Dominic Yagong ~ ~ ~ County Cotulci] County of Hawaii 25 Aupuni Street Hilo, Hawaii 96720 Rc: Request of Liloa Willard to Purchase Abandoned Roadway Portion of Kaieie Hoanesteads 2nd Series, South Hilo, h](awaii Tax Map Key No.: (3) 2-7-005 Dear Mr. Yagong: This will co:nfirxxx our phone conversation of this date in which 1 advised you that Mr. Willard and Maauia Kea Meanorial Park, through its owner/manager Mr. Ed 1V,[urty, have reached an agreement concerning the provision of an easement to the Park over the abandoned roadway for the use of the Park and the plot-holders. This agreement was reached this nnorning, aftea~ Mfr. Murty faxed you his letter dated August 27, 2001. Mr. Musty advises that he is agreeable to the following conditions to the sale of the roadway to Mr. Willard, and he advised me that he will not be in attendance at tomorrow's meeting of the Council. Mr. Willard will grant to Mauna ICea Memorial Park a perpetual, r~on-exclusive casement for ingress and egress over a portion of the abandoned roadway, extending the width thereof and extending north for a distance of 275 feet from Kaieie Road. The Park will indemnify Mr. Willard from any liability arising from the Park and its invitees and plot-holders use of the easement, and will repair at its own cost any damage to the easement arising tom such use. NIr. Willard will agree not to construct any fence along the 275 foot boundary of the Park and the easement, Y am attaching a plot plan showing the 275 foot portion of the roadway over which the easement will be granted. Y aan pleased that we have been able to resolve this rtlatter as between Mr. Willard and Mauna Kea Memorial Park, and respectfully rcyuest that yon and your fellow Council ffiembers give favorable consideration to Mr. Willard's request.
