Buck, Administrator, State Department of Land and Natural Resources, Division of Forestry and Wildlife, dated February 6, 1990, transmitting a copy of an examination of legal issues relating to Hawaii's trails and accesses, which was requested by the Legislature in 1989. States the study was researched and written by the Attorney General with assistance from the Na Ala Hele Program. Comm. 1378: CHANGE OF ZONE ORDINANCE NO. 84 23, AS AMENDED BY ORDINANCE NOS. 84 42 AND 88 4 (REZ 470) GAMLON CORPORATION TAX MAP KEY 7-6-21:04, 9-13, and 15-17 Copy of letter to Gregg Kashiwa from Planning Director Duane Kanuha dated February 8, 1990, acknowledging receipt of his January 29, 1990 letter reporting on Gamlon Corporation's present status prior to their hearing for time extension and containing an estimated construction schedule. Comm. 1388: CHANGE OF ZONE ORDINANCE NO. 88 68 U TO A-3a TAX MAP KEY 5-9-05:16 (REZ 589) Copy of lettei to Donald Ollis, Et al., from Planning Director Duane Kanuha dated February 12, 1990, informing that final subdivision approval of their property should have been secured on or before December 6, 1989, pursuant to Condition C of Ordinance No. 88 68. Requests submittal of a time extension request in which to comply with the condition within 30 days of receipt of their certified letter, stating the reasons for the PC-26 Page 2 February 28, 1990 C-1388: request, the status of the proposed development, and (cont'd) their compliance with the conditions of approval. Further, informs, pursuant to Condition H, should any of the conditions not be met or substantially complied with in a timely fashion, the Director may initiate rezoning of the area to its original or more appropriate designation. Comm. 1389: CHANGE OF ZONE ORDINANCE NO. 87 95 A-la TO CG-20 TMK: 7-5-04:29 (R566) Copy of letter to Robert W. Carlsmith, Esq., from Planning Director Duane Kanuha dated February 13, 1990, informing that the development plan submittal date of January 7, 1990, pursuant to Condition C of Ordinance No. 87 95, has lapsed. States, on May 8, 1989, the Planning Director granted him a time extension until January 7, 1990, in which to comply with the condition, but to date, no plans have been received by their office. Requests submittal of a request for time extension and a filing fee of $100 in which to comply with the condition within 30 days of receipt of their certified letter. States, since the ordinance only authorizes the Planning Director to grant a single time extension, the request must be approved by the Council. Further, should they not hear from him within the specified time frame, the Planning Director, pursuant to Condition G, may initiate procedures to rezone the subject property to its original or more appropriate designation. Comm. 1390: CHANGE OF ZONE ORDINANCE NO. 525 OPEN TO A-3a TMK: 2-5-43:07 (R343) Copy of letter to Dr. Al K. Takayama from Planning Director Duane Kanuha dated February 13, 1990, informing that the subdivision plan submittal date of February 12, 1983, pursuant to Condition B of Ordinance No. 525, has lapsed. Informs, if he intends to pursue the proposed development and wish to retain the A-3a zoning, he needs to submit a request for an extension of time in which to comply with Condition B, accompanied by a filing fee of $100, to their office within 30 days of receipt of their certified letter. States the request should state the reasons for the request, the status of the proposed development, and his compliance with the conditions of approval; further, should they not hear from him within the specified time frame, they shall have no alternative but to initiate rezoning of the property to its original or more appropriate designation. PC-26 Page 3 February 28, 1990 Comm. 1391: CHANGE OF ZONE ORDINANCE NO. 89 5 A-20a TO A-3a TMK: 7-3-24:35 (REZ 617) Copy of letter to Elizabeth McCormick from Planning Director Duane Kanuha dated February 13, 1990, informing that her annual progress report and subdivision plan submittal date of January 30, 1990, pursuant to Conditions B and G of Ordinance No. 89 5, has lapsed. Requests submittal of the annual progress report and a request for time extension in which to comply with Condition B within 30 days of receipt of their certified letter, stating the reasons for the request, the status of the proposed development and her compliance with the conditions of approval. Further, states, should they not hear from her within the specified time frame, the Planning Director, pursuant to Condition H, may initiate rezoning of the property to its original or more appropriate designation. Comm. 1394: TIME EXTENSIONS TO CONDITIONS B AND C (Bill 223) OF CHANGE OF ZONE ORDINANCE NO. 855 APPLICANTS: GARY PECK, ET AL. TAX MAP KEY: 8-3-10:5 From Planning Commission Chairman Fred Y. Fujimoto dated February 14, 1990, submitting a bill amending Section 25-88 (South Kona Zone Map), Article 3, Chapter 25 (Zoning Code) of the Hawaii County Code, relating to modifications of Conditions B and C of Ordinance No. 85-5, which reclassified 4.1302 acres of land from an Agricultural-5 acre (A-Sa) to an Agricultural-2 acre (A-2a) zoned district at Keei 2nd, South Kona. Informs the Planning Director recommended denial of the time extension to Condition B and approval of the time extension to Condition C; however, the Commission voted to recommend denial of both requests. Comm. 1413: From Donald R. Mock, Vice President, Moxie Farms, Inc., and R. T. "Doc" Halliday, Vice President, Kona Coast Services, Inc., dated February 16, 1990, informing of their support of the Planning Commission's denial of Gary Peck, et al.'s time extension request to Conditions B and C of Ordinance No. 855. PC-26 Page 4 February 28, 1990 Comm. 1400: AMENDMENT TO THE GENERAL PLAN (Bill 226) From Legislative Assistant Tadato Nagasako dated February 15, 1990, transmitting a bill to amend Subsection 6(B)(3)(a) of the Hawaii County General Plan, as requested by the Planning Committee at its meeting of January 24, 1990. Comm. 1417: SPECIAL PERMIT APPLICATION - STATE OF HAWAII DEPARTMENT OF ACCOUNTING AND GENERAL SERVICES TMK: 1-5-09:Portion of 9 Copy of letter to Sidney Fuke from Planning Commission Chairman Fred Y. Fujimoto dated February 20, 1990, informing they approved the State Department of Accounting and General Services' special permit application to allow the establishment of a new elementary school and related improvements on 10.3 acres of land situated within the State Land Use Agricultural District along the northeast side of Kahakai Boulevard and immediately adjacent to the Hawaiian Beaches Subdivision in the vicinity of the Hawaiian Shores Equestrian Center facility, Keonepoko Iki, Puna, subject to conditions, as listed. Informs the approval does not, however, sanction the specific plans submitted with the application as they may be subject to change given specific code and regulatory requirements of the affected agencies. Comm. 1418: CHANGE OF ZONE ORDINANCE N0. 87 12 APPLICANT: AHIMSA ASSOCIATES A-20a TO A-3a ADMINISTRATIVE TIME EXTENSION TO CONDITION C TMK: 5-9-07:05 (Rez 554) Copy of letter to David Palmer, dba AHIMSA Associates, from Planning Director Duane Kanuha dated February 21, 1990, informing he is being granted a time extension until October 6, 1990, in which to secure final subdivision approval in compliance with Condition C of Ordinance No. 87 12. Res. 151: STUDY TO AMEND GENERAL PLAN TMK: 2-2-33:oarcels 11, 19, 20 & 4 Requests the Planning Director to conduct a study to determine the feasibility of amending the General Plan to redesignate the properties identified as TMK: 2-2-33:parcel5 11, 19, 20 & 4 from Medium Density to Industrial Area.
