Road. The subject property is approximately 1,400 feet from the Ainaola Drive/Ainalako Road intersection. Ainalako has an approximate 16-foot wide pavement within a 50-foot right-of--way. The City of Hilo map depicts a road widening to a 60-foot right-of--way. Water is available to the subject property via an existing 8- inch water line fronting the subject property. According to the Department of Health, the property is located in the Critical Wastewater Disposal area, therefore, any development on these lots would require septic tank systems. All other utilities and services are currently available to the subject parcel. Committee Member Julie Jacobson explained that to be consistent with her stand on the preservation of agricultural lands, she would be voting against this measure. Committee Member Curtis Tyler reiterated some of the background information. He also recommended that language restricting the construction of a second dwelling, the fair share assessments, and septic tank installation be included as conditions, and Your Committee unanimously agreed. Committee Member James Arakaki stated that his only concern about this measure is the wastewater problem, but since the Department of Health recommends the installation of the septic tanks, he is in agreement with the applicant's request. PC-30 PC-30 Page 3 August 1, 2001 Bill No. 73, Draft 2, which corrected the Section number from " 25-8-32" to " 25-8-33" was approved by Your Committee. Your Committee concurs with the Planning Commission and the Planning Director for recommending a favorable consideration for the Change of Zone request. Your Committee on Planning is in accord with the intent and purpose of Bill No. 73, Draft 2, as amended to Bill No. 73, Draft 3, and recommends it pass first reading.
