L The Secretary's minutes of the l-ISAC Executive Committee meeting of June 26, 2001 were approved. II. The Treasurer's Reports for June 2001 and July 200-1 were approved (copies attached). III. No Executive Committee reports were received. IV. County Reports A. Hawaii County's approval of HSAC officers for FY 2001-02 and nominees for for NACo and WIR Boards of Directors was received and acknowledged. B. The undersigned presented a $1,000 check payable to HSAC from John O'Rourke of Synagro Technologies. C. Hawaii County's approval dated August 29, 2001 of the draft 2002 HSAC- Legislative Program Policy Statement was received and acknowledged. ivlaia{ County and Kauai County will take up consideration of the draft legislative pr~hc~, statement at their next scheduled council meetings. V. The undersigned reported that NACo's 66`h annual conference in Philadelphia. n .hay; 2001 was highly informative. A full packet of NACo's proposed resolutions and platform changes taken up by the NACo Board of Directors will be distributed to 'ISAC Executive Committee members for their review. VI. Unfinished Business: None J VII. New Business ~ A. Ron Kouchi congratulated the City & County of Honolulu for leading the charge on . behalf of vicious dog state legislation enabling the counties to enact their own ordinances respective to animal control and public safety. ~ ~ B. Mr. Kouchi reported that recent legislative hearings indicate still further erosion of i~_ county jurisdiction over agricultural lands. He sees additional Land Use Commission _ ~r.~ intervention and prohibitive delay of development initiatives, even if they enjoy ,~yir~oi ~ '`s ~ « vY . broad support by affected communities such as slow-impact resort project slated for Kauai's south shore near Waimea. C. Mr. Kouchi reported growing momentum of support for legislation granting the counties immunity for beach and hazardous activity liability. However, he advised committee members that for the bill to succeed in the coming session, it will likely need to be assigned to a committee not chaired by Eric Hamakawa, who has been influenced by Bob Toyofuku to kill this bill in the past. Dain Kane suggested that an informal discussion with James Krueger, a Maui attorney, might yield further insight as to the position of litigation attorneys who oppose county immunity. D. Ron Kouchi reminded the members of HSAC's longstanding position to seek one- half of one percent of the state excise tax as a appropriate source of county revenue, as opposed to the current TAT revenue sharing. He suggested that as little as one- quarter ofone percent might be sufficient to meet county revenue needs. E. HSAC committee members and their staff will confer about their respective council meeting dates in order to establish the HSAC meeting calendar for 2002. F. HSAC Executive Committee members will assemble proposed legislation submitted by each county (in draft form) at their next meeting for compilation of HSAC's legislative package and the concurrence of each county. The undersigned circulated a memorandum dated September 6, 2001 (attached) to Council Chair Arakaki and fellow council members soliciting their input on proposed legislation for the upcoming session of the Hawaii State Legislature. VIII. HSAC Mid-Year Conference President Jon Yoshimura announced that the HSAC mid-year conference will be hosted by the City and County of Honolulu. Honolulu offered to mount this conference effort (rather than Hawaii County) to acknowledge Hawaii County's considerable expenditure of effort hosting the recent WIR conference. The HSAC mid-year conference is scheduled for November 29-30 (Thursday/Friday), 2001 at the Hawaii Prince Hotel. Conference registration has been set at $150.00. A highly favorable $125/night oceanfront room rate for attendees has been offered by the Hawaii Prince Hotel. Honolulu will be sending out pre-conference notices in the next several weeks. HSAC Executive Committee and General Membership meetings will be held on the 29`n, as well as field trips, golf, and an evening hospitality event. For those who wish to stay through Saturday, arrangements are being made for attendance at the UH-BYU football game at Aloha Stadium. The conference program on Friday will focus on solid waste management, transportation issues, and water development. IX. Curtis Tyler, III, HSAC Executive Committee Membe SUBJECT: Proposals for 2002 HSAC Legislative Package I am writing to solicit your thoughts'and proposals for legislation to be included in the 2002 legislative package for adoption by the Executive Committee of the Hawaii State Association of Counties (HSAC). Some discussion of this matter will occur at the September 10, 2001. agenda of the HSAC Executive Committee in Honolulu. I will circulate a memo to you about proposals discussed by other counties promptly following this meeting. Adoption of the 2002 HSAC leb dative package is slated for October. In considering proposed state legislation, please keep in mind that HSAC's annual package of bills submitted to the legislature requires the unanimous concurrence of all four counties.
