E., Director SUBJECT: USE OF KING KAMEHAMEHA PARK'S ROAD EASEMENT HAWAIIAN PERMACULTURE AND WELLNESS RETREAT CENTER (HPWRC) I have reviewed Communication 307 and related communications, and the Special Management Area Use Permit and make the following comments: 1. According to Kohala Corporations letter (Exhibit C) dated July 31, 1975, and Corporation Counsel's Memorandum dated August 21, 2001, it seems that Hawaiian Permaculture and Wellness Retreat Center has a right to use the road easement for access (assuming that HPWRC are or will be successors or assignees of Kohala Corporation). 2. Despite the present practice of securing the Park, the road easement agreement allows access and the County of Hawaii cannot limit the use of the road easement. If the County of Hawaii does so, then the County of Hawaii must provide another road easement for the successors or assignees of Kohala Corporation (see Exhibit C letter by Kohala Corporation). 3. In regards to HPWRC using the road easement, the Department would require HPWRC to provide information on traffic in order to assess the usefulness of the existing condition of the road. HPWRC may be required to upgrade the existing road based on the traffic information. The traffic information would contain type of vehicles using the road, volume of traffic, and peak hour characteristics. Our assessment would also take into account traffic safety in a park setting. 'The State of Hawaii has conveyed to the County of }iawaii, in fee simple, the area identified as Road Easement 1 which shall be used for roadway purposes. °I'he deed on said conveyance was recorded with the Bureau~of Conveyances on September 30, 19°75, in I.iber 10936, page 566. Sinc® the roadway provides public right of way, the problem of iCohala Corporation getting same is now resolved. Thank you for your patience and cooperation on this matter. - Very truly yours. .
