We are transmitting for the Council's review and consideration for acceptance a
copy of the above dedication deed, along with a resolution accepting the deed.
For your information, the deed has been reviewed by the Department of Public
Works, Department of Water Supply and the Planning Department and all have certified
that the water, road, and drainage improvements, respectively have been completed, are in
acceptable condition for dedication, and are in full compliance with applicable provisions
of Chapter 23, Hawaii County Code. These Departments have recommended acceptance
of the dedication deed, as evidenced by the letter copies enclosed. All subdivision
improvements have been completed.
For your further information, as discussed at the August 1, 2001 Committee on
Public Works & Intergovernmental Relations meeting, we have revised the Resolution to
reflect that the roadway along with all roadway and drainage improvements, including the
signs, markings and streetlights, are being dedicated to the County.
Revised letters of inspection and approval from Planning and Water departments
have also been submitted, more specifically identifying the improvements certified as
compliant with Chapter 23. Please note that Department of Public Works Engineering

Chief Galen Kuba is responsible for certifying compliance with Chapter 23, which he has
done. The attachments to his memo certifying compliance are for information only.
The Revised Dedication Deed now includes information regarding the Grant of
Easement and Bill of Sale to the County Water Board, which covers the dedication and
acceptance of the water system by the Water Board. The Dedication Deed Exhibits A and
B specify that the conveyance is subject to the title to mineral and metallic mines reserved
to the State.
With respect to the diacritical marks for Ke'eke'e, those have been applied to the
extent that the name of the subdivision does. However, to the extent that the surveyor's
description relies upon the Ahupua'a as identified in the tax maps, which do not use
diacritical marks, we have acknowledged the same, while noting the spelling with
diacriticals.
We hope that this is responsive to the concerns raised, and appreciate the
opportunity to timely hear and respond to the concerns of any Council Member.
Upon acceptance of the above dedication deed, please send a notification of such
acceptance to: (1) Central Kona Land, LLC., P.O. Box 789, Kealakekua, Hawaii 96750;
(2} William Takaba, Director of Finance, County of Hawaii; and (3) Ivan M. Torigoe,
Deputy Corporation Counsel, who will record the said deed with the Bureau of
Conveyances. Thank you.

system improvements were constructed and inspected and found to comply to our standards and are in
compliance with the provisions of Chapter 23 of the Hawaii County Code as applicable.
The subject roadway and water system improvements were dedicated and accepted by the Water Board
of the County of Hawaii by a Grant of Easement and Bill of Sale document dated April 19, 2001, and
recorded at the Bureau of Conveyances, State of Hawaii, as Document No. 2001-084428.
